Terms and Condition

I. Definitions

• "Alliance Partner" shall mean Pisces eservices Pvt. Ltd. (known as www.foodpanda.in), who has entered into an alliance agreement with ICICI Bank for purpose of providing the Offer.
• "ICICI Bank Internet Banking customer" shall mean a person who holds an ICICI Bank savings account, credit card account(s), loan / facility account(s), depository account(s) and/or any other type of account(s), so maintained with ICICI Bank or its Affiliate which are eligible account(s) for purposes of ICICI Bank Internet Banking Service(s) and who has received communication from ICICI Bank with respect to the Offer.
• "ICICI Bank Internet Banking Service(s) "shall mean internet banking services of ICICI Bank offered to ICICI Bank internet banking registered customers.
• "Offer" shall mean such discount(s) /benefit(s) provided by the Alliance Partner on purchase of Products/Services using ICICI Bank Internet Banking Services, during the Offer Period on the Website.
• "Offer Period" shall mean the period commencing from May 11, 2015 to May 31, 2015, both days inclusive.
• "Primary Terms and Conditions" shall mean the terms and conditions applicable to ICICI Bank’s Internet banking facility/service.
• "Products/Services" shall mean the goods/benefits/facilities offered by the Alliance Partner.
• "Website" shall mean the following website of the Alliance Partner www.foodpanda.in.
• "Void Transaction" shall mean any transaction wherein the transaction has taken place but has been can celled /rejected /unsuccessful by the Alliance Partner.

All capitalized terms used but not defined herein shall have the respective meanings prescribed to them in the Primary Terms and Conditions. These terms ("Terms") shall be in addition to and not in derogation of the Primary Terms and Conditions. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail.

II. Terms and Conditions for Get a Tab a day Offer.

• The offer "get a tab everyday" is applicable for Fund Transfer, Bill Pay, Recharge Prepaid Mobile/DTH transactions using ICICI Bank Internet Banking.
• The Tab will be given to the Top 3 transactors per day during the offer period.
• Warranty period will be as per product.
• OTS e-solution Pvt Ltd will deliver the product to winner’s address post confirmation from ICICI Bank.
• If the delivered product is found defective, the customer would have to get a Dead on Arrival (DOA) certificate from the brand service center and OTS e-solution Pvt Ltd will replace post reverse pick up.
• If the delivered product is found damaged, we would reverse pick the product and replace the same.
• OTS e-solution Pvt Ltd will not be responsible for winners’ list and it will be at the sole discretion of ICICI Bank to choose winners as per the criteria set in the offer.
• ICICI Bank will not be responsible for product delivered by OTS e-solution Pvt Ltd and complaints if any about the product will be redirected to OTS e-solution Pvt Ltd.
• The Top 3 transactors will be chosen as per the offer criteria.
  • Eligibilty criteria – customer has to do 2 or more transactions using ICICI Bank Internet Banking. The 2 transactions should be for 2 different products. However, for more than 2 transactions customer can do transaction for same product more than once.
  • The winner will be decided as per the highest number and highest value of transaction.
  • Example: If Customer A has done Fund Transfer, Bill Pay and Prepaid Mobile Recharge worth Rs 100000 and Customer B has done Fund Transfer and Bill worth Rs 100000, Customer A will be higher since his number of transactions are higher. Hence, for choosing the winner both number and value of transaction will be considered.
• . If there are more than 3 eligible customers, then ICICI Bank will choose the customer who came in first to do the transaction.
• Fund transfer, Bill pay and Recharge using any other channel but ICICI Bank Internet Banking will not be valid for the offer.
• Fund transfer to own account will be not considered.
• The Top3 transactors every day will be given the Tab.
• The offer is valid from April 13 to April 30, 2015.
• Customer will not have to do any payment to receive the payment.
• Customer will get the original product certificate along with the product during delivery.
• Employees will not be able eligible for the offer.

III. General Terms

• ICICI Bank does not guarantee and make any representation about the usefulness, worthiness and/or character of the discount / benefit or of the Products/Services under the Offer provided by the Alliance Partner.
• Any tax or other liabilities or charges payable to the government or any other statutory authority/body or any participating establishment, which may arise or accrue to the ICICI Bank Internet Banking customer/s due to provision of the Offer, shall be to the sole account of the ICICI Bank Internet Banking Customers. Tax deducted at source, if any, on the monetary value of the Offer shall be payable by the ICICI Bank Internet Banking Customer/s.
• The existence of a dispute, if any, regarding the Offer shall not constitute a claim against ICICI Bank and shall be addressed directly by the Alliance Partner.
• All communication / notices with regard to this Offer should be addressed.
• The Offer is not available wherever prohibited and / or on products / services for which such offers cannot be made available for any reason whatsoever.
• ICICI Bank/Alliance Partner reserve the right to modify/ change all or any of the terms applicable to the Offer without assigning any reasons or without any prior intimation whatsoever. ICICI Bank also reserves the right to discontinue the Offer without assigning any reasons or without any prior intimation whatsoever.
