Terms and Condition

I. Definitions

• "Cardholder" shall mean such customer/s who are ICICI Bank’s customers; and to whom a Card has been issued and who is authorized to hold the Card and to whom the offer has been granted by virtue of such customer holding a Card.
• "Card" shall mean Credit and Debit card, which has been issued by ICICI Bank and is valid and subsisting during the Program Period "Program" shall mean the assured discount offers for the Cardholder at Featured Restaurants.
• "Program Period" shall mean the period commencing from January 23, 2015 to February 1, 2015 (both days inclusive) during which the offer can be availed by the Cardholder.
• "Offer" shall mean the Set Menu provided on products/services of the Featured Restaurants and shall be provided to the Cardholder.

"Primary Terms and Conditions" shall mean the terms and conditions applicable to the Card in addition to these Terms and Conditions.

• "Featured Restaurants" shall mean restaurants who have agreed to provide Offer to ICICI Bank Credit and Debit Card Holders during the Program Period.

II. Merchant Terms and Conditions

• Offer is valid upto February 1, 2015 and is applicable only if the bill is paid using ICICI Bank Credit or Debit cards and booked the seat using ICICI Bank Credit or Debit Card.
• Offer is valid only at the mentioned outlets.
• The offer shall be available on a set menu of the Featured Restaurants offered at Rs 999 or Rs 1499. All taxes will be applicable above the menu price.
• This offer has no monetary value, is not transferable, is not for sale or re-sale nor redeemable for cash.
• The offer cannot be clubbed with any other offer running at the outlet.
• The cardholder has to present his valid Credit or Debit Card to the restaurant and state the intention to use the offer before asking for the bill.
• To avail the Offer, the customer has to book the seat at the restaurants with time slot given at www.dineout.co.in/gourmetfest and also has to inform the restaurant about his/her choice of payment through ICICI Bank Credit or Debit Card before the bill is generated.

III. General Terms and Conditions

• ICICI Bank holds out no warranty or makes no representation about the quality, delivery or otherwise of the goods and services offered by the Featured Restaurants.
• Any dispute or claim regarding the goods/ services must be resolved by the Card Holder/s with the Featured Restaurants directly without any reference to ICICI Bank.
• ICICI Bank shall not be liable in any manner whatsoever for any loss/ damage/ claim that may arise out of use or otherwise of any goods/ services availed by the Card Holder/s under the Program offered by the Featured Restaurants.
• ICICI Bank reserves the right to disqualify the Restaurants /s or Card Holder/s from the benefits of the Program if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the Program or otherwise by use of the Card.
• ICICI Bank reserves the right to modify/ change all or any of the terms applicable to the Offer without assigning any reasons or without any prior intimation whatsoever. ICICI Bank also reserves the right to discontinue the offer without assigning any reasons or without any prior intimation whatsoever.
• The program is sponsored by the Featured Restaurants and the Card Holder/s shall be bound by the terms and conditions stipulated by the Featured Restaurants in this regard. Offers cannot be used or redeemed in combination with any other discounts or promotions or vouchers or special events such as 'Weekend Brunches' or 'Happy Hours', unless otherwise stated by the featured partner.
• ICICI Bank shall not be held liable for any delay or loss that may be caused in delivery of the goods/ services by the Featured Restaurants.
• The Program is not available wherever prohibited and / or on services for which such programs cannot be offered for any reason whatsoever.
• All disputes are subject to the exclusive jurisdiction of the competent courts of Mumbai.
• Any applicable taxes have to be paid by the card holder.
• These Terms shall be in addition to and not in substitution / derogation to the Primary Terms and Conditions governing the Card of ICICI Bank. All capitalized terms used but not defined herein shall have the respective meanings ascribed to it in the Primary Terms and Conditions.
