Terms and Condition

I. DEFINITIONS

• “Alliance Partner” shall mean Panoramic Holidays Limited hereinafter called as “Magic Holidays”, who has entered into an alliance agreement with ICICI Bank for purpose of providing the Offer.
• “Program Period” shall mean the period commencing from November 24, 2014 to December 31, 2014.
• “ICICI Bank Net Banking User” shall mean a person who holds an ICICI Bank savings account, so maintained with ICICI Bank or its Affiliate which are eligible account(s) for purposes of ICICI Bank Net Banking Service(s).
• “ICICI Bank Net Banking Service(s) “shall mean Internet banking services of ICICI Bank offered to ICICI Bank Net Banking User.
• “Offer” shall mean such discount(s) /benefit(s) provided by the Alliance Partner on purchase of products using ICICI Bank Net Banking Services during the Offer Period on the Website.
• “Offer Period” shall mean the period commencing from November 15, 2014 to March 31, 2015, both days inclusive.
• "Primary Terms and Conditions" shall mean the terms and conditions applicable to ICICI Bank’s Card in addition to these Terms and Conditions.
• “Products/Services” shall mean the goods/benefits/facilities offered by the Alliance Partner.
• The offer will be applicable on the use of ICICI Bank Netbanking services on ICICI Bank payment gateway, whether provided by ICICI Bank, or any other service providers appointed by ICICI Bank.
• “Website” shall mean the following website of the Alliance Partner “www.magicholidays.info”.
• “Void Transaction” shall mean any transaction wherein the transaction has taken place but has been canceled /rejected /unsuccessful by Magic Holidays.
• All capitalized terms used but not defined herein shall have the respective meanings prescribed to them  in the Primary Terms and Conditions. These terms (“Terms”) shall be in addition to and not in derogation of the Primary Terms and Conditions. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail.

II Offers

• ICICI Bank customers top 100 spenders everyday using Netbanking services shall be entitled to get a Magic Holiday voucher which will entitle the customer a complimentary stay of 2Nights/3Days stay at the following specified Magic Holidays Resorts/Hotels
• The availability of the offer to the customer is on the basis of following premises
• Participation in the Offer by the ICICI Bank Netbanking customers is on a voluntary basis only to ICICI Bank Netbanking customers.
• The Magic Holiday voucher will entail the eligible ICICI Bank Netbanking Customers, a complimentary 2Night/3days free stay. This will be given in the form of voucher . The details on the Holidays are given in the Annexure below.
• Voucher issued to ICICI Bank Netbanking customers will be redeemed at the following locations only
• This Voucher will be valid only on the Resorts/Hotels of Panoramic Holidays Ltd. ( Magic Holidays)
• This voucher is valid for Stay Only.
• This voucher is not valid for food, beverages, travel cost etc.
• This voucher cannot be clubbed with any other offer, cash backs, discounts etc.
• This Voucher once used can’t be reused.
• This voucher is not valid for partial redemption.
• One voucher is valid only for one Booking ID.
• Booking is subject to availability and cannot be booked on black out dates.
• This Voucher cannot be exchanged for cash.

Redemption Process:  ICICI Bank customers

• ICICI bank customer to call __________ or get the invite from their website to make bookings and collect physical booking voucher.
• On confirmation from our Travel desk about his/her holiday availability, ICICI Bank Customer shall have to come to Magic Holidays venue to collect confirmation voucher. Magic holidays will show case a  45 minute presentation regarding time share schemes at a Magic Holiday venue
• Voucher issued to ICICI customers will be redeemed at the following locations only
  West zone North Zone South Zone
  Malvan Chail Mysore
  Kanha Bhimtal Kollam
  Pench Jim Corbett Kodaikanal
  Gir  
  Todhgarh  
  Karnala (Panvel)
• Specific serial number will be assigned to the vouchers and the date of issue will be mentioned.
• The voucher will have to be redeemed within 6 months from the date of issue.
• Holidays can be availed only between the following dates :-
• Oct 25’ – Dec 15 2014 || Jan 20 2015 - March 20 2015 || July 1 - Sept 20 2015
• The booking of Holidays is subject to availability
• Offer is valid for 2 adults and 2 kids below the age of 12.
• This Offer cannot be clubbed with any other offer that may be made available to the ICICI Bank customers by the Alliance Partner.
• The Offer is non-transferable, non-binding and non-encashable.
• The Offer is not valid for Void Transactions
• Vouchers will have serial numbers on it.

Terms and Conditions applicable to the Offer prescribed by Alliance Partner

• The offer is brought to you solely by Panoramic Holiday  Ltd. ICICI Bank is only communicating this offer on behalf of the Panoramic Holiday Ltd. (Magic Holidays)
• The prices and availability of products are subject to change without prior notice at the sole discretion of Panoramic Holiday Ltd.
• The coupon offers a complimentary holiday for 2nights and 3 days at a resort/hotel in the Magic Holiday destination network and is Valid for 2 adults and 2 kids below the age of 12.
• The coupon is valid for a period of 6 months from the date of issue. After its expiry, the Voucher shall stand automatically cancelled
• The coupon is valid for a holiday stay at Magic Holidays resort in West Zone: Malvan, Kanha, Pench, Gir, Todhgarh, Karnala (Panvel), Goa; North Zone: Chail, Bhimtal, Jim Corbett; South Zone: Mysore, Kollam, Kodaikanal, Alleppey
• Some resorts may not be available for operational reasons during certain period of the year.
• This Voucher will be valid only on the Resorts/Hotels of Panoramic Holidays Ltd. ( Magic Holidays)
• This voucher is valid for Stay Only.
• This voucher is not valid for food, beverages, travel cost etc.
• This voucher cannot be clubbed with any other offer, cash backs, discounts etc.
• This Voucher once used can’t be reused.
• This voucher is not valid for partial redemption.
• One voucher is valid only for one Booking ID.
• Booking is subject to availability.
• This Voucher cannot be exchanged for cash.
• By submitting this voucher to Magic Holidays, the person submitting the voucher, agrees to abide by these terms & conditions and the applicable terms and conditions on the website, www.magicholidays.info  and person undertakes not to raise any dispute on the same.
• The voucher amount is not refundable in case of cancellation of booking.
• Voucher code/Physical copy in original or both to be provided at the time of booking along with an ID proof.
• Magic Holidays is not responsible if the voucher is lost, stolen or used by anybody without permission of original holder.
• Magic Holidays is the final authority on the interpretation and applicability of the rules.
• Magic Holidays reserves the right to deny or accepting any voucher if Magic Holidays suspects that there is duplicity of vouchers.
• In no event the liability of Magic Holidays for any claims arising under this offer shall exceed the value of the voucher.
• In the event of any dispute, parties agree to refer the same to sole Arbitrator to be appointed by  Magic Holidays and Arbitrator’s decision shall be final and binding.
• Only appropriate courts in Mumbai shall have exclusive jurisdiction on any matter arising out of this Voucher.
• This Offer is only for ICICI Bank Net Customer who are individual. Any third party found using the voucher would lead to cancellation of booking and no refund would be made.
• No fake or duplicate Vouchers shall be entitled for any discount and Magic Holidays will immediately cancel such voucher and intimate to ICICI Bank, the details of voucher and person who has submitted the same for necessary action.
• Magic Holidays does not make any warranty, express or implied, with respect to the services rendered by any Hotel or any of the third parties, participating in this promotion directly or indirectly and in no event will Magic Holidays be liable for consequential, incidental, special or indirect damages or for acts of negligence or otherwise, with respect to any Hotel or any other services by third parties.
• Magic Holidays reserves the right at any time to add, alter, modify or cancel  all or any of these terms and conditions or replace wholly or in part, this discount vouchers offer by any other Offer, whether similar to this Offer or not or to withdraw it altogether without any prior notice.
• Any existing / future tax / charges levied shall be to the customer’s account.
• The apartment type that will be allocated for stay can be a Hotel unit / studio room, depending upon availability . This will vary from resort to resort.
• Accommodation is subject to availability. Limited rooms are kept aside for this offer and are made available on first come first serve basis. Magic Holiday reserves the right to refuse specific dates /resorts without giving any reasons and the Company’s decision in this regard will be final.
• This coupon is non-transferable and non-negotiable . Confirmation Voucher issued against this coupon cannot be gifted or canceled.
• Any Booking request must have 3 choices of non-overlapping dates.
• The Coupon holder needs to produce identity documents as many be required by the Company before issuing the Voucher in his /her name.
• ICICI Bank / Magic Holiday Ltd reserve the right to modify/ change all or any of the terms applicable to the Offer without assigning any reasons or without any prior intimation whatsoever. ICICI Bank also reserves the right to discontinue the Offer without assigning any reasons or without any prior intimation whatsoever.

Terms and Conditions applicable to the Offer prescribed by ICICI Bank

• This offer is brought to you solely by the alliance partner. ICICI Bank is only communicating this offer on behalf of the Alliance partner.
• ICICI Bank does not guarantee and make any representation about the usefulness, worthiness and/or character of the discount / benefit or of the Products/Services under the Offer provided by the alliance partner
• Any tax or other liabilities or charges payable to the government or any other statutory authority/body or any participating establishment, which may arise or accrue to the ICICI Bank Net Banking User/s due to provision of the Offer, shall be to the sole account of the ICICI Bank Net Banking User/s. Tax deducted at source, if any, on the monetary value of the Offer shall be payable by the ICICI Bank Net Banking User/s.
• The existence of a dispute, if any, regarding the Offer shall not constitute a claim against ICICI Bank and shall be addressed directly by the alliance partner
• ICICI Bank holds out no warranty or makes no representation about the quality, delivery or otherwise of the goods and services or the Cash back / discounts offered by the Alliance Partner. Any dispute or claim regarding the goods, services and cash back / discounts must be resolved by the Card Holder/s with the Program Partners directly without any reference to ICICI Bank.
• ICICI Bank reserves the right to disqualify the Program Partner/s or Net Banking User/s from the benefits of the Program if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the Program or otherwise by use of the services
• ICICI Bank shall not be held liable for any delay or loss that may be caused in delivery of the goods and services or the assured gifts / prizes.
• The Program is not available wherever prohibited and / or on merchandise / products / services for which such programs cannot be offered for any reason whatsoever.
• All issues / queries / complaints / grievances relating to the Offer, if any, shall be addressed to Alliance Partner directly on tel no 1800 267 1211  without any reference to ICICI Bank. The same shall be addressed by Magic Holiday Ltd only up to a period of 15 days after the date of transaction/purchase.
• All communication / notices with regard to this offer should be addressed to Panoramic Holidays Limited’s address: Aman Chambers, 4TH Floor, Opp. New Passport Office, Veer Savarkar Road, Prabhadevi, Mumbai 400025.
• The Offer is not available wherever prohibited and / or on products / services for which such offers cannot be made available for any reason whatsoever.
• ICICI Bank / Magic Holiday Ltd reserve the right to modify/ change all or any of the terms applicable to the Offer without assigning any reasons or without any prior intimation whatsoever. ICICI Bank also reserves the right to discontinue the Offer without assigning any reasons or without any prior intimation whatsoever.
• If the ICICI Bank Net Banking User ceases to be a ICICI Bank Net Banking User at any time during the currency of the Offer Period, all the benefits under the Offer shall lapse and shall not be available to the ICICI Bank Net Banking User.
