Terms and Condition

I. Definitions

• "Alliance Partner" shall mean "Provogue India Ltd", who has entered into an alliance agreement with ICICI Bank for the purpose of providing the Offer.
• “Customer(s)” for the purpose of this Offer shall mean Value Banking, Privilege Banking and Wealth Standard customers of ICICI Bank who hold an ICICI Bank Savings Account; logging in for the first time on ICICI Bank Internet Banking or mdot facility.
• "Offer" shall mean, that the new ICICI Bank customer who will use ICICI Bank Internet Banking service during the offer period shall get Alliance Partner’s fashion accessories by paying a handling charge up to Rs 549 during the Offer Period on www.Provogue.com/icicinetbanking.
• "Offer Period" shall mean the period ending on November 30, 2018.
• "Products/ Services" shall mean the goods/ benefits/ facilities offered by the Alliance Partner.
• "Website" shall mean the website of the Alliance Partner i.e. www.Provogue.com/icicinetbanking
• "Void Transaction" shall mean any transaction wherein the transaction has taken place, but has been cancelled /rejected /unsuccessful by Provogue.
• All capitalised terms used but not defined herein shall have the respective meanings prescribed to them in the Primary Terms and Conditions. These terms ("Terms") shall be in addition to and not in derogation of the Primary Terms and Conditions. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail.

II. Offer Details

• Any ICICI Bank Savings Account, Value Banking and Privilege Banking customers who activate ICICI Bank Internet Banking facility during the offer period shall be eligible for the offer as defined hereinabove.
• To activate Internet Banking, customers are required to log in to ICICIBank.com with their User ID and Password.
• Such Customer can avail Alliance Partner’s fashion accessories worth up to Rs 4499 by paying a shipping and handling charge up to Rs 549 to Provogue.
• The fashion accessory selection and payment has to be done on www.provogue.com/icicinetbanking. Payment can be done using ICICI Bank Internet Banking only.
• The Offer is non-transferable, non-binding and non-encashable.
• The Offer is not valid for Void transactions.
• The offer is valid only till stock lasts.

III. Steps to avail the Offer

For ICICI Bank Internet Banking and m.icicibank.com customers:

• Log in to Internet Banking with your User ID and Password from your desktop/ laptop/ mobile

• Post login, customers who are eligible, shall follow the below mentioned process:
• Customer has to login to www.Provogue.com/icicinetbanking
• Customer shall select Provogue accessories as per the given categories on the website of the Alliance Partner.
• Customer shall make the payment through ICICI Bank Internet Banking service only.
• Product selected by ICICI Bank customer will be delivered by Alliance partner to the customer as per the Alliance Partner’s terms and conditions.

III. Terms and Conditions as prescribed by Provogue

• This offer is brought to ICICI Bank customers solely by Provogue. ICICI Bank is only communicating this offer on behalf of Provogue.
• ICICI Bank does not guarantee and make any representation about the usefulness, worthiness and/ or character of the discount /benefit or of the Products/ Services under the Offer provided by Provogue.
• Any person availing this offer shall be deemed to have accepted these Terms and Conditions.
• ICICI Bank and Provogue reserve the right, at any time, without prior notice and without assigning any reason whatsoever, to add/ alter/ modify/ change or vary all of these terms and conditions or to replace, wholly or in part, this offer by another offer, whether similar to this offer or not, or to extend or withdraw it altogether.
• All disputes, if any, arising out of or in connection with or as a result of the above offers or otherwise relating hereto shall be subject to exclusive jurisdiction of the competent courts / tribunals in Mumbai only, irrespective of whether courts /tribunals in other areas have concurrent or similar jurisdiction.
• Provogue shall not be liable for any claims or grievances solely attributable to Internet Banking services of ICICI Bank
• Once the user places an order for Special Privilege, it will be delivered within 28 working days.
• The payment towards handling charges while indenting for Provogue accessory should be made through ICICI Bank Internet Banking only.
• Any manufacturing defect should be communicated to Provogue within 7 days of order receipt to be eligible for replacement warranty.
• This special privilege is valid till November 30, 2018.
• Order for Provogue accessory has to be placed online after redeeming the code.
• Two schemes cannot be clubbed together.
• This Special Privilege will be delivered only in India.
• ICICI Bank holds no responsibility for products or services being offered in alliance with this offer.
• Any dispute shall be subject to the jurisdiction of Mumbai courts only.

IV. Terms Prescribed by ICICI Bank

• This offer is brought to ICICI Bank Internet Banking customers solely by Provogue. ICICI Bank is only communicating this offer on behalf of Provogue.
• ICICI Bank does not guarantee and make any representation about the usefulness, worthiness and/ or character of the discount/ benefit or of the Products/ Services under the Offer provided by “Provogue".
• The existence of a dispute, if any, regarding the Offer shall not constitute.
• Any claim against ICICI Bank shall be addressed directly by Provogue. In the event of any customer claims arising due to any acts and omission on the part of ICICI Bank or claims or fraud related to ICICI Bank Internet Banking, ICICI Bank shall be liable to address such disputes.
• All communication/notices with regards to the mentioned claims attributable to Provogue should be addressed to Provogue India Ltd., 105/ 106, Provogue house, off new link road, Andheri (W), Mumbai - 400053.
• All issues/ queries/ complaints/ grievances relating to the Offer, if any, shall be addressed to Alliance Partner directly at icici@provogue.com without any reference to ICICI Bank. The same shall be addressed by Provogue within 7 working days of transaction.
• ICICI Bank reserves the right to disqualify the Offer Partner(s) or ICICI Bank Internet Banking users from the benefits of the programme if any fraudulent activity is identified or being carried out for the purpose of availing the benefits under the programme or otherwise by using the services of ICICI Bank.
• ICICI Bank shall not be held liable for any delay or loss that may be caused in delivery of the goods and services or the assured gifts/ prizes.
• The Offer is not available wherever prohibited and/ or on products/ services for which such offers cannot be made available for any reason whatsoever.
• ICICI Bank and Provogue together reserve the right to modify/ change all or any of the terms applicable to the Offer without assigning any reasons or without any prior intimation whatsoever. ICICI Bank also reserves the right to discontinue the Offer without assigning any reasons or without any prior intimation whatsoever after the offer period.
• If the ICICI Bank user ceases to be so at any time during the Offer Period, then all the benefits under the Offer shall lapse and shall not be available to such an ICICI Bank user.
