I) DEFINITIONS

• “Alliance partner” shall mean eBay India Pvt Ltd as “eBay.in”, who has entered into an alliance agreement with ICICI Bank for purpose of providing the Offer.
• “Customer/s” for the purpose of this Offer shall mean a person who is using ICICI bank Netbanking services and who has received communication from ICICI Bank with respect to the Offer.
• “ICICI Bank Net Banking User” shall mean a person who holds an ICICI Bank savings account, loan / facility account(s), depository account(s) and/or any other type of account(s), so maintained with ICICI Bank or its Affiliate which are eligible account(s) for purposes of ICICI Bank Net Banking Service(s) and who has received communication from ICICI Bank with respect to the Offer.
• “Offer” shall mean instant discount/benefit provided by the "Alliance partner" on purchase of Products/Services using ICICI Bank Netbanking services.
• “Offer Period” shall mean the period commencing from May 22, 2014 to May 31, 2014, both days inclusive.
• "Website" shall mean the following ""website"" of the "Alliance partner" www.ebay.in
• "Void Transactions "shall mean wherein the transaction has taken place but has been rejected /cancelled/ been unsuccessful at the ""website"" of the "Alliance partner".
• "Primary Terms and Conditions" shall mean the terms and conditions applicable to ICICI Bank’s Internet banking facility/service .
• “Products/Services” shall mean the goods/benefits/facilities offered by the Alliance Partner.

All capitalized terms used but not defined herein shall have the respective meanings prescribed to them in the Primary Terms and Conditions. These terms (“Terms”) shall be in addition to and not in derogation of the Primary Terms and Conditions. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail.

II) Offer:

First 10 new logins every hour will get eBay gift vouchers worth ₹200. New login(s) means customers who login to their Internet Banking for the first time.

This offer is valid from May 22, 2014 to May 31, 2014 between 10:00 am and 10:00 pm only. The time period 10:00 am to 10:00 pm will be divided into twelve slots - 10:00 - 11:00, 11:01- 12:00, 12:01- 13:00 ...20:01- 21:00, 21:01-2200 hours. First 10 new logins in each slot will be eligible for eBay gift voucher worth ₹200

The eBay India gift voucher worth ₹200 is valid on purchase of all products at www.ebay.in and there is no minimum purchase required to redeem this voucher

Winners will be sent eBay vouchers through Internet Banking secure mailbox and through SMS (if mobile number is registered with ICICI Bank and not in DNC,NDNC)

The availability of the offer is based on the following criteria:

IV) Terms and Conditions Prescribed by Alliance Partner

• This offer is brought to you solely by eBay India Pvt Ltd. ICICI Bank is only communicating this offer on behalf of eBay India Pvt Ltd..
• The offer is valid on purchase of all products displayed on the website
• To avail the discount on www.ebay.in, the ICICI Bank net banking user/Credit card user should enter the promo code to avail the offer. If the ICICI Bank Net banking user fails to enter the promo code, the customer will not be eligible for the discount
• The offer is valid on purchase of all products on www.ebay.in till the code validity expired. Code validity will be informed along with the code
•  Customer cannot club two offers during the same transaction. The discount benefit cannot be combined with any other promotional benefit offered for bookings on www.ebay.in
• The ICICI Bank Internet Banking customer needs to quote the deal code at the time of booking to be eligible for the discount

• Service charges as applicable shall be payable by the Customer.

• Any person availing of this offer shall be deemed to have accepted these Terms and Conditions.
• ICICI Bank and eBay India Pvt Ltd reserves the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change or vary all of these terms and conditions or to replace, wholly or in part, this offer by another offer, whether similar to this offer or not, or to extend or withdraw it altogether.
• ICICI Bank Cardholders are advised to go through the privacy policy for the Ebay website, prior to providing such information.
• You (means the person using this promotion with the intent to receive assured free gift under the ICICI Promotion Offer or the eBay User) should not be in violation and agree to abide with this terms and conditions, the eBay User Agreement, PaisaPay User agreement, eBay Site rules and policies.
• eBay India reserves the right at anytime to amend / add / remove / modify (in whole or part) any of the terms & conditions of this ICICI Promotion Offer, or to replace, wholly or in part, this ICICI Promotion Offer by another Promotion/ Offer, whether similar to this ICICI Promotion Offer or not, or to withdraw it altogether, and eBay India's decision in this regard shall be final.

Any entrant user of the eBay Site who, knowingly and with intent to injure, defraud or deceive, files a Fraudulent Complaint containing false, incomplete, or misleading information may be guilty of a criminal offence and will be prosecuted to the fullest extent of the law. eBay India reserves all the rights including but not limited to suspend, block, restrict, cancel the user id and remove all listings of the errant eBay User and its related user id's on the eBay Site.
• eBay India shall not be liable for issues related to technical, human error whatsoever e.g. wrong promotion number being entered by you or you being logged out of system.
• eBay India does not accept, and is not responsible for, any lost or delayed data, communication. eBay India reminds you of the nature and limitations of the Internet and is not responsible for any problems, technical malfunctions of any communications network, online system, computer hardware/ software failure, human error, things outside the control of eBay India that may affect entry/participation to the ICICI Promotion Offer.
• The products or services are listed by third parties, who are responsible and liable for complying with commitments, communications, understanding including but not limiting to guarantees, warranties, services (pre, post sales) between them and you, as also complying with applicable law of the land.
• You understand and agree that participation in the Offer is good and sufficient consideration for you to agree and be bound by these Terms and Conditions.
• Any and all taxes, including without any limitation income tax (if any) applicable on this Offer and the rewards / benefits thereto shall be borne by you and you shall deposit the applicable amount of taxes (if any) to eBay / contract administrator / applicable governmental authorities before user could avail any benefits, unless otherwise mandated under the applicable laws.

• All disputes, if any, arising out of or in connection with or as a result of above offers or otherwise relating hereto shall be subject to the exclusive jurisdiction of the competent courts / tribunals in Mumbai only, irrespective of whether courts / tribunals in other areas have concurrent or similar jurisdiction.

• Any tax or other liabilities or charges payable to the government or any other statutory authority/body or any participating establishment, which may arise or accrue to the ICICI Bank Net Banking User/s due to provision of the Offer, shall be to the sole account of the ICICI Bank Net Banking User/s. Tax deducted at source, if any, on the monetary value of the Offer shall be payable by the ICICI Bank Net Banking User/s.
• All issues / queries / complaints / grievances relating to the Offer, if any, shall be addressed to Alliance Partner directly at without any reference to ICICI Bank. The same shall be addressed by e-bay, only up to a period of 2 days after the date of transaction/purchase.
• The existence of a dispute, if any, regarding the Offer shall not constitute a claim against ICICI Bank and shall be addressed directly by ebay.

• The Offer is not available wherever prohibited and / or on products / services for which such offers cannot be made available for any reason whatsoever.
• ICICI Bank/Alliance Partner reserve the right to modify/ change all or any of the terms applicable to the Offer without assigning any reasons or without any prior intimation whatsoever. ICICI Bank also reserves the right to discontinue the Offer without assigning any reasons or without any prior intimation whatsoever.

If the ICICI Bank Net Banking User ceases to be an ICICI Bank Net Banking User at any time during the currency of the Offer Period, all the benefits under the Offer shall lapse and shall not be available to the ICICI Bank Net Banking User.
