Terms and Condition

I. Definitions

• "Alliance Partner" shall mean Hot Stuffs Private Ltd. as "hotmuggs.com", who has entered into an alliance agreement with ICICI Bank for purpose of providing the Offer.
• "Code" shall mean the promo/ discount/voucher code received by the Customer under this Offer as further defined under Clause II (Offer).
• "Program Period" shall mean the period commencing from May 20, 2015 to June 30, 2015, both days inclusive.
• "Customer/s" for the purpose of this Offer shall mean an ICICI Bank Net Banking User who is using ICICI Bank Netbanking Services of ICICI Bank and who has received communication from ICICI Bank with respect to the Offer.
• "ICICI Bank Netbanking Services" shall mean the internet banking facility/service provided by ICICI Bank.
• "ICICI Bank Net Banking User" shall mean a person who holds an ICICI Bank savings account, loan / facility account(s), depository account(s) and/or any other type of account(s), so maintained with ICICI Bank or its Affiliate which are eligible account(s) for purposes of ICICI Bank Net Banking Service(s) and who has received communication from ICICI Bank with respect to the Offer.
• "Offer" shall mean instant discount/benefit provided by the "Alliance Partner" on purchase of Products/Services using ICICI Bank Netbanking services.
• "Offer Period" shall mean the period commencing from May 20, 2015 to July 31, 2015, both days inclusive.
• "Website" shall mean the following "website" of the "Alliance Partner" www.hotmuggs.com/mymoney
• "Void Transactions" shall mean wherein the transaction has taken place but has been rejected /canceled/ been unsuccessful at the "website" of the "Alliance partner".
• "Primary Terms and Conditions" shall mean the terms and conditions applicable to ICICI Bank’s Internet banking facility/service.
• "Products/Services" shall mean the goods/benefits/facilities offered by the Alliance Partner.

All capitalized terms used but not defined herein shall have the respective meanings prescribed to them in the Primary Terms and Conditions. These terms ("Terms") shall be in addition to and not in derogation of the Primary Terms and Conditions. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail.

II. Offer

• In order to avail the Offer, the Customer/s shall have to login to ICICI Bank Net Banking Services and subscribe to My Money from ICICI Bank during the Offer Period.
• Steps to Subscribe to My Money:
  • Login to ICICI Bank Net Banking using your user id and password
  • Visit Exclusive Offerings Tab, click on My Money
  • On My Money Page, Click on I Accept Terms and Conditions
  • Click on Go to My Money
• Post subscription, promocode ("Code") shall be sent to him/her in his/her secured ICICI Bank mailbox in the logged in section and / or by SMS.
• The Code sent by ICICI Bank can be used by the Customer/s to avail this Offer during the Offer Period.
• The Code can be used by ICICI Bank Net Banking User to avail a flat Rs.245 off on Classic Medium bottle listed on the Alliance Partner’s Website (www.hotmuggs.com/mymoney).
• Steps To Avail the Offer:
  • Visit the Website.
  • Select the bottle.
  • Enter your Code at the time of booking to be eligible for the discount during checkout before making payment
  • Make Payment using ICICI Bank Net Banking Services
• To avail benefits under the Offer the ICICI Bank Net Banking User shall be required to subscribe to My Money on the Website using ICICI Bank Net Banking Service(s) during the Offer Period.
• The Offer is valid only for select set of ICICI Bank Net Banking User(s) selected at the sole discretion of ICICI Bank and who have received communication about the Offer from ICICI Bank, during the Offer Period.
• The ICICI Bank Net Banking User/s may avail the Offer during the Offer Period or until the stock lasts, whichever is earlier.
• The Code shall be sent to you via SMS / secured inbox communication in the logged in section within 45 days of the Offer Period.
• The Offer shall be available only during the Program Period; and the Code generated during the aforesaid period can be redeemed till the end of the Offer Period to avail discounts at the Website.
• Participation in the Offer by the Customer/s is on a voluntary basis.
• This Offer cannot be clubbed with any other Offer that may be made available to ICICI Bank customer/s by the Alliance Partner.
• The Offer is non-transferable, non-binding and non-encashable.
• The Offer is not valid for Void Transactions.

III. Terms and Conditions Prescribed by Alliance Partner

• The Offer is valid on purchase of select products displayed on the Website.
• The Offer is valid till stocks last.
• The Offer is valid for limited period only.
• To avail the Offer, the Customer should enter the Code. If the Customer fails to enter the Code, he/she will not be eligible for the discount.
• The benefits under the Offer cannot be clubbed with other vouchers/offers running on the Website.
• Orders shall be delivered within 20 working days.
• Orders shall be delivered only within India.
• Offers can be withdrawn without any notice.
• Offer is valid only for Retail / Individual Customers and not for Corporate / Bulk Bookings.
• This is a limited period offer and may be withdrawn during the Offer Period without prior notice.
• This Offer is conducted at the sole discretion of the Alliance Partner. In case of any disputes, the final decision will rest with the Alliance Partner.
• Any person availing of this Offer shall be deemed to have accepted these Terms and Conditions.
• ICICI Bank and Alliance Partner reserves the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change or vary all of these terms and conditions or to replace, wholly or in part, this offer by another offer, whether similar to this offer or not, or to extend or withdraw it altogether.
• ICICI Bank /Alliance Partner shall not be liable for issues related to technical, human error whatsoever e.g. wrong Code being entered by the Customer or Customer being logged out of system.
• Any and all taxes, including without any limitation income tax (if any) applicable on this Offer and the rewards / benefits thereto shall be borne by the Customer & shall deposit the applicable amount of taxes (if any) to applicable governmental authorities before user could avail any benefits, unless otherwise mandated under the applicable laws.
• All disputes, if any, arising out of or in connection with or as a result of above offers or otherwise relating hereto shall be subject to the exclusive jurisdiction of the competent courts / tribunals in Mumbai only, irrespective of whether courts / tribunals in other areas have concurrent or similar jurisdiction.

IV. Terms prescribed by ICICI Bank

• This Offer is brought to you solely by the Alliance Partner. ICICI Bank is only communicating this Offer on behalf of the Alliance Partner.
• The participation in the Offer shall be deemed to be acceptance of all the terms and conditions governing the Offer.
• Any tax or other liabilities or charges payable to the government or any other statutory authority/body or any participating establishment, which may arise or accrue to the Customer due to provision of the Offer, shall be to the sole account of the Customer. Tax deducted at source, if any, on the monetary value of the Offer shall be payable by the Customer/s.
• The existence of a dispute, if any, regarding the Offer shall not constitute a claim against ICICI Bank and shall be addressed directly and solely by the Alliance Partner.
• ICICI Bank holds out no warranty or makes no representation about the quality, delivery, worthiness or otherwise of the Products/Services or the Cash back / discounts offered by the Alliance Partner. Any dispute or claim regarding the Product/Services and cash back / discounts must be resolved by the Customer with the Alliance Partners directly without any reference to ICICI Bank.
• ICICI Bank reserves the right to disqualify the Alliance Partner/s or the Customer from the benefits of the Offer, if any fraudulent activity is identified as being carried out for the purpose of availing such benefits or otherwise.
• ICICI Bank shall not be held liable for any delay or loss that may be caused in delivery of the Products/Services or the assured gifts / prizes by the Alliance Partner.
• All issues / queries / complaints / grievances relating to the Offer or Products/Services, if any, shall be addressed to the Alliance Partner directly without any reference to ICICI Bank. The same shall be addressed by the Alliance Partner only up to a period of 15 days after the date of transaction/purchase.
• The Offer is not available wherever prohibited and / or on Products / Services for which such offers cannot be made available for any reason whatsoever.
• ICICI Bank / Alliance Partner reserve the right to modify/ change all or any of the terms applicable to the Offer without assigning any reasons or without any prior intimation whatsoever. ICICI Bank also reserves the right to discontinue the Offer without assigning any reasons or without any prior intimation whatsoever.
• ICICI Bank will not be liable in any manner whatsoever for any loss/ damage /claim/injury that may arise due to withdrawal or change in the terms and conditions of the Offer.
• If the ICICI Bank Net Banking User/Cardholder ceases to be a ICICI Bank Net Banking User /Cardholder at any time during the currency of the Offer Period, all the benefits under the Offer shall lapse and shall not be available to the ICICI Bank Net Banking User/Cardholder.
