• The Promotion offers are valid on purchase of all products/services displayed by the Sellers on the eBay Website and is valid on a select range of products as listed on the designated URLs
• To avail the discount on eBay Website, the ICICI Bank Pockets prepaid card user should enter the promo code to avail the offer. If the ICICI Bank user fails to enter the promo code, the customer will not be eligible for the discount under the offer
• Customer cannot club two offers during the same transaction. The discount benefit cannot be combined with any other promotional benefit offered for shopping on eBay URL(s) or apps as specified
• The ICICI Bank Pockets prepaid card user needs to quote the Unique deal code sent in the secured in-box by ICICI Bank at the time of booking to be eligible for the discount
• Code should be redeemed within the promotion period only
• Service charges as applicable shall be payable by the Customer
• Prior to using the www.ebay.in website, the Customer should read, understand and accept the User Agreement, Privacy Policy and other Rules of the eBay Website (hereinafter referred to as "eBay UAs") and proceed to make purchases only if the Account holder agrees to abide by the same. The Customer shall be required to give required personal information and account details online for the products purchased on www.ebay.in The ICICI Bank Pockets prepaid user should read, understand and accept the Privacy policy of eBay Website, prior to providing such information. • Any person availing of this offer shall be deemed to have read, understood and accepted these Terms and Conditions of the offer as well as eBay UAs
• Save and except the terms and conditions of eBay UAs, eBay makes no representation or warranties of any kind regarding any product or service provided by any Seller/ third party and shall not be responsible for any costs, damages, accident, delay, injury, loss, expense or inconvenience that may arise in connection with the transaction on eBay
• ICICI Bank and eBay India Pvt Ltd reserves the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change or vary all of these terms and conditions or to replace, wholly or in part, this offer by another offer, whether similar to this offer or not, or to extend or withdraw it altogether
• You (means the person using this promotion with the intent to receive assured free gift under the ICICI Promotion Offer or the eBay User) should not be in violation and agree to abide with this terms and conditions, the eBay User Agreement, PaisaPay User agreement, eBay Site rules and policies
• In the event of circumstances arising outside of eBay India's control, which in eBay India's opinion make it necessary to suspend, substitute, change or cancel the Offer, eBay India reserves the right to suspend, change, substitute or cancel the Offer at any time without any notice
• If eBay India has suspicion or knowledge, that any entrant has been involved in any fraudulent or illegal activity related to this ICICI Promotion Offer, eBay India reserves the right to disqualify that entrant and any related entrants. Any entrant user of the eBay Website who, knowingly and with intent to injure, defraud or deceive, files a Fraudulent Complaint containing false, incomplete, or misleading information may be guilty of a criminal offence and will be prosecuted to the fullest extent of the law. eBay India reserves all the rights including but not limited to suspend, block, restrict, cancel the user id and remove all listings of the errant eBay User and its related user id's on the eBay Website
• eBay India shall not be liable for issues related to technical, human error whatsoever e.g. wrong promotion number being entered by you or you being logged out of system
• eBay India does not accept, and is not responsible for, any lost or delayed data, communication. eBay India reminds you of the nature and limitations of the Internet and is not responsible for any problems, technical malfunctions of any communications network, online system, computer hardware/ software failure, human error, things outside the control of eBay India that may affect entry/participation to the ICICI Promotion Offer
• The products or services are listed by third parties, who are responsible and liable for complying with commitments, communications, understanding including but not limiting to guarantees, warranties, services (pre, post sales) between them and you, as also complying with applicable law of the land
• You understand and agree that participation in the Offer is good and sufficient consideration for you to agree and be bound by these Terms and Conditions of this offer as well as eBay UAs
• Any and all taxes, including without any limitation income tax (if any) applicable on this Offer and the rewards / benefits thereto shall be borne by you and you shall deposit the applicable amount of taxes (if any) to eBay / contract administrator / applicable governmental authorities before user could avail any benefits, unless otherwise mandated under the applicable laws
• All communications with you will be, on your email (ID registered on eBay Website) and / or community board
• The benefits under the Offer CANNOT be clubbed with other offers running on the eBay Website, including vouchers or any other offer available on the eBay Website
• The employees and the immediate family members of the employees of eBay India and its associate companies are NOT eligible to participate in the Offer
• All disputes, if any, arising out of or in connection with or as a result of above offers or otherwise relating hereto shall be subject to the exclusive jurisdiction of the competent courts / tribunals in Mumbai only, irrespective of whether courts / tribunals in other areas have concurrent or similar jurisdiction .

II. Terms and Conditions prescribed by ICICI Bank

• This offer is brought to you solely by the alliance partner. ICICI Bank is only communicating this offer on behalf of the Alliance partner
• ICICI Bank does not guarantee and make any representation about the usefulness, worthiness and/or character of the discount / benefit or of the Products/Services under the Offer provided by the alliance partner
• Any tax or other liabilities or charges payable to the government or any other statutory authority/body or any participating establishment, which may arise or accrue to the ICICI Bank Pockets prepaid account/Cardholder due to provision of the Offer, shall be to the sole account of the Pockets pre-paid account holders. Tax deducted at source, if any, on the monetary value of the Offer shall be payable by the Pockets pre-paid account holders
• The existence of a dispute, if any, regarding the Offer shall not constitute a claim against ICICI Bank and shall be addressed directly by the alliance partner
• ICICI Bank holds out no warranty or makes no representation about the quality, delivery or otherwise of the goods and services or the Cash back / discounts offered by the Alliance Partner. Any dispute or claim regarding the goods, services and cash back / discounts must be resolved by the Card Holder/s with the Program Partners directly without any reference to ICICI Bank
• ICICI Bank reserves the right to disqualify the Program Partner/s or Card Holder/s from the benefits of the Program if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the Program or otherwise by use of the Card
• ICICI Bank shall not be held liable for any delay or loss that may be caused in delivery of the goods and services or the assured gifts / prizes
• The Program is not available wherever prohibited and / or on merchandise / products / services for which such programs cannot be offered for any reason whatsoever
• All issues / queries / complaints / grievances relating to the Offer, if any, shall be addressed to Alliance Partner directly at eBay.in without any reference to ICICI Bank. The same shall be addressed in the same fashion as eBay India’s standard customer service requests
• All communication / notices with regard to this offer should be addressed to eBay India
• The Offer is not available wherever prohibited and / or on products / services for which such offers cannot be made available for any reason whatsoever
• ICICI Bank reserves the right to modify/ change all or any of the terms applicable to the Offer without assigning any reasons or without any prior fintimation whatsoever. ICICI Bank also reserves the right to discontinue the Offer without assigning any reasons or without any prior intimation whatsoever
