ICICI Bank Terms & Conditions for iWish Promotional offer

These Terms and Conditions (the “Terms”) apply to and regulate the iWish promotional offer provided by ICICI Bank and are in addition to and not in derogation of the Terms and Conditions applicable to ICICI Bank’s iWish program, ICICI Bank's Internet Banking services, ICICI Bank's Savings Account And ICICI Bank Recurring Deposits (collectively referred to as the “Primary Terms and Conditions”) as available on www.icicibank.com. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail. All capitalized terms used herein but not defined shall have the same meaning as specified under Primary Terms and Conditions.

I. DEFINITIONS

• “Alliance Partner” shall mean “Essel Marketing & Promotions Pvt. Ltd.” who has entered into an alliance agreement with ICICI Bank for the purpose of providing the offer.
• “Customer/s” shall mean an ICICI Net Banking User using internet banking services of ICICI Bank.
• “ICICI Bank Net Banking User” shall mean a resident who holds an ICICI Bank Savings Account and has Net Banking Services of ICICI Bank
• “ ICICI Bank Net Banking Service(s)“ shall mean Internet Banking services of ICICI Bank offered to ICICI Bank Net Banking User
• “Goal” for the purpose of this Offer shall mean an ICICI Bank iWish goal opened by a Customer/s online under any of the goal categories mentioned under ICICI bank’s iWish program.
• “Gift” for the purpose of this Offer shall mean the free gift of a FOCE watch worth Rs. 2990 from the Alliance Partner.
• “Offer” shall mean such discount(s)/benefit(s) provided by the Alliance Partner on Purchase of Products/Services using ICICI Bank Net Banking Services, during the Offer Period on the Website.
• “Offer Period” shall mean the period commencing from December 13, 2013 to January 15, 2013.
• “Primary Terms and Conditions” shall mean the Terms and Conditions applicable to the ICICI Bank's Internet Banking facility/service.
• “Products/Services” shall mean the goods/benefits/facilities offered by the Alliance Partner.
• “Promotion Code” shall mean such voucher/coupon of the Alliance Partner, as shall made available to the Customer/s by ICICI Bank, and which shall entitle the Customer/s to avail the Offer.
• “Website” shall mean the following website of the Alliance Partner http://offers.empowerreward.com/
• “Void Transaction” shall mean any transaction wherein the transaction has taken place but has been cancelled/rejected/unsuccessful by Alliance Partner

2. Offer

• This Offer is valid only on the Customer/s opening a new Goal within the Offer Period. Upon doing so, Customers would be given a Promotion Code that would entitle them to the Gift by the Alliance Partner.
• Only Shipping and handling charges of Rs. 299/- are required to to be paid by the Customer/s.
• Participation in the Offer by the Customer/s is on a voluntary basis.
• The Promotion Code received by the Bank shall bear its individual validity date. Within the validity date, the Promotion Code can be used to purchase the merchandise through ICICI Bank’s Internet Banking Services
• This Offer cannot be clubbed with any other offer, that may be made available to ICICI Bank Net Banking User/s by the Alliance Partner.
• The Offer is non-transferable, non-binding and non-encashable.
• The Offer is not valid for Void Transactions.

Redemption process:

• The Customer needs to visit the Website, to avail the Gift for the purposes of this Offer.
• Customer/s would have to select one watch, as per their choice, from the two types of watches on display at the Website for the purposes of this Offer.
• The Customer needs to enter the Promotion Code and click on “REDEEM”.
• The Customer would then have to enter their contact details and pay the shipping and handling charges of Rs. 299/- to be eligible to receive the Gift.

    All queries / returns / grievances should be marked to wecare@empowerreward.com.

Terms and Conditions applicable to the Offer prescribed by Alliance Partner

• The Promotion Code can only be redeemed against the Gift mentioned on the Website for the purposes of the Offer.
• The Promotion Code can only be used once, for either of the two watches on display, and cannot be clubbed together.
• The Promotion Code provided to the Customer/s can be only be redeemed online. The same needs to be entered during the redemption process.
• The Gift will be delivered, only in India, within 7 to 14 working days from the date of redemption of the Promotion Code.
• Any dispute shall be subject to the jurisdiction of Mumbai Courts only.
• All the Terms & Conditions of the Offer are applicable.
• Any dispute that may arise with regard to the products sold shall be resolved between the Customer and Essel Marketing & Promotions Pvt. Ltd.
• ICICI Bank shall neither be held responsible nor shall it become a party to such dispute in question.
• The Promotion Code can only be redeemed on http://offers.empowerreward.com/.
• No two offers can be clubbed on a single purchase transaction.
• All the products carry the manufacturer’s warranty only, the Alliance Partner is responsible for sales and shipping and handling only and the respective brand(s) are responsible for the service
• Only manufacturing defects will be entertained for replacement.
• Customer/s are requested to report any defects, if found in the product, within 24 hours of the receipt of the product shipment to wecare@empowerreward.com
• Colour change / Exchange of goods / Size change is not permitted.

Terms and Conditions applicable to the Offer prescribed by ICICI Bank

• This Offer is brought to you solely by the Alliance Partner. ICICI Bank is only communicating this offer on behalf of the Alliance Partner.
• ICICI Bank does not guarantee and make any representation about the usefulness, worthiness and/or character of the discount / benefit or of the Products/Services under the Offer provided by the Alliance Partner.
• Any tax or other liabilities or charges payable to the government or any other statutory authority/body or any participating establishment, which may arise or accrue to the ICICI Bank Net Banking User/s due to provision of the Offer, shall be to the sole account of the ICICI Bank Net Banking User/s. Tax deducted at source, if any, on the monetary value of the Offer shall be payable by the ICICI Bank Net Banking User/s.
• The existence of a dispute, if any, regarding the Offer shall not constitute a claim against ICICI Bank and shall be addressed directly by the Alliance Partner
• ICICI Bank holds out no warranty or makes no representation about the quality, delivery or otherwise of the goods and services or the Cash back / discounts offered by the Alliance Partner. Any dispute or claim regarding the goods, services and cash back / discounts must be resolved by the Card Holder/s with the Program Partners directly without any reference to ICICI Bank.
• ICICI Bank reserves the right to disqualify the Program Partner/s or customer/s from the benefits of the Program if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the Program.
• ICICI Bank shall not be held liable for any delay or loss that may be caused in delivery of the goods and services or the gifts / prizes.
• The Program is not available wherever prohibited and / or on merchandise / products / services for which such programs cannot be offered for any reason whatsoever.
• All issues / queries / complaints / grievances relating to the Offer, if any, shall be addressed to Alliance Partner directly at wecare@empowerreward.com without any reference to ICICI Bank. The same shall be addressed by Essel Marketing & Promotions Pvt. Ltd only up to a period of 15 days after the date of transaction/purchase. • The Offer is not available wherever prohibited and / or on products / services for which such offers cannot be made available for any reason whatsoever.
• ICICI Bank / Alliance partner reserve the right to modify/ change all or any of the terms applicable to the Offer without assigning any reasons or without any prior intimation whatsoever. ICICI Bank also reserves the right to discontinue the Offer without assigning any reasons or without any prior intimation whatsoever.
• If the ICICI Bank Net Banking User ceases to be a ICICI Bank Net Banking User at any time during the currency of the Offer Period, all the benefits under the Offer shall lapse and shall not be available to the ICICI Bank Net Banking User.
