Terms and Condition

I. Definitions

• “Offer” shall mean the campaign for "Internet Banking – Free Skullcandy Headphones Offer" under which Gift shall be given to the Winners during the Offer Period .
• “Alliance Partner” shall mean Flatworld Trading Pvt. Ltd.
• “Gift” shall mean Skullcandy headphones.
• “Customer/s” for the purpose of this Offer shall mean ICICI savings bank account holders who are ICICI Bank net banking users and do transactions using internet banking..
• “Offer Period” shall mean Offer will be valid till November 30, 2017.
• “Winners” shall mean the top 100 Customers who have done the maximum number of transactions during the Offer Period on ICICI Bank internet banking to whom Gift shall be given during the Offer Period
• "Primary Terms and Conditions" shall mean the terms and conditions applicable to ICICI Bank's internet banking service.
• All capitalized terms used but not defined herein shall have the respective meanings prescribed to them in the Primary Terms and Conditions. These terms ("Terms") shall be in addition to and not in derogation of the Primary Terms and Conditions. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail. 
• “Channel” shall mean using ICICI Bank net banking services.

II. Offer construct

• The Offer is valid only for Customers selected at the sole discretion of ICICI Bank and who have received communication about the Offer from ICICI Bank, during the Offer
• Customer needs to do transactions using internet banking.
• Transactions that the Customer can do are – bill Payments, fund transfer and recharge.
• If a Customer has done at least 3 of any of the above transactions, he is eligible for this Offer.
• The top 100 (hundred) Customers who have done the maximum number of transactions during the Offer Period will be declared the Winners.
• The final decision pertaining to Winner shall be that of ICICI Bank and the Alliance Partner shall not be responsible for the same
• Fund transfer by the Customer to his/her own account will not be eligible to be considered for this Offer.
• The warranty period for Gifts will be one (01) year from the date of receipt of Gift by the Winner.Alliance Partner shall deliver the Gifts to Winner’s address as available in ICICI Bank records, post confirmation from ICICI Bank.
• If the delivered Gift is found damaged, Alliance Partner would reverse pick the damaged Gift and replace the same.
• If the delivered Gift is found defective, Alliance Partner will receive the complaint on phone and replace the Gift.
• After the Gifts are delivered to the Winner, ICICI Bank shall not be responsible for any loss, damage, theft of the same

III. General Terms and Conditions

• One Customer can be eligible only once a Winner under the Offer.
• Offer not available for Customers who have won anything before through any contest/promotion done by ICICI Bank
• This Offer is applicable only for value banking, privilege banking and wealth Customers
• Employees will not be eligible for the Offer
• The Winners list will be published by December 30, 2017. This will be the name of all eligible Winners, who will be sent their smartphone at their registered address.
• The warranty period for the Gift will be 1 (one) year and for accessories the warranty will be for 6 (six) months. The Gift can be serviced at any service centre of the Gift while in the warranty period.

• Transactions using any other channel but ICICI Bank internet banking will not be considered eligible for the Offer.
• Winner will get the original product certificate along with the Gift at the time of delivery.
• After the Gifts delivered to the Winner, ICICI Bank shall not be responsible for any loss, damage, theft of the same.
• Any queries/communication/notice regarding the Offer should be sent to ICICI Bank’s 24 hour Customer care
• Suggestions/Grievances if any have to be registered with ICICI Bank Customer care maximum within 60 (sixty) days of Offer completion.
• In all matters relating to the Offer, the decision of ICICI Bank shall be final and binding in all respects.
• ICICI Bank shall not in any way be deemed to be making any representation whatsoever about the usefulness, worthiness, quality and/or character of the Gift and the services provided by the delivery partner and shall not be responsible in any way what so ever for the same. The existence of a dispute with respect to, if any, regarding the usefulness, worthiness, nature and/or quality of the Gift or other services provided by the delivery partner, shall not constitute a claim against ICICI Bank.
• Any tax or other liabilities or charges payable to the government or any other statutory authority/body or any participating establishment, which may arise or accrue to the Customer due to provision of the Offer, shall be to the sole account of the Customer/s. Tax deducted at source, if any, on the monetary value of the Offer shall be payable by the Customer/s.
• The Offer is not available wherever prohibited and / or on products / services for which such Offers cannot be made available for any reason whatsoever.
• ICICI Bank reserves the right to modify/ change all or any of the terms and conditions contained herein as per its discretion without assigning any reasons or without any prior intimation/notice whatsoever. ICICI Bank also reserves the right to discontinue the Offer without assigning any reasons or without any prior intimation whatsoever. ICICI Bank will not be liable in any manner whatsoever for any loss/ damage /claim/injury that may arise due to withdrawal or change in the terms and conditions of the Offer or discontinuation of it.
• ICICI Bank shall not be liable in any manner whatsoever for any loss/ damage/ claim that may arise out of use or otherwise of the smartphone availed by the Customer/s under this Offer.
• If the Customer ceases to be a Customer at any time during the currency of the Offer Period, all the benefits under the Offer shall lapse and shall not be available to the Customer.
• The Offer is subject to applicable Indian laws and such other terms and conditions as may be stipulated by ICICI Bank. The Offer is not available wherever the same is prohibited and/or cannot be offered or for any reason whatsoever. All disputes are subject to the exclusive jurisdiction of the competent courts/tribunals of Mumbai. However, ICICI Bank reserves the right to approach any other court or tribunal of competent jurisdiction.
• The Offer and the opportunity to participate therein are entirely voluntary. Participation in this Offer shall be deemed to be acceptance of all the Terms and Conditions governing the Offer.
• The Offer shall be governed by applicable Indian laws. All disputes arising under this Offer are subject to the exclusive jurisdiction of the competent courts of Mumbai. However, ICICI Bank reserves the right to approach any other court or tribunal of competent jurisdiction. ICICI Bank does not guarantee and make any representation about the usefulness, worthiness and/or character of the Gift under the Offer
• ICICI Bank shall not be held liable for any delay or loss that may be caused in delivery of the products/ services or the Gifts.
• ICICI Bank reserves the right to disqualify Customers from the benefits of the Offer if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the Offer or otherwise by use of the savings bank accounts.
