Terms and Condition

I. Definitions

• "Cardholder(s)" shall mean a customer of ICICI Bank, to whom the Facility has been granted by virtue of such customer holding a Card.
• "Card" shall mean a Debit Card, which has been issued by ICICI Bank to the Cardholder(s) and is valid and subsisting during the Program Period.
• "Offer" shall mean collectively Offer 1&2.
• "Offer 1" shall mean cashback of Rs.200 on spending Rs.2000 or more, during each Friday (excluding cash withdrawals at ATMs and banks, Void Transactions, fuel payment, and mutual fund transactions), done on the Card, during the Program Period. This offer is limited to top 2000 spenders only. For this, Bank will consider only transactions done at restaurants, fast food chains, movie theaters, amusement parks, bowling alleys, golf courses or movie tickets or plays through online websites during the program period.
• "Offer 2" shall mean 51% off on expenditure by a Cardholder, during each Friday (excluding cash withdrawals at ATMs and banks, Void Transactions, fuel payment, and mutual fund transactions) , done on the Card on Foodpanda app, during the Program Period.
• "Online expenditure" shall mean usage of card on internet / mobile application for making payment against purchase of any product or services.
• Primary Terms and Conditions" shall mean the terms and conditions applicable to the Card in addition to these Terms and Conditions.
• "Program" shall mean the assured cashback, for the Cardholder(s) availing the Offer 1 during the Program Period.
• "Program Period" shall mean the period commencing from August 07, 2015 to and ending on 0000 hours of August 07, 2015, during which the Offer can be availed by the Cardholder(s).
• "Void Transaction" shall mean any transaction wherein the transaction made by using the Card has been canceled by the merchant establishment prior to settlement with ICICI Bank.

II. Program / Offer

• The Program is valid for the Cardholder/s only and shall be valid and subsisting during the Program Period, unless otherwise notified by ICICI Bank. The Cardholder/s shall be required to carry out at least one transaction using his Card in the Program Period, in order to be eligible for the Gift.
• The Program construction shall be as follows:
• Top 2000 spenders spending minimum Rs.2000, amongst all eligible Cardholder(s), during the Program Period, shall qualify for Offer 1.
• 51% off on purchases on Foodpanda app, during the Program Period.
• In case of a tie between two or more Cardholders availing Offer 1 who have done the highest spends, the Cardholder who has done the first transaction during the Program Period shall be eligible for Offer 1.
• The winners of the Offer 1 shall be intimated through email or sms on the registered email address or contact detail of such Cardholders. The winners’ list shall also be displayed on ICICI Bank’s website.
• The winners shall be announced within 45 days of the end of the Program Period.
• Offer 1 shall be sent to the qualifying Cardholder(s) within 60 days of the end of the Program Period.
• A transaction which shall not be considered as a valid transaction for the purpose of the Program are: cash withdrawals at ATMs or ICICI Bank branches, Void Transactions, fuel payment, or mutual fund purchase.
• This Program cannot be clubbed with any other program that may be made available to the Cardholders by ICICI Bank.
• Any cancellations or foreclosures, will amount to cancellation of the Offer 1 to the Cardholder.
• A Cardholder shall be entitled to receive Offer 1 only once during the Program Period

III. Terms and Conditions prescribed to ICICI Bank Card Holders:

• ICICI Bank holds out no warranty or makes no representation about the quality, delivery or otherwise of the goods and services offered by the Alliance Partner. Any dispute or claim regarding the services and must be resolved by the Card Holder/s with the alliance partner directly without any reference to ICICI Bank.
• ICICI Bank shall not be liable in any manner whatsoever for any loss/ damage/ claim that may arise out of use or otherwise of any products or services availed by the Card Holder/s under the alliance offered by the Alliance Partner.
• ICICI Bank reserves the right to disqualify the Alliance Partner or the Card Holder/s from the benefits of the Offer, if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the said Offer or otherwise by use of the Card.
• The Card Holder/s shall be bound by the terms and conditions stipulated by the Alliance Partner in this regard.
• The Offer is sponsored by the Alliance Partner and the Card Holder/s shall be bound by the terms and conditions stipulated by the Alliance Partner in this regard.
• No substitutions or exchange of Offer, other than what is detailed in the communication sent to the Card Holder/s shall be allowed. However, ICICI Bank reserves the right to substitute and/or change the Offer or any of them, without any intimation or notice, written or otherwise to the Card Holder/s.
