Terms and Condition

I. Definitions

• “Alliance Partner” shall mean eBay India Pvt Ltd as “eBay”, who has entered into an alliance agreement with ICICI Bank for purpose of providing the Offer.
• “Customer/s” for the purpose of this Offer shall mean a resident Indian individual/HUF holding an ICICI Bank savings account
• “Net Banking User” shall mean a person who holds an ICICI Bank savings bank account and is using ICICI Bank Net Banking Services.
• “ICICI Bank Net Banking Service(s)” shall mean internet banking services of ICICI Bank offered to the Net Banking Users.
• “Offer” shall mean Voucher provided by the "Alliance Partner" on purchase of its Products/Services using ICICI Bank Debit/Credit/Prepaid/Gift Card or Net Banking Services, during the offer period
• “Offer Period” shall mean the period commencing from August 25, 2014 to October 31, 2014, both days inclusive.
• "Pockets" shall mean the ICICI Bank Facebook application on which the Customer/s can register through their ICICI Bank Debit Card using their ATM PIN and perform banking transactions.
• "Website" shall mean the following "website" of the "Alliance partner" www.ebay.in/pockets"
• Void Transactions "shall mean the transactions which have taken place but have been rejected /cancelled/ declared unsuccessful while transacting on the Website of the "Alliance partner".
• "Voucher" shall mean the Promo Code received by the Customer from the Alliance Partner.
• "Primary Terms and Conditions" shall mean the terms and conditions applicable to ICICI Bank’s Internet Banking Service.
• “Products/Services” shall mean the goods/benefits/facilities offered by the Alliance Partner.

All capitalized terms used but not defined herein shall have the respective meanings prescribed to them in the Primary Terms and Conditions. These terms (“Terms”) shall be in addition to and not in derogation of the Primary Terms and Conditions. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail.

II. Offer

ICICI Bank customers who register for the first time on Pockets during the Offer Period will be entitled to get an eBay Voucher offering flat 25% off on purchase of products of select categories displayed on the Website.

Offer will be applicable on products of below categories-

4. Health & fitness
5. Car and bike accessories
6. Home & Living

8. Jewelery (gold and silver coins and bars will be excluded)

The availability of the offer is based on the following criteria:

• The Offer is valid only for those ICICI Bank customers who have registered for Pockets by ICICI Bank for the first time during the Offer Period.
• Eligible Customer/s shall be provided the promo code by mail to their email address registered with ICICI Bank and also by SMS on mobile number registered with ICICI Bank
• Participation in the Offer by the Customer is on a voluntary basis.
• The Customer may avail the Offer during the Offer Period or until the stock lasts, whichever is earlier.
• This Offer cannot be clubbed with any other Offer that may be made available to the Customer by the Alliance Partner.
• The Offer is non-transferable, non-binding and non-encashable.
• The Offer is not valid for Void Transactions
• In order to register for Pockets app, the Customer/s would be required to follow the steps below
  • To register for desktop app- Customer would have to login to Facebook and type "Pockets by ICICI Bank" in their search bar and accept all permissions.
  • To register for mobile app - Customer would have to search for Pockets by ICICI Bank in Android Playstore or iOS Appstore and download and install the app.
  • Register using their ICICI Bank debit card and ATM Pin.

III. Steps To Avail The Offer

• Visit www.ebay.in/pockets.
• Select the products of choice.
• Enter your promo code received for the discount during checkout before making payment.
• Make your Payment through ICICI Bank Net Banking Services, ICICI Bank credit card or ICICI Bank debit card/prepaid/gift card.

IV. Terms and Conditions Prescribed by Alliance Partner

• This offer is brought to you solely by the Alliance Partner. ICICI Bank is only communicating this offer on behalf of the Alliance Partner.
• The offer is valid from August 25, 2014 to October 31, 2014, on purchase of products belonging to the below mentioned categories displayed on the Website.

• To avail the discount the Website, the Net Banking User/credit card user should enter the promo code to avail the offer. If the Net Banking User fails to enter the promo code, the customer will not be eligible for the discount.
• Customer cannot club two offers in a single transaction. The discount benefit cannot be combined with any other promotional benefit offered by the Alliance Partner/ICICI Bank.
• The Net Banking User, credit or debit card customer needs to quote the promo code provided to him at the time of booking to be eligible for the discount.
• The ICICI Bank cardholder will be required to make payment as per the price quoted by Alliance Partner on the Website.
• Service charges as applicable shall be payable by the Customer.
• Prior to using the Website, the Customer should read and understand the User Agreement of the Website and proceed to make purchases only if the account holder agrees to abide by the terms and conditions of the User Agreement.
• The Customer shall be required to share personal information and account details on the Website for purchasing the products purchased on the Website. The ICICI Bank user should read and understand the privacy policy of the Alliance Partner, prior to providing such information.
• Any person availing of this offer shall be deemed to have accepted these terms and conditions.
• ICICI Bank and the Alliance Partner reserve the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change or vary all of these terms and conditions or to replace, wholly or in part, this offer by another offer, whether similar to this offer or not, or to extend or withdraw it altogether.
• ICICI Bank Cardholders are advised to go through the privacy policy for the Website, prior to providing such information.
• The Customer should not be in violation and agree to abide with these terms and conditions, the Alliance Partner User Agreement, PaisaPay User agreement and rules and policies of the Website.
• All decisions of the Alliance Partner/ ICICI Bank regarding running / process / results, of the promotion, data selection shall be final and binding on all participants of this promotion.
• No appeals will be entertained in this regard. On occurrence of force majeure events, which in ICICI Bank's/ Alliance Partner's opinion makes it necessary to suspend, substitute, change or cancel the Offer, ICICI Bank/ Alliance Partner reserve the right to suspend, change, substitute or cancel the Offer at any time without any notice.
• If the Alliance Partner has suspicion or knowledge, that any participant has been involved in any fraudulent or illegal activity related to this ICICI Promotion Offer, it reserves the right to disqualify such participant and/or any related participants. Any participant who, knowingly and with intent to injure, defraud or deceive, files a fraudulent complaint containing false, incomplete, or misleading information may be guilty of a criminal offence and will be prosecuted to the fullest extent of the law. The Alliance Partner reserves all the rights including but not limited to the right to suspend, block, restrict, cancel the user id and remove all listings of the errant participant and its related user id's on the Website.
• The Alliance Partner shall not be liable for issues related to technical, human error whatsoever e.g. wrong promo code being entered by you or you being logged out of the system.
• The Alliance Partner does not accept, and is not responsible for, any lost or delayed data, communication. The Alliance Partner reminds you of the nature and limitations of the Internet and is not responsible for any problems, technical malfunctions of any communications network, online system, computer hardware/ software failure, human error, events beyond the control of the Alliance Partner that may affect entry/participation to the ICICI Promotion Offer.
• The Products or Services are listed by third parties, who are responsible and liable for complying with commitments, communications, understanding including but not limited to guarantees, warranties, services (pre, post sales) in relation to the Customer/s and comply with applicable law of the land.
• The Participant understands and agrees that participation in the Offer is good and sufficient consideration for you to agree and be bound by these terms and conditions.
• Any and all taxes, including without any limitation income tax (if any) applicable on this Offer and the rewards / benefits thereto shall be borne by the Customer and shall also deposit the applicable amount of taxes (if any) to the Alliance Partner / contract administrator / applicable governmental authorities before the Customer can avail any benefits, unless otherwise mandated under the applicable laws.
• All promo code should be redeemed within the promotion period only.
• All communications with you will be through mails sent on your email (ID registered with the Alliance Partner and / or community board.
• The benefits under the Offer CANNOT be clubbed with other offers running on the the Website, including but not limited to vouchers.
• The employees and the immediate family members of the employees of the Alliance Partner and its associate companies are NOT eligible to participate in the Offer.
• All disputes, if any, arising out of or in connection with or as a result of above offers or otherwise relating hereto shall be subject to the exclusive jurisdiction of the competent courts / tribunals in Mumbai only, irrespective of whether courts / tribunals in other areas have concurrent or similar jurisdiction.

V. Terms prescribed by ICICI Bank

a) Terms and conditions prescribed for the Net Banking Users

• The offer is brought to you by the Alliance Partner. ICICI Bank is only communicating the offer on behalf of the Alliance Partner
• Participation in the Offer by the Net Banking User/s is on a voluntary basis.
• The Net Banking User/s may avail the Offer during the Offer Period or until the stock lasts, whichever is earlier.
• This Offer cannot be clubbed with any other Offer that may be made available to the Net Banking User/s by the Alliance Partner.
• The Offer is non-transferable, non-binding and non-encashable.
• The Offer is not valid for Void Transactions
• ICICI Bank does not guarantee and make any representation about the usefulness, worthiness and/or character of the discount / benefit or of the Products/Services under the Offer provided by the Alliance Partner.
• Any tax or other liabilities or charges payable to the government or any other statutory authority/body or any participating establishment, which may arise or accrue to the Net Banking User/s due to provision of the Offer, shall be to the sole account of the Net Banking User/s. Tax deducted at source, if any, on the monetary value of the Offer shall be payable by the Net Banking User/s.
• All issues / queries / complaints / grievances relating to the Offer, if any, shall be addressed to Alliance Partner directly at without any reference to ICICI Bank. The same shall be addressed by e-bay, only up to a period of 2 days after the date of transaction/purchase.
• The existence of a dispute, if any, regarding the Offer shall not constitute a claim against ICICI Bank and shall be addressed directly by the Alliance Partner.
• The Offer is not available wherever prohibited and / or on products / services for which such offers cannot be made available for any reason whatsoever.
• ICICI Bank/Alliance Partner reserve the right to modify/ change all or any of the terms applicable to the Offer without assigning any reasons or without any prior intimation whatsoever. ICICI Bank also reserves the right to discontinue the Offer without assigning any reasons or without any prior intimation whatsoever.
• If the Net Banking User ceases to be so at any time during the currency of the Offer Period, all the benefits under the Offer shall lapse and shall not be available to such Net Banking User.
• The employees of ICICI Bank and its affiliate companies and the immediate family members such employees are NOT eligible to participate in the Offer.
