Terms and Condition

I. Definitions

• "Alliance partner" shall mean Flipkart Internet Pvt Ltd as "flipkart.com” or Flipkart app, who has entered into an alliance agreement with ICICI Bank for purpose of providing the Offer.
• "Customer/s" for the purpose of this Offer shall mean a person who is using ICICI bank Net Banking services or holds a valid Pockets shopping card issued by ICICI Bank and who has received communication from ICICI Bank with respect to the Offer. 
• "ICICI Bank Net Banking User" shall mean a person who holds an ICICI Bank savings account, loan / facility account(s), depository account(s) and/or any other type of account(s), so maintained with ICICI Bank or its Affiliate which are eligible account(s) for purposes of ICICI Bank Net Banking Service(s) and who has received communication from ICICI Bank with respect to the Offer.
• "Pockets user" shall mean a customer to whom the Facility has been granted by virtue of downloading and activating the application. 
• "Pockets shopping card" shall mean card, which has been issued by ICICI Bank and is valid and subsisting during the Program Period.
• "Offer" shall mean instant discount/benefit provided by the "Alliance partner" on purchase of Products/Services using Pockets application or Netbanking services.
• "Offer Period" shall mean the period commencing from March 19, 2016 to March 20, 2016, both days inclusive.
• "Void Transactions "shall mean wherein the transaction has taken place but has been rejected /canceled/ been unsuccessful at the "website"" of the "Alliance partner".
• "Primary Terms and Conditions" shall mean the terms and conditions applicable to ICICI Bank’s Internet banking facility/service.
• "Products/Services" shall mean the goods/benefits/facilities offered by the Alliance Partner.
  All capitalized terms used but not defined herein shall have the respective meanings prescribed to them in the Primary Terms and Conditions.

These terms ("Terms") shall be in addition to and not in derogation of the Primary Terms and Conditions. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail.

II. Offer

• 15% Cash back* with ICICI Bank Net Banking & Pockets ONLY on Flipkart.com, m.flipkart.com & mAPP
• The Offer is valid from March 19, 2016(00:00 Hours) to March 20, 2016 (23:59 Hours), (Offer Period)
• The Offer is applicable Only on Fashion and Lifestyle Categories
• The minimum transaction amount to avail the Offer is Rs. 1999/-
• This offer is valid for maximum discount of Rs. 1000/- per account during the offer term.
• Cash back amount will be credited to customer’s card account on or before May 20, 2016. The time line provided for effecting credit is only indicative of expected period and may vary from the actual date of credit.

III. Terms and Conditions prescribed by ICICI Bank 

• The offer is applicable on ICICI Net Banking and Pockets Only.
• Participation in the Offer by the Customer/s is on a voluntary basis.
• All services offered are at the sole discretion of ICICI Bank.
• The participation in the program is entirely voluntary and that the participation by the Referrer shall be deemed to have been made on a voluntary basis.
• ICICI Bank reserves the right to modify/change all or any of the Terms and Conditions applicable to the Offer without assigning any reasons or without any prior intimation whatsoever. ICICI Bank also reserves the right to discontinue the Offer without assigning any reasons or without any prior intimation whatsoever. 
• Notwithstanding anything contained herein, ICICI Bank reserves the right at any time at its absolute discretion without prior notice to vary, withdraw, cancel, or invalidate the Cash back Program, without having to give a reason thereof, and without compensation whatsoever. Further, ICICI Bank has the discretion to reject any claim in the event of irregularity, discrepancy, or dispute, and its decision shall be final, conclusive and binding.
• All claims against ICICI Bank, if any, are subject to the exclusive jurisdiction of the competent courts/tribunals of Mumbai.
• Any tax or other liabilities or charges payable to the Government or any other statutory authority/body or any participating establishment, which may arise or accrue to the Customer due to provision of the Offer, shall be to the sole account of the Customer.
• ICICI Bank reserves the right to disqualify the Offer or Customer/s from the benefits of the Offer if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the Offer.
• ICICI Bank shall not be held liable for any delay or loss that may be caused during the process of Cash back. 
•  The Offer is not available wherever prohibited and / or on Products / Services for which such offers cannot be made available for any reason whatsoever. 
• If the ICICI Bank user ceases to be so at any time during the Offer Period, then all the benefits under the offer shall lapse and shall not be available to such ICICI Bank user.
• Any query regarding the program will be entertained until May 30, 2016. Post such date, Flipkart Internet Pvt. Ltd will not entertain any correspondence or communication regarding this Program from any persons
• All liability with respect to the products purchased lies with the respective seller and Flipkart Internet Pvt. Ltd. nor the BANK shall be in no way responsible for the same.
