Terms and Condition

I. DEFINITIONS

• “Alliance Partner” shall mean Samsung India Electronics Pvt. Ltd who has entered into an alliance agreement with ICICI Bank for purpose of providing the Offer.
• "Card" shall mean Credit card(VISA/ Mastercard/ Amex) or Debit card (VISA/Electron/Maestro), which has been issued by ICICI Bank and is valid and subsisting during the Program/Offer Period.
• "Card Holder/s" shall mean such customer/s to whom a Card has been issued and who is authorized to hold the Card.
• "Program/“Offer” shall mean such cashback(s)/ discount(s) /benefit(s) provided by the Alliance Partner on purchase of Products/Services using ICICI Bank Credit Services, during the Offer Period at participating stores on Pine labs terminals only and website.
• “Program/Offer Period” shall mean the period commencing from May 21, 2018 to August 31, 2018, both days inclusive.
• "Primary Terms and Conditions" shall mean the terms and conditions applicable to e ICICI Bank’s internet banking facility/service.
• “Products/Services” shall mean the goods/benefits/facilities offered by the Alliance Partner.
• “Void Transaction” shall mean any transaction wherein the transaction has taken place but has been canceled /rejected /unsuccessful by the Alliance Partner.
• All capitalized terms used but not defined herein shall have the respective meanings prescribed to them in the Primary Terms and Conditions. These terms (“Terms”) shall be in addition to and not in derogation of the Primary Terms and Conditions. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail.

II. Offer:

Samsung Galaxy J6 / J8 cashback offer

Get cashback on purchase of Samsung Galaxy J Series smartphones with ICICI Bank Credit and Debit Cards.

Offer details:

• Offer valid from May 21 to August 31, 2018
• Offer applicable on Credit and Debit Card transactions done at Pine Labs terminals or on www.flipkart.com/ or shop.samsung.com/in/
• Offer also applicable on Credit Card Equated Monthly Instalment (EMI) transactions
• The cardholder needs to retain the copy of the Electronic Data Capture (EDC) machine charge slip for a period of 180 days
• Cashback would be credited on or before November 30, 2018
• Offer can be availed once per card during the offer period
• Offer not applicable on Business, Corporate and Commercial Credit Cards.

III. Alliance Partner prescribed Terms & Conditions of Offer:

• All transactions towards purchase of Samsung Galaxy J6 using ICICI Bank Credit or Debit Cards from May 21, 2018 to August 31, 2018 will be eligible for cashback amount of Rs.1500.
• All transactions towards purchase of Samsung Galaxy J8 using ICICI Bank Credit or Debit Cards from June 28, 2018 to August 31, 2018 will be eligible for cashback amount of Rs. 2000.
• No Cost EMI schemes of 3m & 6m tenures are also available on ICICI Bank Credit Cards.
• Cashback will be processed to the customer’s card account on or before November 30, 2018.
• Any partial payments (towards EMI or Regular Transactions) will not be eligible for the Cashback.
• All EMI and regular transactions need to be under 'Brand EMI' and applicable as stated in the charge slip.
• Cardholder needs to retain the copy of the Electronic Data Capture (EDC) machine charge slip for a period of 180 days.
• Offer valid for purchase at select participating stores only.
• Samsung disclaims any/all claims or liabilities with respect to the above mentioned offers.
• Under no circumstances shall Samsung and/or its affiliates &/or their directors, employees, agents or officers be held responsible for any part of these offers.
• Offers are subject to change without prior notice.
• No two offers can be clubbed together. Under no circumstances shall Samsung and/or its affiliates &/or their directors, employees, agents or officers be held responsible for any part of these offers. Offers are subject to change without prior notice. This offer cannot be clubbed with any offer
• Offer cannot be exchanged in form of cash/gifts.
• Offer valid for purchase at select participating stores only and valid till August 31, 2018.
• ICICI Bank does not endorse any of the products or brands being offered under the programme and will not accept any liability pertaining to the quality, delivery or after sales service of such products which shall be at the sole liability to Merchant.
• All government levies or taxes, if any, shall be payable by the Cardholder as applicable.
• Any disputes arising out of this offer shall be subject to the exclusive jurisdiction of courts in Mumbai only.
• ICICI Bank reserves the right to modify or change any of the terms and conditions applicable to this offer at any time without prior notice to the Cardholders.
• The participation in the Offer is entirely voluntary and it is understood, that the participation by the Cardholder/s shall be deemed to have been made on a voluntary basis.
• The decision of Samsung India Electronics Pvt. Ltd & ICICI Bank ltd. will be final and binding and any correspondence in this regard will not be entertained.
• No substitutions or exchange of Offer, other than what is detailed in the communication sent to the Card Holder/s shall be allowed
• Samsung India Electronics Pvt. Ltd & ICICI Bank Ltd. retains the right to change or discontinue the Offer at any time during the Offer Period.

IV. ICICI Bank Prescribed Terms and Conditions:

• Terms and Conditions of ICICI Bank and third parties apply. ICICI Bank makes no representation about the quality, delivery, usefulness or otherwise of the goods/services offered by the third party. Nothing contained herein shall constitute or be deemed to constitute an advice, invitation or solicitation to purchase any products/ services of ICICI Bank / third party.
• Images used in all the communications pertaining to the Offer are for representation purpose only.

• If the Cardholder/s ceases to be Cardholder/s at any time during the subsistence of the Offer, all the benefits under the Offer shall lapse and shall not be available to the Cardholder/s.
• All disputes are subject to the exclusive jurisdiction of the competent courts/tribunals of Mumbai.
• In all matters relating to the Offer, the decision of ICICI Bank shall be final and binding in all respects.
• These Terms and Conditions shall be in addition to and not in substitution / derogation to the Primary Terms and Conditions governing the Credit Cards. All capitalized terms used but not defined herein shall have the respective meanings ascribed to it in the Primary Terms and Conditions.
• ICICI Bank holds out no warranty or makes no representation about the quality, delivery or otherwise of the goods and services offered by the merchant. Any dispute or claim regarding the goods and services must be resolved by the Cardholder/s with the merchant directly without any reference to ICICI Bank.
• ICICI Bank shall not be liable in any manner whatsoever for any loss/ damage/ claim that may arise out of use or otherwise of any goods/ services availed of by the Card holder/s under the offer.
• ICICI Bank reserves the right to modify/ change all or any of the terms applicable to the Offer without assigning any reasons or without any prior intimation whatsoever. ICICI Bank also reserves the right to discontinue the Offer without assigning any reasons or without any prior intimation whatsoever.
• ICICI Bank reserves the right to disqualify any merchant or Cardholder/s from the benefits of the Offer if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the Offer.
• All taxes, duties, levies or other statutory dues and charges payable in connection with the benefits accruing under the Offer shall be borne solely by the Cardholder/s and ICICI Bank will not be liable in any manner whatsoever for any such taxes, duties, levies or other statutory dues.
• The Offer is not available wherever prohibited and / or on merchandise / products / services for which such programs cannot be offered for any reason whatsoever.
• The Card Holder/s shall be bound by the terms and conditions stipulated by Samsung India Electronics Pvt. Ltd in this regard.
• No substitutions or exchange of Offer, other than what is detailed in the communication sent to the Card Holder/s shall be allowed. However, ICICI Bank reserves the right to substitute and/or change the Offer or any of them, without any intimation or notice, written or otherwise to the Card Holder/s.
• No two offers can be clubbed or availed together. In case, customer is eligible for two offers then customer will receive better of the two offers.
