Terms and Condition

I. Definitions

• "Alliance Partner" shall mean NSI Infinium Global Pvt.Ltd., which has entered into an alliance agreement with ICICI Bank for purpose of providing the Offer.
• "Customer/s" for the purpose of this Offer shall mean Value Banking and Privilege Banking of ICICI Bank who are iMobile app users and have received communication from ICICI Bank in the form of SMS, notification or email regarding the Offer.
• "Offer" shall mean such discount(s) /benefit(s) provided by the Alliance Partner on purchase of Products/Services using ICICI Bank iMobile app ,during the Offer Period. "Offer Period" shall mean the period commencing from March 29, 2017 to April 11, 2017, both days inclusive.
• “Gift” shall mean an I pad Air 2 given to the qualified winner of the offer, from the Alliance Partner.
• "Primary Terms and Conditions" shall mean the terms and conditions applicable to ICICI Bank’s internet banking facility/service.
• "Products/Services" shall mean the goods/benefits/facilities offered by the Alliance Partner.
• "Void Transaction" shall mean any transaction wherein the transaction has taken place but has been cancelled /rejected /unsuccessful by the Alliance Partner.
• "Channel" shall mean ICICI Bank iMobile app.

All capitalized terms used but not defined herein shall have the respective meanings prescribed to them in the Primary Terms and Conditions. These terms ("Terms") shall be in addition to and not in derogation of the Primary Terms and Conditions. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail.

II. Offer

• The offer "get an iPad Air 2 everyday" is applicable for fund transfer, bill pay, recharge, insurance payment transactions done by the Customer/s using the iMobile app.
• The Offer is valid only during the Offer Period.  3. The iPad Air shall be given to the top transactors per day on each channel – iMobile during the Offer Period ("Winners").
• The top transactor will be selected on the below criteria:
• Customer has to do 2 or more transactions, all on the same channel, i.e, iMobile app.  The highest transactor (value and volume wise) will win an iPad Air 2, one each day, on each channel
• The transactions which will be considered – Fund Transfer, Bill Pay, Recharge, Insurance payment, done through the iMobile app.
• Fund transfer by the customer to his/her own account will not be eligible to be considered for this Offer.
• One customer can be eligible only once as a winner under the Offer.
• The transaction time considered will be from 9am to 6pm.
• he warranty period for the iPad Air 2 will be 1 year and for the accessories the warranty will be for 6 months. The IPad Air 2 and the accessories can be serviced at any Infibeam outlet while in the warranty period.
• Infibeam shall deliver the IPad Air 2 to winner’s address post confirmation from ICICI Bank.
• If the delivered IPad Air 2 is found damaged, Infibeam would reverse pick the damaged IPad Air and replace the same.
• If the delivered IPad Air 2 is found defective, the winner would have to get a Dead on Arrival (DOA) certificate from the brand service center and Infibeam will replace the defective IPad Air 2 post reverse pick up.
• ICICI Bank shall have sole discretion in selecting the winners as per the criteria set out in Point 4.
• ICICI Bank shall not be responsible for the iPad Air 2 delivered and the services provided by Infibeam and complaints if any about the same shall be redirected to Infibeam.
• Transactions using any other channel but iMobile will not be considered eligible for the Offer.
• Winners shall have to make payment of 30% of the value of the iPad air 2 as gift tax for final delivery of the iPad air 2
• The Customer has to confirm the acceptance of____and the delivery of iPad air 2 will be done post payment of the tax amount to ICICI Bank
• Winner will get the original product certificate along with the IPad Air 2 at the time of delivery.
• After the IPad Air 2 is delivered to the winner, ICICI Bank shall not be responsible for any loss, damage, theft of the same.
• The winners list will be published by May 15, 2017. This will be the name of all eligible winners, who can claim their iPad Air 2 after paying the gift tax of 30% of the value of the iPad Air.
• Dispatch of iPad Air 2 will start post confirmation from winners on accepting the gift after paying the gift tax

III. Terms Prescribed By ICICI Bank

• In all matters relating to the Offer, the decision of ICICI Bank shall be final and binding in all respects.
• ICICI Bank shall not in any way be deemed to be making any representation whatsoever about the usefulness, worthiness, quality and/or character of the IPad Air 2 and the services provided by Infibeam and shall not be responsible in any way what so ever for the same. The existence of a dispute with respect to, if any, regarding the usefulness, worthiness, nature and/or quality of the IPad Air 2 or other services provided by Infibeam, shall not constitute a claim against ICICI Bank.
• ICICI Bank reserves the right to modify/ change all or any of the terms and conditions contained herein as per its discretion without assigning any reasons or without any prior intimation/notice whatsoever. ICICI Bank also reserves the right to discontinue the contest/Offer without assigning any reasons or without any prior intimation whatsoever. ICICI Bank will not be liable in any manner whatsoever for any loss/ damage /claim/injury that may arise due to withdrawal or change in the terms and conditions of the Offer or discontinuation of it.
• The Offer is subject to applicable Indian laws and such other terms and conditions as may be stipulated by ICICI Bank. The Offer is not available wherever the same is prohibited and/or cannot be offered or for any reason whatsoever. All disputes are subject to the exclusive jurisdiction of the competent courts/tribunals of Mumbai. However, ICICI Bank reserves the right to approach any other court or tribunal of competent jurisdiction.
• Any queries/communication/notice regarding the Offer should be sent to ICICI Bank’s 24 hour customer care
• This offer is applicable only for Value Banking and Privilege Banking customers
• Employees of ICICI Bank will not be eligible for the offer
• The winners list will be published by May 15, 2017. This will be the name of all eligible winners, who can claim their iPad Air 2 after paying the gift tax of 30% of the value of the iPad Air.
• Dispatch of iPad Air 2 will start post confirmation from winners on accepting the gift after paying the gift tax
• ICICI Bank does not guarantee and make any representation about the usefulness, worthiness and/or character of the discount / benefit or of the Products/Services under the Offer provided by the Alliance Partner.
• Any tax or other liabilities or charges payable to the government or any other statutory authority/body or any participating establishment, which may arise or accrue to the ICICI Bank Net Banking User/s due to provision of the Offer, shall be to the sole account of the ICICI Bank Net Banking User/s. Tax deducted at source, if any, on the monetary value of the Offer shall be payable by the ICICI Bank Net Banking User/s.
• All issues / queries / complaints / grievances relating to the Offer, if any, shall be addressed to Alliance Partner directly at www.amazon.in without any reference to ICICI Bank. The same shall be addressed by Alliance Partner, only as mentioned on their website
• The existence of a dispute, if any, regarding the Offer shall not constitute a claim against ICICI Bank and shall be addressed directly by the Alliance Partner.
• The Offer is not available wherever prohibited and / or on products / services for which such offers cannot be made available for any reason whatsoever.
• ICICI Bank/Alliance Partner reserve the right to modify/ change all or any of the terms applicable to the Offer without assigning any reasons or without any prior intimation whatsoever. ICICI Bank also reserves the right to discontinue the Offer without assigning any reasons or without any prior intimation whatsoever.
• If the ICICI Bank net banking user ceases to be a ICICI Bank net banking user at any time during the currency of the Offer Period, all the benefits under the Offer shall lapse and shall not be available to the ICICI Bank net banking user.
