Terms and Condition

I. Definitions

• "Offer" shall mean a smartphone worth INR 10,000 (ten thousand) for every Customer who downloads and logs into the Channel to iMobile application for the 1^st (first) time and is the highest transactor by value of Ttransactions on any given day during the Offer Period " Customer(s)” shall mean a ICICI Bank savings account holder who downloads and logs into the Channel for the 1^st (first) time and does at least one (1) Transaction and has received communication with respect to the Offer from ICICI Bank.
• "Offer Period" shall mean Offer will be valid from September 1, 2017 to September 30, 2017.
• "Winners" shall mean top transactor of the day by cumulative value of Transactions who has downloaded and logged in to the Channeland has done at least (one)1 transaction during the Offer Period on THE Channel.to " Primary Terms and Conditions" shall mean the terms and conditions applicable to the Channelf
• "Channel" shall mean using ICICI Bank iMobile app only“Transactions” shall mean funds transfer, bill pay, prepaid mobile recharge, or ticket booking.
• “Void Transactions”
• "Products" shall mean the smartphones given to Customers under the Offer.
  
  All capitalized terms used but not defined herein shall have the respective meanings prescribed to them in the Primary Terms and Conditions. These terms ("Terms") shall be in addition to and not in derogation of the Primary Terms and Conditions. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail.

II. Offer Construct

• The Offer is valid only for select set of Customers selected at the sole discretion of ICICI Bank and who have received communication about the Offer from ICICI Bank, during the Offer Period.
• There is no minimum value of Transaction.
• The highest transactor per day will be eligible for the Offer.
• 1 (One) smartphone will be given every day during the duration of the Offer.

III. Steps to avail the Offer

• Any Customer that downloads and logs in to the Channelfor the 1^st (first) time and performs Transactions (no minimum value required) shall get a smartphone worth INR10,000 (ten thousand)(
• Customer needs to be the highest transactor by value of Transactions on the Channel on any given dayduring the Offer Period.
• The highest transactors every day by value of Transactions during the Offer Period shall be the Winners.

IV. General Terms and Conditions

• Fund transfer by the Customer to his/her own account will not be eligible to be considered for this Offer.
• One Customer can be eligible only once as a Winner under the Offer.
• The complete Winners list will be published after 30 days of the Offer expiry date. This will be the name of all eligible Winners, who will be sent their smartphones at their registered address
• The warranty period for smartphone will be 01 year from date of registration by user and for accessories the warranty will be for 00 months.
• Flatworld Trading Pvt Ltd. shall deliver the smartphone to Winner’s address post confirmation from ICICI Bank.
• If the delivered smartphone is found damaged, Flatworld Trading Pvt Ltd. would reverse pick the damaged smartphone and replace the same.
• If the delivered smartphone is found defective, Flatworld Trading Pvt Ltd. will receive the complaint on phone and replace the device.
• ICICI Bank shall be selecting the Winners as per the criteria set out in "Steps to avail the Offer" and Flatworld Trading Pvt Ltd. shall not be responsible for Winners’ list.
• ICICI Bank shall not be responsible for smartphone delivered and the services provided by Flatworld Trading Pvt Ltd. and complaints if any about the same shall be redirected to Flatworld Trading Pvt Ltd. .
• Transactions using any other channel except the Channelwill not be considered eligible for the Offer.
• After smartphone is delivered to the Winner, ICICI Bank shall not be responsible for any loss, damage, theft of the same.
• Any queries/communication/notice regarding the Offer should be sent to ICICI Bank’s 24 hour customer care
• Suggestions/grievances if any have to be registered with ICICI Bank Customer care maximum within 7 days from the date of delivery.
• In all matters relating to the Offer, the decision of ICICI Bank shall be final and binding in all respects.
• ICICI Bank shall not in any way be deemed to be making any representation whatsoever about the usefulness, worthiness, quality and/or character of the smartphone and the services provided by Flatworld Trading Pvt Ltd. and shall not be responsible in any way what so ever for the same. The existence of a dispute with respect to, if any, regarding the usefulness, worthiness, nature and/or quality of the smartphone or other services provided by Flatworld Trading Pvt Ltd., shall not constitute a claim against ICICI Bank.
• Any tax or other liabilities or charges payable to the government or any other statutory authority/body or any participating establishment, which may arise or accrue to the Customer/s due to provision of the Offer, shall be to the sole account of the Customer/s.Tax deducted at source, if any, on the monetary value of the Offer shall be payable by the Customer/s
• The Offer is not available wherever prohibited and / or on products/ servoces for which such Offers cannot be made available for any reason whatsoever.
• ICICI Bank reserves the right to modify/ change all or any of the terms and conditions contained herein as per its discretion without assigning any reasons or without any prior intimation/notice whatsoever. ICICI Bank also reserves the right to discontinue the Offer without assigning any reasons or without any prior intimation whatsoever. ICICI Bank will not be liable in any manner whatsoever for any loss/ damage /claim/injury that may arise due to withdrawal or change in the terms and conditions of the Offer or discontinuation of it.
• ICICI Bank shall not be liable in any manner whatsoever for any loss/ damage/ claim that may arise out of use or otherwise of the smartphone availed by the Customer/s under this Offer.
• If the Customerceases to be a Customerat any time during the currency of the Offer Period, all the benefits under the Offer shall lapse and shall not be available to the Customer.
• The Offer is subject to applicable Indian laws and such other terms and conditions as may be stipulated by ICICI Bank. The Offer is not available wherever the same is prohibited and/or cannot be offered or for any reason whatsoever. All disputes are subject to the exclusive jurisdiction of the competent courts/tribunals of Mumbai. However, ICICI Bank reserves the right to approach any other court or tribunal of competent jurisdiction.
• Any Customer who wins any gift/incentive under any Offer from ICICI Bank will not be eligible to win another gift/incentive from ICICI Bank for a period of one year from the date of receipt of the gift/incentive.
• In case there is more than one Offer available simultaneously, no two Offers can be combined by the Customer. It shall be entirely at the discretion of ICICI Bank to consider any exceptions to the above.
• The Offer and the opportunity to participate therein are entirely voluntary. Participation in this Offer shall be deemed to be acceptance of all the Terms and Conditions governing the Offer.
• The Offer enumerated herein shall be non-transferable and / or non-negotiable. ICICI Bank reserves the right to change the Offer at any point of time without informing the Customer/s.
• ICICI Bank shall not be obliged to make any public announcements to intimate the Custome/s of the award of the Offer hereunder.
• ICICI Bank does not guarantee and make any representation about the usefulness, worthiness and/or character of the smartphones under the Offer provided by Flatworld Trading Pvt Ltd.
• ICICI Bank reserves the right to disqualify Customers from the benefits of the Offer if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the Offer or otherwise by use of the Channel.
