Terms and Condition

I. Definitions

For the purpose of these terms and conditions (“Terms and Conditions”), the following terms shall have the meanings ascribed to them hereunder:

• "Customer(s)" shall mean a person who is interested in availing the online credit card services from ICICI Bank.
• "Alliance Partner" shall mean "Provogue India Ltd", who has entered into an alliance agreement with ICICI Bank for purpose of providing the Offer.
• "Offer" shall mean, the Customer(s) who apply for ICICI Bank credit card and submits the requisite documents required for availing the credit card facility from ICICI Bank during the Offer Period.
• "Gift Offer" or "Gift" shall mean a gift of wrist watch worth Rs. 2,499/- from Alliance Partner to the Customer(s), in the event of the Offer being availed by them, during the Program Period and by paying handling charge of Rs. 299 on www.provogue.com/icicicreditcard during the Offer period and upon meeting the requisite criteria for such gift having been duly met by such Customer.
• "Program" shall mean the assured Gift, for the Customer(s) availing the Offer during the Program Period.
• "Offer Period" shall mean the period commencing from April 20, 2015 to May 31, 2015 (both days inclusive).
• "Products/Services" shall mean the goods/benefits/facilities offered by the Alliance Partner.
• "Website" shall mean the following website of the Alliance Partner i.e. www.Provogue.com/icicicreditcard.
• "Void Transaction" shall mean any transaction wherein the transaction has taken place, but has been cancelled /rejected /unsuccessful by Alliance Partner.
• All capitalised terms used, but not defined herein shall have the respective meanings prescribed to them in the Primary Terms and Conditions. These terms ("Terms") shall be in addition to and not in derogation of the Primary Terms and Conditions. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail.

II. Offer

• Any Customer(s) who apply for ICICI Bank credit card and submits the required documents, during the Offer Period i.e. a Customer availing Offer, shall qualify for Gift.
• Offer valid only on Visa & MasterCard Network partner.
• The Offer is non-transferable, non-binding and non-encashable.

Steps to avail the Provogue watch offer:

Customers who are eligible for Gift shall follow the below mentioned process:

• Customer has to Log on to www.Provogue.com/icicicreditcard.
• Customer shall select His/Her wrist watch as per given categories at the website of the Alliance Partner.
• Customer shall make the payment through the ICICI Bank credit card services only.
• Product selected by the ICICI Bank customer will be delivered by Alliance partner to the Customer (s) on availing offer during the Offer Period and upon meeting the requisite criteria.

III. Terms and Conditions for Provogue Watch offer as prescribed by Provogue:

• The Offer is brought to Customers solely by Alliance Partner. ICICI Bank is only communicating this offer on behalf of Alliance Partner.
• ICICI Bank does not guarantee and make any representation about the usefulness, worthiness and/or character of the discount / benefit or of the products/services under the Gift provided by Alliance Partner.
• Gift valid only on his/her wrist watch as per given range.
• Customer will have to pay only handling charges of Rs. 299 as per assigned terms and conditions by Alliance Partner.
• Any person availing Offer shall be deemed to have accepted these terms and conditions.
• Alliance Partner shall not be liable for any claims or grievances, solely attributable to credit card services of ICICI Bank.
• The gift is deliverable only at the serviceable pin codes in India.

IV. Other Terms and conditions:

• The Offer is brought to Customers solely by Alliance Partner. ICICI Bank is only communicating this Offer on behalf of Alliance Partner.
• ICICI Bank does not guarantee and make any representation about the usefulness, worthiness and/or character of the discount/ benefit or of the products/services under the Gift provided by Alliance Partner.
• The existence of a dispute, if any, regarding the Gift shall not constitute any claim against ICICI Bank and shall be addressed directly by Alliance Partner. In the event of any customer claims arising due to any acts and omission on the part of ICICI Bank or claims or fraud related to the credit card, ICICI Bank shall be liable to address such disputes.
• All communication / notices with regard to the said claims attributable to Alliance Partner should be addressed to, Provogue India Ltd., 105 / 106, Provogue house, Off New Link road, Andheri (W), Mumbai - 400053.
• All issues / queries / complaints / grievances relating to the Offer, if any, shall be addressed to Alliance Partner directly at the below mentioned e-mail ID icici@Provogue.com, without any reference to ICICI Bank. The same shall be addressed by Alliance Partner, within 15 working days of transaction. E-mail ID: icici@Provogue.com.
• ICICI Bank shall not be held liable for any delay or loss that may be caused in delivery of the goods and services or the assured gifts / prizes.
• The Offer is not available wherever prohibited and / or on Products / Services for which such Gift cannot be made available for any reason whatsoever.
• If the ICICI Bank user ceases to be so at any time during the Offer Period, then all the benefits under the Offer shall lapse and shall not be available to such ICICI Bank customer.
• Alliance Partner will send the Gift to the cardholder within 21 days from the date the Customer paying handling charge of Rs. 299 on www.provogue.com/icicicreditcard during the Offer period.
• ICICI Bank shall not be liable to any person for any indirect, incidental, consequential, special or exemplary damage or for any financial loss arising out of refusal, cancellation or withdrawal of the Offer or inability of the person to use of Offer for any reason whatsoever. This Offer cannot be clubbed with any other Offer/program that may be made available to the Customer/cardholder by ICICI Bank.
• ICICI Bank shall, with the help of the authorised vendor, attempt to have the Gift delivered at the registered mailing address of the Customer. After the termination of this time period, ICICI Bank shall be under no obligation to entertain any requests or claims for the Gift item. In order for the Gift to be delivered to the Customer, the Customer understands and permits ICICI Bank shall share the Customer(s) details like name, address, phone number etc. with the authorised vendor for delivery of the Gift item.
• Any cancellations or foreclosures on the Offer, before the dispatch of the Gift will amount to cancellation of the Gift Offer to the Customer.
• ICICI Bank shall not be held liable for any delay or loss that may be caused in delivery of the Gift.
• ICICI Bank does not guarantee and make any representation about the quality, usefulness, worthiness and/or character of the Gift, and shall not be responsible if the same, in any way, is found to be defective.
• ICICI Bank shall not be liable in any manner whatsoever for any loss/ damage/ claim that may arise out of the use or otherwise of any goods/ services availed of by the Customers during Offer Period.
No queries shall be entertained after 90 days from the closure date of the Program Period. The existence of a dispute, if any, regarding the Gift shall in no event constitute a claim against ICICI Bank.
• These Terms and Conditions shall be in addition to and not in substitution / derogation to the terms and conditions governing the Offer / Primary Terms and Conditions. All capitalized terms used but not defined herein shall have the respective meanings ascribed to it in the terms and conditions applicable to the Offer / Primary Terms and Conditions.
• ICICI Bank reserves the right to modify/ change all or any of the terms applicable to the Program without assigning any reasons or without any prior intimation, whatsoever. ICICI Bank also reserves the right to discontinue the Program without assigning any reasons or without any prior intimation, whatsoever.
• All disputes are subject to the exclusive jurisdiction of the competent courts/tribunals of Mumbai.
• These Terms and Conditions shall be in addition to and not in substitution / derogation to the terms and conditions governing the Offer / Primary Terms and Conditions. All capitalized terms used but not defined herein shall have the respective meanings ascribed to it in the terms and conditions applicable to the Offer / Primary Terms and Conditions.
• ICICI Bank reserves the right to modify/ change all or any of the terms applicable to the Offer without assigning any reasons or without any prior intimation, whatsoever. ICICI Bank also reserves the right to discontinue the Offer without assigning any reasons or without any prior intimation, whatsoever.
