Terms and Condition

These Terms and Conditions (the “Terms”) apply to and regulate the Fixed Deposit promotional offer provided by ICICI Bank and are in addition to and not in derogation of the Terms and Conditions of ICICI Bank’s Fixed Deposit and Terms and conditions applicable to ICICI Bank's Internet Banking services (the “Primary Terms and Conditions”) as available on www.icicibank.com. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail. All capitalized terms used herein but not defined shall have the same meaning as specified under Primary Terms and Conditions.

1. Definitions

• “Alliance Partner” shall mean “Provogue India Ltd”, who has entered into an alliance agreement with ICICI Bank for the purpose of providing the Offer. “Coupon Code” shall mean the code shared by ICICI Bank to eligible customers on their registered email ID, latest by one month after the Program Period is over. Coupon code will be valid on Provogue website till December 31, 2017.
• "Customer/s" for the purpose of this Offer shall mean a resident Indian individual who has an ICICI Bank Resident Savings Account and opens a Fixed Deposit (as defined hereunder) during the Program Period for a tenure of 1 year and above, subject to such terms and conditions as shall be specified by ICICI Bank from time to time.
• "Fixed Deposit" for the purpose of this Offer shall mean an ICICI Bank Fixed Deposit opened by a Customer/s, for a minimum value of Rs.Fifty Thousand (Rs.50,000/-) subject to a maximum amount of Rs. One Crore (Rs. 1,00,00,000/-) created for a period of 1 year & above, during the Program Period and shall exclude any Linked Fixed Deposits including Money Multiplier Fixed Deposits, Quantum Optima Fixed Deposits, Fixed Deposits opened in the name of proprietors, partnerships, companies, trusts and societies, and such existing Fixed Deposits which are renewed during the Program Period
• “Offer” shall mean, that the existing and new ICICI Bank customer who opens a Fixed Deposit with ICICI Bank during the program period shall be eligible for Provogue accessories worth up to Rs 4499/- that can be availed by ICICI Bank customer by paying handling charges Rs.299/- to Rs.649/- to Provogue depending on merchandise selected. during the Offer Period on the www.provogue.com/icicitransaction
• “Program” for the purpose of this offer shall mean, creating a new ICICI Bank Fixed Deposit of ₹50,000 or more subject to a maximum amount of ₹ 1 crore for minimum tenure of 1 year.
• “Program Period” shall mean the period commencing from October 15, 2017 to November 30, 2017, both days inclusive
• “Offer Period” shall mean the period during which customer can avail the offer. Valid till December 31, 2017
• “Products/Services” shall mean the goods/benefits/facilities offered by the Alliance Partner.
• “Website” shall mean the following website of the Alliance Partner i.e. www.provogue.com/icicitransaction
• “Void Transaction” shall mean any transaction wherein the transaction has taken place but has been cancelled /rejected /unsuccessful by Provogue.
  
  All capitalized terms used but not defined herein shall have the respective meanings prescribed to them in the Primary Terms and Conditions. These terms (“Terms”) shall be in addition to and not in derogation of the Primary Terms and Conditions. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail.

Offer Details:

• Any ICICI Bank Customer who opens a new Fixed Deposit of min. Rs 50,000 and for a time period of 1 year and above during the program period shall be eligible for the offer as defined hereinabove
• Value Date of the Fixed Deposit shall be considered to ascertain the eligibility of a person for the Offer.
• Such ICICI Bank Customer can avail Alliance partner’s merchandise worth up to Rs 4499/- from Provogue by paying handling charges of Rs.299/- to Rs.649/- to Provogue depending on merchandise selected. This offer can be availed during the Offer period from the website www.provogue.com/icicitransaction
• Only one gift will be given per customer irrespective of the number of Fixed Deposits opened by the Customer during the Program Period.
• The Offer is non-transferable, non-binding and non- en-cashable.
• The Offer is not valid for Void Transactions

Steps to avail the offer:

• Customer who is eligible for the Offer shall follow the below mentioned process:
• Customer has to Log on to www.provogue.com/icicitransaction
• Apply the “Coupon code” provided by ICICI Bank to redeem the offer
• Customer shall select the merchandise as per given categories at the website of the Alliance Partner.
• Customer shall make the payment through ICICI Bank Internet Banking and the ICICI Bank Card services.
• Product selected by the ICICI Bank customer will be delivered by Alliance partner to the Customer within 30 working days
• Coupon Code will be shared with the customers within one month from Program end date on their registered email id and mobile number

2. Terms and Conditions as prescribed by the Alliance Partner

• Offer valid only on Provogue accessories as per the above-mentioned criteria.
• Customer will have to pay only handling charges of Rs.299/- to Rs.649/- to Provogue depending on merchandise selected, as per assigned terms and conditions by Provogue.
• The accessories would be delivered to the shipping address mentioned by you within 30 working days after you successfully place the order.
• Any person availing this offer shall be deemed to have accepted these Terms and Conditions.
• ICICI Bank and Provogue reserves the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change or vary all of these terms and conditions or to replace, wholly or in part, this offer by another offer, whether similar to this offer or not, or to extend or withdraw it altogether.
• All disputes, if any, arising out of or in connection with or as a result of above offers or otherwise relating hereto shall be subject to the exclusive jurisdiction of the competent courts / tribunals in Mumbai only, irrespective of whether courts / tribunals in other areas have concurrent or similar jurisdiction.
• Provogue shall not be liable for any claims or grievances solely attributable to net banking services of ICICI bank

3. Terms Prescribed by ICICI Bank

• This offer is brought to ICICI Bank Customers solely by Provogue. ICICI Bank is only communicating this offer on behalf of Provogue.
• ICICI Bank does not guarantee and make any representation about the usefulness, worthiness and/or character of the discount / benefit or of the Products/Services under the Offer provided by “Provogue.”
• The existence of a dispute, if any, regarding the Offer shall not constitute any claim against ICICI Bank and shall be addressed directly by Provogue. In the event of any customer claims arising due to any acts and omission on the part of ICICI or claims or frauds related net banking, ICICI shall be liable to address such disputes. All communication / notices with regard to the said claims attributable to Provogue should be addressed to , Provogue India Ltd., 105 / 106, Provogue house, Off New Link road , Andheri (W), Mumbai - 400 053
• All issues / queries / complaints / grievances relating to the Offer, if any, shall be addressed to Alliance Partner directly at the below mentioned email id icici@Provogue.com without any reference to ICICI Bank. The same shall be addressed by Provogue within 15 working days of transaction.

• ICICI Bank shall not be held liable for any delay or loss that may be caused in delivery of the goods and services or the assured gifts / prizes.
• The Offer is not available wherever prohibited and / or on products / services for which such offers cannot be made available for any reason whatsoever.
• ICICI Bank and Provogue together reserve the right to modify/ change all or any of the terms applicable to the Offer without assigning any reasons or without any prior intimation whatsoever. ICICI Bank also reserves the right to discontinue the Offer without assigning any reasons or without any prior intimation whatsoever after the offer period.
• If the ICICI Bank user ceases to be so at any time during the Offer Period, then all the benefits under the Offer shall lapse and shall not be available to such ICICI Bank user.
• The Offer is subject to applicable Indian laws and such other terms and conditions as may be stipulated by ICICI Bank. The Offer is not available wherever the same is prohibited and/or cannot be offered or for any reason whatsoever. All disputes are subject to the exclusive jurisdiction of the competent courts/tribunals of Mumbai. However, ICICI Bank reserves the right to approach any other court or tribunal of competent jurisdiction
• ICICI Bank reserves the right to disqualify the Alliance Partner/s or ICICI Bank Cutomer/s from the benefits of the Offer if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the Program .
• The Offer is not available wherever prohibited and / or on merchandise / products / services for which such offers cannot be offered for any reason whatsoever.
