Terms and Condition

I. DEFINITIONS

• “Customer/s” for the purpose of this Offer shall mean a person who are ICICI Bank Net Banking Users.
• "ICICI Bank Net Banking User" shall mean a person who holds an ICICI Bank savings account maintained with ICICI Bank for purposes of ICICI Bank Net Banking Service(s) and who has received communication from ICICI Bank with respect to the Offer.
• “Offer” shall mean gifts/voucher/discounts made available to Customers on maximum transactions done through Net Banking. 
• "Offer Period” shall mean the period commencing from September 18, 2015 to October 03, 2015 both days inclusive.
• "Void Transactions" shall mean wherein the transaction has taken place but has been rejected /cancelled/unsuccessful at the Website of the Alliance partner.
• "Primary Terms and Conditions" shall mean the terms and conditions applicable to the ICICI Bank’s internet banking facility/service.

All capitalized terms used but not defined herein shall have the respective meanings prescribed to them in the Primary Terms and Conditions. These terms (“Terms”) shall be in addition to and not in derogation of the Primary Terms and Conditions. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail.

II. Offer details

• The iPad Air 2 shall be given to the top 5 transactors and the powerbank will be given to the next top 100 transactors during the Offer Period ("Winners").
• The following Retail Purchases / Transactions shall be considered for calculating the Targets during the Offer Period and eligibility in the Program:
• Consumer Shopping
• E-commerce
• Travel (IRCTC transactions not included)
• The top transactors will be selected on the basis of the highest value of shopping transaction using Internet Banking of ICICI Bank. If there are more than 105 eligible customers, then ICICI Bank shall select the customer who first made the transaction.
• Shopping transaction does not include Bill Payment, Prepaid Mobile Recharge or DTH Recharge.
• One customer can be eligible only once as a Winner under the Offer.
• The warranty period for the iPad Air 2 will be 1 year and for accessories the warranty will be for 6 months. The IPad Air 2 and the accessories can be serviced at any Infibeam outlet while in the warranty period.
• The warranty period of the powerbank will be 1 year
• Infibeam shall deliver the IPad Air 2 or the powerbank to the Winner’s address post confirmation from ICICI Bank.
• If the delivered IPad Air 2 or the powerbank is found damaged, Infibeam would reverse pick the damaged IPad Air 2 or the powerbank and replace the same.
• If the delivered IPad Air 2 or the powerbank is found defective, the Winner would have to get a Dead on Arrival (DOA) certificate from the brand service center and Infibeam will replace the defective IPad Air 2 or the powerbank post reverse pick up.
• ICICI Bank shall be selecting the Winners as per the criteria set out in Point 4 and Infibeam shall not be responsible for Winners’ list.
• ICICI Bank shall not be responsible for the iPad Air 2 or the powerbank delivered and the services provided by Infibeam and complaints if any about the same shall be redirected to Infibeam.
• Transactions using any other channel but ICICI Bank Internet Banking or m.icicibank.com will not be considered eligible for the Offer.
• Winners will have to make payment of 30% of the value of the iPad air 2 as gift tax for final delivery of the iPad air 2
• The customer has to confirm the acceptance and the delivery of iPad air 2 will be done post payment of the tax amount to ICICI Bank
• Winner will get the original product certificate along with the IPad Air 2 at the time of delivery.
• After the IPad Air 2 or the powerbank is delivered to the Winner, ICICI Bank shall not be responsible for any loss, damage, theft of the same.
• In all matters relating to the Offer, the decision of ICICI Bank shall be final and binding in all respects.
• The winners list will be published by November, 2015. This will be the name of all eligible winners, who can claim their iPad Air 2 after paying the gift tax of 30% of the value of the iPad Air 2.
• Dispatch of iPad Air 2 will start post confirmation from winners on accepting the gift after paying the gift tax
• Participation in the Offer by the ICICI Bank customer(s) is on a voluntary basis.
• The ICICI Bank customer(s) may avail the Offer during the Alliance Period or until the stock lasts with the alliance partners affiliate channels, whichever is earlier.
• This Offer cannot be clubbed with any other Offer that may be made available to the ICICI Bank by the Alliance Partner.
• The Offer is non-transferable, non-binding and non-encashable.

III. Terms and conditions for ICICI Bank Net Banking Customers.

• ICICI Bank shall not in any way be deemed to be making any representation whatsoever about the usefulness, worthiness, quality and/or character of the IPad Air 2 or the powerbank and the services provided by Infibeam and shall not be responsible in any way what so ever for the same. The existence of a dispute with respect to, if any, regarding the usefulness, worthiness, nature and/or quality of the IPad Air 2 or the powerbank or other services provided by Infibeam, shall not constitute a claim against ICICI Bank.
• Any tax or other liabilities or charges payable to the government or any other statutory authority/body or any participating establishment, which may arise or accrue to the ICICI Bank Net Banking User/s due to provision of the Offer, shall be to the sole account of the ICICI Bank Net Banking User/s. Tax deducted at source, if any, on the monetary value of the Offer shall be payable by the ICICI Bank Net Banking User/s.
• ICICI Bank shall not be liable in any manner whatsoever for any loss/ damage/ claim that may arise out of use or otherwise of any products or services availed by the Customer/s under this Offer.
• ICICI Bank reserves the right to disqualify the Customer/s from the benefits of the Offer if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the Offer
• ICICI Bank shall not be held liable for any delay or loss that may be caused in delivery of the goods and services or the assured gifts / prizes.
• The Offer is not available wherever prohibited and / or on products / services for which such offers cannot be made available for any reason whatsoever.
• If the ICICI Bank Net Banking User ceases to be a ICICI Bank Net Banking User at any time during the currency of the Offer Period, all the benefits under the Offer shall lapse and shall not be available to the ICICI Bank Net Banking User.
• ICICI bank has the right to withdraw the offer without any prior notice.
• ICICI Bank reserves the right to modify/ change all or any of the terms and conditions contained herein as per its discretion without assigning any reasons or without any prior intimation/notice whatsoever. ICICI Bank also reserves the right to discontinue the Contest/Offer without assigning any reasons or without any prior intimation whatsoever. ICICI Bank will not be liable in any manner whatsoever for any loss/ damage /claim/injury that may arise due to withdrawal or change in the terms and conditions of the Offer or discontinuation of it.
• The Offer is subject to applicable Indian laws and such other terms and conditions as may be stipulated by ICICI Bank. The Offer is not available wherever the same is prohibited and/or cannot be offered or for any reason whatsoever. All disputes are subject to the exclusive jurisdiction of the competent courts/tribunals of Mumbai. However, ICICI Bank reserves the right to approach any other court or tribunal of competent jurisdiction.

• This offer is applicable only for Value Banking and Privilege Banking customers
• Employees will not be eligible for the offer.
