Terms and Condition

I. Definitions

• “Offer” shall mean the campaign for "win 3 smartphone daily" which shall be applicable for fund transfer, bill pay, recharge, insurance payment, online shopping transactions using the ICICI Bank Internet Banking or iMobile or m.icicibank.com. (online shopping will not be applicable for iMobile)
• “Customer/s” for the purpose of this offer shall mean a person who are ICICI Bank Net Banking Users and iMobile users.
• “Offer Period” shall mean Offer will be valid from November 01, 2015 to November 22, 2015.
• “Winners” shall mean to the top transactors per day on each channel – ICICI Bank Internet Banking / iMobile / m.icicibank.com to whom a smartphone shall be given during the Offer Period
• "Primary Terms and Conditions" shall mean the terms and conditions applicable to ICICI Bank's Internet Banking Service.
• “ICICI Bank Net Banking Service(s)” shall mean internet banking services of ICICI Bank offered to the Internet Banking users.
• “Net Banking User(s)” shall mean a person who holds an ICICI Bank savings bank account  and is using ICICI Bank Net Banking Services.
• All capitalized terms used but not defined herein shall have the respective meanings prescribed to them in the Primary Terms and Conditions. These terms ("Terms") shall be in addition to and not in derogation of the Primary Terms and Conditions. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail. 
• “Channel”  shall mean using ICICI Bank Netbanking Services or iMobile or m.icicibank.com

II. Steps to avail the Offer

• The top transactor will be selected on the below criteria:
• Customer needs to be the highest transactor on any of the channel on a particular day
• The highest transactor ( value and volume wise) will win a smartphone, one each day, on each channel
• The transactions which will be considered – Fund Transfer, Bill Pay, Recharge, Insurance payment, online shopping (as payment mode for Internet Banking and m.icicibank.com. Online shopping will not be applicable for iMobile)

III. General Terms and Conditions

• Fund transfer by the Customer to his/her own account will not be eligible to be considered for this Offer.
• One customer can be eligible only once a Winner under the Offer.
• The transaction time considered will be from 9am to 6pm.
• This Offer is applicable only for Value Banking and Privilege Banking customers
• Employees will not be eligible for the Offer
• The Winners list will be published by January 01, 2016. This will be the name of all eligible Winners, who will be sent their smartphone at their registered address
• The warranty period for the smartphone will be 1 year and for accessories the warranty will be for 6 months. The Smartphone and the accessories can be serviced at any service centre of the smartphone while in the warranty period.
• OTS –e solutions shall deliver the Smartphone to Winner’s address post confirmation from ICICI Bank.
• If the delivered Smartphone is found damaged, OTS-e solutions would reverse pick the damaged Smartphone and replace the same.
• If the delivered Smartphone is found defective, the Winner would have to get a Dead on Arrival (DOA) certificate from the brand service center and OTS-e solutions will replace the defective Smartphone post reverse pick up.
• ICICI Bank shall be selecting the Winners as per the criteria set out in “Steps to avail the offer” and OTS-e solutions shall not be responsible for Winners’ list.
• ICICI Bank shall not be responsible for the smartphone delivered and the services provided by OTS-e solutions and complaints if any about the same shall be redirected to OTS-e solutions.
• Transactions using any other channel but ICICI Bank Internet Banking or iMobile or m.icicibank.com will not be considered eligible for the Offer.
• Winner will get the original product certificate along with the Smartphone at the time of delivery.
• After the Smartphone is delivered to the Winner, ICICI Bank shall not be responsible for any loss, damage, theft of the same.
• Any queries/communication/notice regarding the Offer should be sent to ICICI Bank’s 24 HOUR CUSTOMER CARE
• Suggestions/Grievances if any have to be registered with ICICI Bank Customer care maximum within 60 days of offer completion.
• In all matters relating to the Offer, the decision of ICICI Bank shall be final and binding in all respects.
• ICICI Bank shall not in any way be deemed to be making any representation whatsoever about the usefulness, worthiness, quality and/or character of the Smartphone and the services provided by OTS-e solutions and shall not be responsible in any way what so ever for the same. The existence of a dispute with respect to, if any, regarding the usefulness, worthiness, nature and/or quality of the Smartphone or other services provided by OTS-e solutions, shall not constitute a claim against ICICI Bank.
• Any tax or other liabilities or charges payable to the government or any other statutory authority/body or any participating establishment, which may arise or accrue to the ICICI Bank Net Banking User/s due to provision of the Offer, shall be to the sole account of the ICICI Bank Net Banking User/s. Tax deducted at source, if any, on the monetary value of the Offer shall be payable by the ICICI Bank Net Banking User/s.
• The Offer is not available wherever prohibited and / or on products / services for which such offers cannot be made available for any reason whatsoever.
• ICICI Bank reserves the right to modify/ change all or any of the terms and conditions contained herein as per its discretion without assigning any reasons or without any prior intimation/notice whatsoever. ICICI Bank also reserves the right to discontinue the Contest/Offer without assigning any reasons or without any prior intimation whatsoever. ICICI Bank will not be liable in any manner whatsoever for any loss/ damage /claim/injury that may arise due to withdrawal or change in the terms and conditions of the Offer or discontinuation of it.
• ICICI Bank shall not be liable in any manner whatsoever for any loss/ damage/ claim that may arise out of use or otherwise of the smartphone availed by the Customer/s under this Offer.
• If the ICICI Bank Net Banking User ceases to be a ICICI Bank Net Banking User at any time during the currency of the Offer Period, all the benefits under the Offer shall lapse and shall not be available to the ICICI Bank Net Banking User.
• The Offer is subject to applicable Indian laws and such other terms and conditions as may be stipulated by ICICI Bank. The Offer is not available wherever the same is prohibited and/or cannot be offered or for any reason whatsoever. All disputes are subject to the exclusive jurisdiction of the competent courts/tribunals of Mumbai. However, ICICI Bank reserves the right to approach any other court or tribunal of competent jurisdiction.
