Terms and Condition

I. Definitions

• "Alliance partner" shall mean eBay India Pvt Ltd as "eBay.in", who has entered into an alliance agreement with ICICI Bank for purpose of providing the Offer.
• "Customer/s" for the purpose of this Offer shall mean a person who is using ICICI bank Netbanking services or holds a valid Pockets shopping card issued by ICICI Bank and who has received communication from ICICI Bank with respect to the Offer.
• "ICICI Bank Net Banking User" shall mean a person who holds an ICICI Bank savings account, loan / facility account(s), depository account(s) and/or any other type of account(s), so maintained with ICICI Bank or its Affiliate which are eligible account(s) for purposes of ICICI Bank Net Banking Service(s) and who has received communication from ICICI Bank with respect to the Offer.
• "Pockets user" shall mean a customer to whom the Facility has been granted by virtue of downloading and activating the application.
• "Pockets shopping card" shall mean card, which has been issued by ICICI Bank and is valid and subsisting during the Program Period.
• "Offer" shall mean instant discount/benefit provided by the "Alliance partner" on purchase of Products/Services using Pockets application or Netbanking services.
• "Offer Period" shall mean the period commencing from May 20, 2015 to May 26, 2015, both days inclusive.
• "Mobile" shall mean the following "m.site" of the Alliance partner "m.ebay.in" or using eBay mobile app
• "Void Transactions "shall mean wherein the transaction has taken place but has been rejected /canceled/ been unsuccessful at the "website"" of the "Alliance partner".
• "Primary Terms and Conditions" shall mean the terms and conditions applicable to ICICI Bank’s Internet banking facility/service .
• "Products/Services" shall mean the goods/benefits/facilities offered by the Alliance Partner.

All capitalized terms used but not defined herein shall have the respective meanings prescribed to them in the Primary Terms and Conditions. These terms ("Terms") shall be in addition to and not in derogation of the Primary Terms and Conditions. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail.

II. Offer

ICICI Bank customers will be entitled to get an Additional 10 off* with a maximum discount of 2000 per transaction on eBay India mobile Site (m.ebay.in) or on the Mobile application (eBay.in app)

The availability of the offer is based on the following criteria:

• To avail benefits under the Offer the ICICI Bank Net Banking User/Pockets user shall be required to make a transaction/purchase on the Website using ICICI Bank Net Banking Service(s) during the Offer Period from May 20, 2015 to May 26, 2015 both days inclusive.
• The Offer is valid only for select set of ICICI Bank Net Banking User(s)/Pockets user(s) selected at the sole discretion of ICICI Bank and who have received communication about the Offer from ICICI Bank, during the Offer Period.
• Participation in the Offer by the ICICI Bank Net Banking User/s/Pockets user(s) is on a voluntary basis.
• The ICICI Bank Net Banking User/s /Pockets user(s) may avail the Offer during the Offer Period or until the stock lasts, whichever is earlier.
• This Offer cannot be clubbed with any other Offer that may be made available to the ICICI Bank Net Banking User/s/Pockets user(s) by the Alliance Partner.
• The Offer is non-transferable, non-binding and non-encashable.
• The Offer is not valid for Void Transactions.

III. Steps To Avail The Offer

• Visit www.eBay.in, m.ebay.in or eBay Mobile app.
• Select products of choice.
• Enter your coupon code "POCKETS10P" at the time of booking to be eligible for the discount during checkout before making payment.
• Make your Payment through ICICI Bank Net Banking or Pockets wallet by ICICI Bank

IV. Terms and Conditions Prescribed by Alliance Partner

• The offer is valid on purchase of all products displayed on the www.eBay.in, m.site or mobile app.
• To avail the discount on www.eBay.in, m.ebay.in or mobile app, the ICICI Bank net banking user/Pockets user should enter the promo code to avail the offer. If the ICICI Bank Net banking user fails to enter the promo code, the customer will not be eligible for the discount .
• The offer is valid on purchase of all products on m.ebay.in or mobile app from June 15, 2015 to Jun 20, 2015; both days inclusive
• Customer cannot club two offers during the same transaction. The discount benefit cannot be combined with any other promotional benefit offered for bookings on www.eBay.in m.ebay.in or mobile app.
• ICICI Bank Internet Banking user/Pockets user needs to quote the deal code "POCKETS10P" at the time of booking to be eligible for the discount
• The ICICI Bank Netbanking user/ Pockets user(s) will be required to make payment as per the price quoted by Alliance partner on www.eBay.in ,m.ebay.in or mobile app.
• Service charges as applicable shall be payable by the Customer.
• Prior to using the www.eBay.in, m.ebay.in or mobile app, the Customer should read and understand the User Agreement of the said website and proceed to make purchases only if the Account holder agrees to abide by the same. The Customer shall be required to give personal information and account details online for the products purchased on www.eBay.in, m.ebay.in or mobile app. The ICICI Bank user should read and understand the Privacy policy for the eBay India Pvt Ltd, prior to providing such information.
• Any person availing of this offer shall be deemed to have accepted these Terms and Conditions.
• ICICI Bank Net Banking user(s)/Pockets user(s) are advised to go through the privacy policy for the eBay website, prior to providing such information.
• You (means the person using this promotion with the intent to receive assured free gift under the ICICI Promotion Offer or the eBay User) should not be in violation and agree to abide with this terms and conditions, the eBay User Agreement, PaisaPay User agreement, eBay Site rules and policies.
• eBay India & ICICI Bank reserves the right at anytime to amend / add / remove / modify (in whole or part) any of the terms & conditions of this ICICI Promotion Offer, or to replace, wholly or in part, this ICICI Promotion Offer by another Promotion/ Offer, whether similar to this ICICI Promotion Offer or not, or to withdraw it altogether, and eBay India's decision in this regard shall be final.
• All decisions of eBay India regarding running / process / results, of the promotion, data selection shall be final and binding on all participants of this promotion, including you. No appeals will be entertained in this regard.
• In the event of circumstances arising outside of eBay India's control, which in eBay India's opinion make it necessary to suspend, substitute, change or cancel the Offer, eBay India reserves the right to suspend, change, substitute or cancel the Offer at any time without any notice.
• If eBay India has suspicion or knowledge, that any entrant has been involved in any fraudulent or illegal activity related to this ICICI Promotion Offer, eBay India reserves the right to disqualify that entrant and any related entrants. Any entrant user of the eBay Site who, knowingly and with intent to injure, defraud or deceive, files a Fraudulent Complaint containing false, incomplete, or misleading information may be guilty of a criminal offence and will be prosecuted to the fullest extent of the law. eBay India reserves all the rights including but not limited to suspend, block, restrict, cancel the user id and remove all listings of the errant eBay User and its related user id's on the eBay Site.
• eBay India shall not be liable for issues related to technical, human error whatsoever e.g. wrong promotion number being entered by you or you being logged out of system.
• eBay India does not accept, and is not responsible for, any lost or delayed data, communication. eBay India reminds you of the nature and limitations of the Internet and is not responsible for any problems, technical malfunctions of any communications network, online system, computer hardware/ software failure, human error, things outside the control of eBay India that may affect entry/participation to the ICICI Promotion Offer.
• The products or services are listed by third parties, who are responsible and liable for complying with commitments, communications, understanding including but not limiting to guarantees, warranties, services (pre, post sales) between them and you, as also complying with applicable law of the land.
• You understand and agree that participation in the Offer is good and sufficient consideration for you to agree and be bound by these Terms and Conditions.
• Any and all taxes, including without any limitation income tax (if any) applicable on this Offer and the rewards / benefits thereto shall be borne by you and you shall deposit the applicable amount of taxes (if any) to eBay / contract administrator / applicable governmental authorities before user could avail any benefits, unless otherwise mandated under the applicable laws.
• All Gift Code should be redeemed within the promotion period only.
• All communications with you will be, on your email (ID registered on eBay Site) and / or community board.
• The employees and the immediate family members of the employees of eBay India and its associate companies are NOT eligible to participate in the Offer.
• All disputes, if any, arising out of or in connection with or as a result of above offers or otherwise relating hereto shall be subject to the exclusive jurisdiction of the competent courts / tribunals in Mumbai only, irrespective of whether courts / tribunals in other areas have concurrent or similar jurisdiction.

V. Terms prescribed by ICICI Bank

a) Terms and conditions prescribed for ICICI Bank Netbanking Users

• The offer is brought to you by the Alliance partner. ICICI Bank is only communicating the offer on behalf of the Alliance Partner.
• The Offer is valid only for select set of ICICI Bank Net Banking User(s) selected at the sole discretion of ICICI Bank and who have received communication about the Offer from ICICI Bank, during the Offer Period.
• Participation in the Offer by the ICICI Bank Net Banking User/s is on a voluntary basis.
• The ICICI Bank Net Banking User/s may avail the Offer during the Offer Period or until the stock lasts, whichever is earlier.
• This Offer cannot be clubbed with any other Offer that may be made available to the ICICI Bank Net Banking User/s by the Alliance Partner.
• The Offer is non-transferable, non-binding and non-encashable.
• The Offer is not valid for Void Transactions
• ICICI Bank does not guarantee and make any representation about the usefulness, worthiness and/or character of the discount / benefit or of the Products/Services under the Offer provided by the Alliance Partner.
• Any tax or other liabilities or charges payable to the government or any other statutory authority/body or any participating establishment, which may arise or accrue to the ICICI Bank Net Banking User/s due to provision of the Offer, shall be to the sole account of the ICICI Bank Net Banking User/s. Tax deducted at source, if any, on the monetary value of the Offer shall be payable by the ICICI Bank Net Banking User/s.
• All issues / queries / complaints / grievances relating to the Offer, if any, shall be addressed to Alliance Partner directly at without any reference to ICICI Bank. The same shall be addressed by e-bay, only up to a period of 2 days after the date of transaction/purchase.
• The existence of a dispute, if any, regarding the Offer shall not constitute a claim against ICICI Bank and shall be addressed directly by eBay.

• The Offer is not available wherever prohibited and / or on products / services for which such offers cannot be made available for any reason whatsoever.
• ICICI Bank/Alliance Partner reserve the right to modify/ change all or any of the terms applicable to the Offer without assigning any reasons or without any prior intimation whatsoever. ICICI Bank also reserves the right to discontinue the Offer without assigning any reasons or without any prior intimation whatsoever.
• If the ICICI Bank Net Banking User ceases to be an ICICI Bank Net Banking User at any time during the currency of the Offer Period, all the benefits under the Offer shall lapse and shall not be available to the ICICI Bank Net Banking User.

b) Terms and conditions prescribed Pockets app by ICICI Bank

• ICICI Bank holds out no warranty or makes no representation about the quality, delivery or otherwise of the goods and services offered by the alliance partner. Any dispute or claim regarding the goods, services and assured gifts / prizes must be resolved by the Pockets user(s) with the alliance partner directly without any reference to ICICI Bank.
• ICICI Bank shall not be liable in any manner whatsoever for any loss/ damage/ claim that may arise out of use or otherwise of any goods/ services / offer availed by the Card Holder/s under the alliance offered by the alliance partner.
• ICICI Bank reserves the right to disqualify the Alliance Partner/s or Pockets user(s)/s from the benefits of the alliance if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the alliance or otherwise by use of the Pockets app.
• The Offer is sponsored by the Alliance Partner and the Pockets user(s) shall be bound by the terms and conditions stipulated by the alliance Partner in this regard.
• ICICI Bank shall not be held liable for any delay or loss that may be caused in delivery of the goods and services.
• The Offer is not available wherever prohibited and / or on merchandise / products / services for which such alliances cannot be offered for any reason whatsoever.
