Terms and Condition

I. Definitions

• "Alliance Partner" shall mean Hindustan Petroleum Corporation Limited, who has entered into an alliance agreement with ICICI Bank for purpose of providing the Offer.
• "ICICI Bank’s Pockets App customer" shall mean a person who has ICICI Bank’s Pocket app on their phones.
• "Cardholder(s)" shall mean a customer of ICICI Bank, to whom the Facility has been granted by virtue of such customer holding a Visa Card.
• "Card" shall mean a Visa Credit or Debit Card, which has been issued by ICICI Bank to the Cardholder(s) and is valid and subsisting during the Program Period.
• "Offer" shall mean such discount(s) /benefit(s) provided by the Alliance Partner on purchase of Products/Services using ICICI Bank Pockets app, during the Offer Period on the Website.
• "Offer Period" shall mean the period commencing till March 14, 2017.
• "Primary Terms and Conditions" shall mean the terms and conditions applicable to thee ICICI Bank’s Pockets App.
• "Products/Services" shall mean the goods/benefits/facilities offered by the Alliance Partner
• "Void Transaction" shall mean any transaction wherein the transaction has taken place but has been cancelled /rejected /unsuccessful by the Alliance Partner.

All capitalized terms used but not defined herein shall have the respective meanings prescribed to them in the Primary Terms and Conditions. These terms ("Terms") shall be in addition to and not in derogation of the Primary Terms and Conditions. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail.

II. Partner’s Terms & Conditions:

• Offer location: 400+ outlets in top 4 cities Delhi, Kolkata, Bangalore, Mumbai.
  Offer Period: 15 Sep 2016 to 14 March 2017.
  The cashback will be applicable for first 60,000 transactions or 14 March 2017 whichever is earlier.
  There are no monthly limits per card holder.
  Cashback will be executed by Axis Bank and ICICI Merchant Services as acquirers.
• Offer details as shown are based on information provided by the Merchant. No warranties are made by Visa that the information is correct. Please check directly with Merchant to confirm availability and validity of the Offer.
  The Merchant is the sole provider of all goods and/or services under this offer. Accordingly, the Visa Cardholder understands, acknowledges and agrees that the procurement by him/her of any goods and/or services under this Offer shall constitute a
• contract solely between the merchant and him/her, and Visa is not, nor will become, a party thereto. 
  By utilizing or attempting to utilize any of the goods and services under this Offer, the Visa Cardholder understands, acknowledges and agrees that:
  Any claim, complaint or dispute of any nature arising out of or in relation to the procurement, or attempted procurement by the cardholder of any goods and/or services under this offer (each a “Claim”) shall be settled by the Visa Cardholder directly with the Merchant, and Visa Cardholder shall not make any Claim against Visa.
  Without prejudice to the foregoing, and to the fullest extent permitted by law, Visa shall not be liable to any person for any loss, damage, expenses or claim (whether direct or indirect) in relation to any personal injury, death, false representation, damage or omission arising from or in connection with the usage or attempted usage of the Offer or goods and/or services provided under the Offer.

How to avail the offer?

• Login to Pockets app
• Click on Touch & pay icon on Pockets home screen
• Select any one of your ICICI Bank Visa Credit or Debit Card activated on the App
• Hold your phone near the merchant terminal to make the payment

III. Terms Prescribed by ICICI Bank

• ICICI Bank holds out no warranty or makes no representation about the quality, delivery or otherwise of the goods and services or the discount offered by Hindustan Petroleum Corporation Limited. Any dispute or claim regarding the goods, services and discount must be resolved by the Card Holder/s with Hindustan Petroleum Corporation Limited directly without any reference to ICICI Bank.
• ICICI Bank shall not be liable in any manner whatsoever for any loss/ damage/ claim that may arise out of use or otherwise of any goods/ services / discount / gift vouchers availed by the Card Holder/s under the said Offer offered by Hindustan Petroleum Corporation Limited
• ICICI Bank reserves the right to disqualify Hindustan Petroleum Corporation Limited or the Card Holder/s from the benefits of the Offer, if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the said Offer or otherwise by use of the Card.
• The Card Holder/s shall be bound by the terms and conditions stipulated by Hindustan Petroleum Corporation Limited in this regard.
• No substitutions or exchange of Offer, other than what is detailed in the communication sent to the Card Holder/s shall be allowed. However, ICICI Bank reserves the right to substitute and/or change the Offer or any of them, without any intimation or notice, written or otherwise to the Card Holder/s.
