Terms and Condition

I. Definitions

• "Alliance Partner" shall mean Avenues Infinite Pvt Ltd as "Dhamaal.com", who has entered into an alliance agreement with ICICI Bank for purpose of providing the Offer.
• "Customer/s" shall mean such customers of ICICI Bank who are using ICICI Bank Net Banking Service(s) for the purpose of this offer.
• "ICICI Bank Net Banking User" shall mean a person who holds an ICICI Bank savings account, loan / facility account(s)1, depository account(s) and/or any other type of account(s), so maintained with ICICI Bank or its Affiliate which are eligible account(s) for purposes of ICICI Bank Net Banking Service(s) and who has received communication from ICICI Bank with respect to the Offer.
• "ICICI Bank Net Banking Service(s)" shall mean internet banking services of ICICI Bank offered to ICICI Bank Net Banking User.
• "Offer" shall mean such discount(s) /benefit(s) provided by the Alliance Partner on purchase of Products/Services using ICICI Bank Net Banking Services, during the Offer Period on the Website.
• "Offer Period" shall mean the period commencing from August 15, 2014 till September 14, 2014, both days inclusive.
• "Primary Terms and Conditions" shall mean the terms and conditions applicable to ICICI Bank’s internet banking facility/service.
• "Products/Services" shall mean the goods/benefits/facilities offered by the Alliance Partner.
• "Website" shall mean the following website of the Alliance Partner: www.dhamaal.com. 
• "Void Transaction" shall mean any transaction wherein the transaction has taken place but has been canceled /rejected /declared unsuccessful by Alliance Partner.

All capitalized terms used but not defined herein shall have the respective meanings prescribed to them in the Primary Terms and Conditions. These terms ("Terms") shall be in addition to and not in derogation of the Primary Terms and Conditions. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail.

• The Alliance Partner shall offer flat Rs.250 off on every successful purchase above Rs.500 on Dhamaal.com. This offer shall be shared to all Customers who have transacted atleast once on www.IRCTC.com using ICICI Bank Net Banking Services during the offer period.

• Minimum order value Rs.500.
  Maximum discount Rs.250.

Redemption Process

• Log on to www.dhamaal.com.
• Select the products of choice.
• Enter the promo code sent by ICICI Bank on your registered email id and / or in the mail box in the logged in section.
• Make payment using ICICI Bank Net Banking Service, Credit card, Debit card or Prepaid/Gift card.

Customer escalation process

• All issues / queries / complaints / grievances relating to the Offer, if any, shall be addressed to Alliance Partner directly at @ Subhrajit@dhamaal.com without any reference to ICICI Bank. The same shall be addressed by Subhrajit Majumder up to a period of 15 days after the date of transaction/purchase.

II. Terms and Conditions applicable to the Offer prescribed by Alliance Partner

• This Offer is brought to you solely by the Alliance Partner. ICICI Bank is only communicating this Offer on behalf of the Alliance partner.
• Alliance Partner reserves the right to modify/ change all or any of the terms applicable to the Offer without assigning any reasons or without any prior intimation whatsoever.
• Any dispute with respect to promotion of the Offer communicated by ICICI Bank to its customer’s shall be referred to ICICI Bank.
• The existence of a dispute, if any, regarding the Offer shall not constitute a claim against ICICI Bank and shall be addressed directly by the Alliance Partner.
• Winner will be liable to pay the taxes and any other considerations, as applicable on the winning prize/prizes
• All the costs and expenses for collecting the prize will be borne solely by the winner and ICICI Bank/Alliance Partner shall not entertain any claim, whatsoever. The winner is solely responsible for any other expenses related to the acceptance and use of the Offer.
• The prize/Offer shall be non-transferable, non-negotiable and non-cashable and no such request shall be entertained by ICICI Bank/Alliance Partner. In the event of any unforeseen circumstances, ICICI Bank/Alliance Partner reserve the sole right to offer an alternative prize of the same value.
• The contest shall be governed by and construed in accordance with the laws of India. Any disputes, differences and, or, any other matters raised by the Customer in relation to and arising out of the contest and, or, pertaining to the rules and regulations and, or, these Terms and Conditions shall be referred to arbitration under the Arbitration & Conciliation Act, 1996. The arbitral tribunal shall consist of a sole arbitrator to be appointed by ICICI Bank/Alliance Partner. The venue of arbitration shall be Mumbai.
• All disputes shall be subject exclusively to Mumbai jurisdiction only.
• All prizes shall be claimed by the winners, accompanied with documents specified herein below, from ICICI Bank within 30 days from the date of publishing of the winners on the website. The documents required to be submitted along with the claim by the winner include the following :
• Identity Proof
• Address Proof
• PAN Card
• Failure to claim the prize within the aforesaid 30 days period may result in disqualification and forfeiture of the prize and/or declaration of alternate winner, which is at the sole discretion of ICICI Bank/Alliance Partner.
• The Alliance Partner will make best efforts to deliver the prize to the address provided by the winners. In the event it is not possible, it will be delivered to the nearest location where services of logistics companies exist.
• The Alliance Partner shall not be held liable for any delay or loss that may be caused in delivery of the goods and services if prevented by any reason beyond its reasonable control.
• The Alliance Partner may discontinue the Offer if it is required to do so by Card Association5, any of its facility providers or any Government or Regulatory authority. Alliance Partner holds out no warranty or makes no representation about the promotion of offer communicated by ICICI Bank to its customer’s. Any dispute or claim regarding the promotion of offer must be resolved by the ICICI Bank directly without any reference to Alliance Partner.
• The Offer is sponsored by the Alliance Partner and the Customers of ICICI Bank shall be bound by the terms and conditions stipulated by the Alliance Partner in this regard on its website.
• If the ICICI Bank Net Banking User ceases to be an ICICI Bank Net Banking User at any time during the Offer Period, all the benefits under the Offer shall lapse and shall not be available to the ICICI Bank Net Banking User.

III. Terms and Conditions applicable to the Offer prescribed by ICICI Bank

• ICICI Bank does not guarantee and make any representation about the usefulness, worthiness and/or character of the discount / benefit or of the Products/Services under the Offer provided by the Alliance Partner.
• Any tax or other liabilities or charges payable to the government or any other statutory authority/body or any participating establishment, which may arise or accrue to the ICICI Bank Net Banking User/s due to provision of the Offer, shall be to the sole account of the ICICI Bank Net Banking User/s. Tax deducted at source, if any, on the monetary value of the Offer shall be payable by the ICICI Bank Net Banking User/s.
• The existence of a dispute, if any, regarding the Offer shall not constitute a claim against ICICI Bank and shall be addressed directly by the Alliance Partner
  ICICI Bank holds out no warranty or makes no representation about the quality, delivery or otherwise of the goods and services or the Cash back / discounts offered by the Alliance Partner. Any dispute or claim regarding the goods, services and cash back / discounts must be resolved by the Customer/s7 with the Alliance Partners directly without any reference to ICICI Bank.
• This Offer cannot be clubbed with any other Offer that may be made available to the ICICI Bank Net Banking User/s by the Alliance Partner.
• The Offer is non-transferable, non-binding and non-encashable.
• The Offer is not valid for Void Transactions.
• ICICI Bank reserves the right to disqualify the Alliance Partner/s or Customer/s from the benefits of the program if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the program or otherwise by use of the ICICI Bank Net Banking Services.
• ICICI Bank shall not be held liable for any delay or loss that may be caused in delivery of the goods and services or the assured gifts / prizes.
• The program is not available wherever prohibited and / or on merchandise / products / services for which such programs cannot be offered for any reason whatsoever.
