Terms and Condition

I. Definitions

• "Alliance Partner" shall mean Cleartrip.com, which has entered into an alliance agreement with ICICI Bank for purpose of providing the Offer.
• "Alliance Brand" shall mean Cleartrip.com, the gift vouchers of which are being provided by the alliance partner.
• "Customer/s" for the purpose of this Offer shall mean a resident Indian individual holding an ICICI Bank Savings Account and has used ICICI Bank Internet Banking for the first time and done highest financial transaction using ICICI Bank Internet Banking.
• "ICICI Bank Internet Banking" shall mean www.ICICIBank.com and its services offered to the Customers.
• "Offer Period" shall mean the period during which the Offer is valid i.e. April 18, 2015 to May 31, 2015.
• "Offer" shall mean that customer logs into ICICI Bank Internet Banking for the first time and then transacts to become the highest transactor on a day during the Offer Period and being declared the Winner.
• "Winner" shall mean the customer who wins the Offer each day and who will get an evoucher worth Rs.5000 sponsored by the Alliance Partner.
• "Transactions" shall mean the following transactions which will be considered for the Offer:
  • Funds transfer- You can transfer funds to any account.
  • Bill payment- Register a biller and make payment.
  • Prepaid mobile /DTH/Broadband recharge.
  • You can do one or more of the above transactions and all will be considered.
  • In the event of a tie, time will be the deciding factor and customer reaching the highest amount first will be declared the winner.
  • A customer can win only once.
• "Website" shall mean the website of the Alliance Brand www.Cleartrip.com.
• "Void Transactions" shall mean a transaction wherein the transaction has taken place on the Website of the Alliance Brand but has been rejected /cancelled/declared unsuccessful.
• "Primary Terms and Conditions" shall mean the terms and conditions applicable to ICICI Bank’s Internet Banking Facility/Service.
• "Products/Services" shall mean the goods/benefits/facilities offered by the Alliance Brand.

All capitalized terms used but not defined herein shall have the respective meanings prescribed to them in the Primary Terms and Conditions. These terms ("Terms") shall be in addition to and not in derogation of the Primary Terms and Conditions. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail.

II. Offer

The Customer who carries out Transactions of the highest value on any day during the Offer Period shall be declared the Winner for that day and shall be provided with an e-voucher worth Rs.5000 by the Alliance Partner.

The availability of the offer is based on the following criteria:

• The Offer is available only to those Customers who log into ICICI Bank Internet Banking for the first time and do any of the financial transactions using ICICI Bank Internet Banking: funds transfer, mobile/dth recharge, bill payment to become the highest transactor on a day during the Offer Period and being declared the Winner.
• Eligible Customer/s shall be provided an evoucher worth Rs.5000.
• The Winner will be selected on the basis highest combined value of the Transactions using ICICI Bank Internet Banking. If there is more than 1 Winner, then ICICI Bank shall select the Customer who first executes all the Transactions and reaches the highest value.
• Participation in the Offer by a Customer is on a voluntary basis.
• The Customer may avail the Offer during the Offer Period or until the stocks last, whichever is earlier.
• This Offer cannot be clubbed with any other Offer that may be made available to the Customer by the Alliance Brand.
• The Offer is non-transferable, non-binding and non-encashable.
• The Offer is not valid for Void Transactions.

Please note:

• This offer is valid only for customers who have logged into Internet Banking for the first time and have done the highest transaction (value) for the day, during the promo period of this offer.
• The final list of winners will be displayed on this page at the end of month. Winners will receive an e-Coupon in their secured mailbox within 15 days from announcement of winners.
• This offer is valid only on domestic hotel/ flight bookings
• A customer who has won in this contest once, will not be eligible for this contest again

How to redeem the offer?

• e-coupon and Pin will be sent to your secured mailbox within 15 days from display of final list of daily winners.
• Go to www.cleartrip.com and confirm your travel bookings (flight/ hotels/ both)
• To redeem this e-coupon on www.cleartrip.com, enter the e-coupon and pin before making payment.
• Up to 3 e-coupons can be used in a single transaction
• Valid for a period of 12 months from the date of purchase
• On payment page, please enter the e-coupon to get Rs.5000 discounted from your total booking cost.
• Make payment for the remaining amount exceeding Rs.5000.

Please note:

• Gift cards are not valid on bus or train bookings
• This gift cards cannot be clubbed with any other offer currently live on Cleartrip.com including cashbacks, discounts etc. on a particular credit/debit card
• This gift card is not valid for partial redemption. However any balance amount left on the used gift card can be reused within the validity period
• For cancellations of trips purchased using gift cards, a new gift card with the refund amount will be generated and sent to the email id which was used for booking the gift card
• Cleartrip is not responsible if the gift card is lost, stolen or used without permission
• The gift cards cannot be replaced, refunded, revalidated or exchanged for cash
• Cleartrip reserves the right to deny accepting any gift card if it suspects that there is duplicity of gift cards.
• In no event the liability of Cleartrip for any claims arising under this offer shall exceed the value of the gift card.
• Any misuse of this gift card will result in cancellation of the booking.
• Cleartrip is the final authority on the interpretation of these rules
• Products and services are subject to availability.
• Disputes are subject to Mumbai jurisdiction.

III. Terms and Conditions pertaining to www.Cleartrip.com

• The Cleartrip.com evoucher worth Rs.5000 is not redeemable for cash or credit nor can be exchanged for a Gift voucher/Gift card.
• If the Cleartrip.com evoucher worth Rs.5000 is lost or stolen, neither will a new evoucher be issued nor will the money be reimbursed in any manner.
• ICICI Bank/ Alliance Partner/ Alliance Brand shall not be liable and responsible for any unauthorized and/or fraudulent purchase/s made using the Cleartrip.com evoucher worth Rs.5000. The holder of this Cleartrip.com evoucher worth Rs.5000 shall be solely responsible for the safe custody of the Cleartrip.com evoucher worth Rs.5000.

IV. Terms and Conditions of ICICI Bank

• ICICI Bank does not guarantee and/or make any representation about the usefulness, worthiness and/or character of the discount / benefit or of the Products/Services under the Offer provided by the Alliance Partner/Alliance Brand.
• Any Winner availing the offer shall be deemed to have accepted these Terms and Conditions.
• ICICI Bank and the Alliance Partner reserve the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change or vary all of these terms and conditions or to replace, wholly or in part, this Offer with another Offer, whether similar to this offer or not, or to extend or withdraw it altogether.
• All disputes, if any, arising out of or in connection with or as a result of above Offer or otherwise relating hereto shall be subject to the exclusive jurisdiction of the competent courts / tribunals in Mumbai only, irrespective of the courts / tribunals in other areas having concurrent or similar jurisdiction.
• The existence of a dispute, if any, regarding the Offer shall not constitute a claim against ICICI Bank and shall be addressed directly by the Alliance Partner.
• All communications / notices with regard to the said claims attributable to the Alliance Partner should be addressed to www.Cleartrip.com.
• All issues / queries / complaints / grievances relating to the Offer, if any, shall be addressed to the Alliance Partner directly on the below mentioned email ID without any reference to ICICI Bank. The same shall be addressed by the Alliance Partner within 15 working days of transaction.
• ICICI Bank shall not be held liable for any delay or loss that may be caused in delivery of the goods and services or the assured gifts / prizes.
• The Offer is not available wherever prohibited and / or on products / services for which such offers cannot be made available for any reason whatsoever.
• If the ICICI Bank user ceases to be so at any time during the Offer Period, then all the benefits under the offer shall lapse and shall not be available to such ICICI Bank user.
