Terms and Condition

I. Definitions

• "Alliance Partner" shall mean OTS e Solutions Pvt Ltd, which has entered into an alliance agreement with ICICI Bank for purpose of providing the Offer.
• "Alliance Brand” shall mean Shoppers Stop Ltd., the gift vouchers of which are being provided by the alliance partner.
• "Customer/s" for the purpose of this Offer shall mean a resident Indian individual holding an ICICI Bank Savings Account and having valid access to ICICI Bank's Internet Banking Services.
• "ICICI Bank Internet Banking” shall mean internet banking services of ICICI Bank offered to the Customers.
• "Offer Period” shall mean the period during which the Offer is valid i.e. January 23, 2015 to January 31, 2015, both days inclusive.
• "Offer" shall mean the use of ICICI Bank Internet Banking by a Customer for funds transfer, mobile/dth recharge, bill payment, shopping payments to become the highest ICICI Bank Internet Banking transactor on a day during the Offer Period and being declared the Winner.
• "Winner” shall mean the customer who wins the Offer each day and who will get an E-Gift Voucher worth Rs. 5000 sponsored by the Alliance Partner.
• "Transactions” shall mean the following transactions which will be considered for the Offer:
  • Funds transfer- Transfer funds to any bank account.
  • Bill payment- Customer must register a biller and make payment or do a quick bill pay.
  • Recharge Prepaid mobile /DTH/Broadband.
  • Make shopping payments using Internet Banking- While doing online shopping select ICICI Bank Internet Banking as your payment mode.
• "Website" shall mean the website of the Alliance Brand www.shoppersstop.com.
• "Void Transactions" shall mean a transaction wherein the transaction has taken place on the Website of the Alliance Brand but has been rejected /cancelled/declared unsuccessful.
• "Primary Terms and Conditions" shall mean the terms and conditions applicable to ICICI Bank’s Internet Banking Facility/Service.
• "Products/Services" shall mean the goods/benefits/facilities offered by the Alliance Brand.

All capitalized terms used but not defined herein shall have the respective meanings prescribed to them in the Primary Terms and Conditions. These terms ("Terms”) shall be in addition to and not in derogation of the Primary Terms and Conditions. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail.

II. Offer

The Customer who carries out Transactions of the highest value on any day during the Offer Period shall be declared the Winner for that day and shall be provided with an E-Gift Card Voucher worth Rs. 5,000 by the Alliance Partner.

The availability of the offer is based on the following criteria:

• The Offer is available only to those Customers who login to their ICICI Bank Internet Banking for the first time on any one of the days during the Offer Period.
• Eligible Customer/s shall be provided an E-Gift Card Voucher in their secure Internet Banking mailbox by February 15, 2015.
• The Winner will be selected on the basis highest combined value of the Transactions using ICICI Bank Internet Banking. If there is more than 1 Winner, then ICICI Bank shall select the Customer who first executes all the Transactions and reaches the highest value.
• The E-Gift Voucher is redeemable at the Website www.shoppersstop.com, Shoppers Stop, Shoppers Stop Airport Stores, HomeStop & Mothercare which is operated by Shoppers Stop Limited within India.
• Participation in the Offer by a Customer is on a voluntary basis.
• The Customer may avail the Offer during the Offer Period or until the stocks last, whichever is earlier.
• This Offer cannot be clubbed with any other Offer that may be made available to the Customer by the Alliance Brand.
• The Offer is non-transferable, non-binding and non-encashable.
• The Offer is not valid for Void Transactions.

III. Terms and Conditions pertaining to the E-Gift Voucher

• Purchase of gift vouchers/gift Cards, Mobiles, Mobile Phone Accessories, Cameras, mp3 players, laptops, 22K & 24K Gold Jewelry & Gold Coins of any Jewelry brand is not allowed through this E-Gift Voucher.
• The E Gift Voucher can be redeemed independently on the Website and also in part by clubbing with an ICICI Bank credit/debit card OR ICICI Bank Net Banking payment option while transacting on the Website.
• The E Gift Voucher is not redeemable for cash or credit nor can be exchanged for a Gift voucher/Gift card.
• The E Gift Voucher cannot be reloaded.
• The E Gift Voucher is valid for a period of 1 year from its date of issue.
• If the E Gift Voucher is lost or stolen, neither will a new E Gift Voucher be issued nor will the money be reimbursed in any manner.
• ICICI Bank/ Alliance Partner/ Alliance Brand shall not be liable and responsible for any unauthorized and/or fraudulent purchase/s made using the E Gift Voucher. The holder of this E Gift Voucher shall be solely responsible for the safe custody of the E Gift Voucher and the credentials mentioned on it.
• No duplicate E Gift Voucher will be issued once lost.
• E Gift Voucher is the property of the Alliance Partner and should be duly returned on any request being made by the Alliance Partner.
• For balance enquiry & any other details pertaining to the E-Gift Voucher, contact the cashier at the relevant store from where the purchase is made or SMS "GCBAL (16 digit E-Gift voucher number)” to 56161 or log on to www.shoppersstop.com.
• Please carry a print out of e-gift voucher to redeem it in cases where transactions are not executed on the Website.

IV. Terms and Conditions of ICICI Bank

• ICICI Bank does not guarantee and/or make any representation about the usefulness, worthiness and/or character of the discount / benefit or of the Products/Services under the Offer provided by the Alliance Partner/Alliance Brand.
• Any Winner availing the offer shall be deemed to have accepted these Terms and Conditions.
• ICICI Bank and the Alliance Partner reserve the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change or vary all of these terms and conditions or to replace, wholly or in part, this Offer with another Offer, whether similar to this offer or not, or to extend or withdraw it altogether.
• All disputes, if any, arising out of or in connection with or as a result of above Offer or otherwise relating hereto shall be subject to the exclusive jurisdiction of the competent courts / tribunals in Mumbai only, irrespective of the courts / tribunals in other areas having concurrent or similar jurisdiction.
• The existence of a dispute, if any, regarding the Offer shall not constitute a claim against ICICI Bank and shall be addressed directly by the Alliance Partner.
• All communications / notices with regard to the said claims attributable to the Alliance Partner should be addressed to william@gadgetsguru.com.
• All issues / queries / complaints / grievances relating to the Offer, if any, shall be addressed to the Alliance Partner directly on the below mentioned email ID without any reference to ICICI Bank. The same shall be addressed by the Alliance Partner within 15 working days of transaction

• ICICI Bank shall not be held liable for any delay or loss that may be caused in delivery of the goods and services or the assured gifts / prizes.
• The Offer is not available wherever prohibited and / or on products / services for which such offers cannot be made available for any reason whatsoever.
• If the ICICI Bank user ceases to be so at any time during the Offer Period, then all the benefits under the offer shall lapse and shall not be available to such ICICI Bank user.
