Terms and Condition

I. Definitions

• "Alliance Partner" shall mean "Croma Retail", who has entered into an alliance agreement with ICICI Bank for purpose of providing the Offer.
• "Card" shall mean Credit card (VISA/ Mastercard/ Amex) or Debit card (VISA/Electron/Maestro), which has been issued by ICICI Bank and is valid and subsisting during the Program/Offer Period.
• "Card Holder/s" shall mean such customer/s to whom a Card has been issued and who is authorized to hold the Card.
• "Offer" shall mean such discount(s) /benefit(s) provided by the Alliance Partner on purchase of Electronics & Other Related Products /Accessories /Services on physical stores and www.croma.com using ICICI Bank Credit Card & Debit during the Offer Period.
• The Offer will be applicable on the use of ICICI Bank Credit & Debit Cards. The Alliance Partner may, on mutual consent of the Parties, use any other gateway for the above Offer if the ICICI Bank payment gateway is down or if the gateway is having functional issues. The Alliance Partner shall ensure that its Website is not down or shut down during the Offer period, except due to Force Majeure Events as mentioned in the Existing Promotional Agreement.
• "Offer Period" shall mean the period from August 11 to August 15, 2018.
• "Primary Terms and Conditions" shall mean the terms and conditions applicable to and which govern the use of ICICI Bank Credit/Debit cards
• "Products/Services" shall mean the goods/benefits/facilities offered by the Alliance Partner
• "Website" shall mean the following website of the Alliance Partner i.e. www.croma.com or any other website of Alliance Partner on which Alliance Partner does the business of retail sale of electronic products/accessories and related services.
• "Void Transaction" shall mean any transaction wherein the transaction has taken place but has been cancelled /rejected /unsuccessful by the Alliance Partner
• All capitalized terms used but not defined herein shall have the respective meanings prescribed to them in the Primary Terms and Conditions. These terms ("Terms") shall be in addition to and not in derogation of the Primary Terms and Conditions. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail.

II. Offer

• This Offer is a joint marketing promotion of ICICI Bank Ltd and Infiniti Retail Limited
• This Offer is valid on ICICI Bank Credit & Debit Cards held by individuals. This offer is not valid on Business, Corporate & Commercial cards

Offer 1:

• Multiple transactions summing up to Rs.15000 or above on an account level will not be eligible for the offer
• One product cannot be bought and billed into two 2 or more invoices i.e. Minimum one product will have to be billed on one invoice for a minimum billing amount of Rs.15000 & above to avail this offer
• Maximum instant discount per card is Rs.1000 during promotion period
• Two offers cannot be combined
• The offer is applicable on home appliances and electronics at Croma store & croma.com
• Cashback for transactions on www.croma.com will be processed within 10 days from date of transaction.
• The discount is valid only on normal transactions including EMI transactions
• Croma will extend Rs.1000 Instant discount upfront to the customer using ICICI bank Credit, Debit Cards provided the customer’s relevant Bank Card Account is active and non-delinquent. Returned transactions, disputed or unauthorized/fraudulent transactions will not be considered for this offer

Offer 2:

• Multiple transactions summing up to Rs.40,000 or above on an account level will not be eligible for the offer
• One product cannot be bought and billed into two 2 or more invoices i.e. Minimum one product will have to be billed on one invoice for a minimum billing amount of Rs.40,000 & above to avail this offer
• Maximum instant discount per card is Rs.2,000 during promotion period
• Two offers cannot be combined
• The offer is applicable on home appliances and electronics at Croma store & croma.com
• Cashback for transactions on www.croma.com will be processed within 10 days from date of transaction.
• The discount is valid only on normal transactions including EMI transactions
• Croma will extend Rs.2000 Instant discount upfront to the customer using ICICI bank Credit, Debit Cards provided the customer’s relevant Bank Card Account is active and non-delinquent. Returned transactions, disputed or unauthorized/fraudulent transactions will not be considered for this offer
• All queries with regards to the offer will be valid/open for escalation only up to 60 days from the date of transaction
• All queries with regards Instant discount are required to be escalated with Bank directly and Infiniti Retail Ltd shall not be responsible and liable for any such claim relating to this offer raised by any ICICI Bank Cardholder.

Other Conditions

• General Terms and Conditions of ICICI Bank are applicable and nothing contained herein shall prejudice or affect the terms and conditions of the card member agreement. The terms of this offer shall be in addition to and not in derogation of the terms contained in the Card members Agreement
• Product warranty will be regulated by the terms and conditions mentioned on the Warranty Card of respective products.

Terms and Conditions as Prescribed by Infinity Retail Limited

• Offers valid only on Credit and Debit cards of ICICI Bank
• Offer is valid only on www.croma.com and physical stores of Croma
• Customer cannot club two offers during the same transaction
• This offer is brought to you solely by Infiniti Retail Limited. ICICI Bank is only communicating this offer on behalf of Infiniti Retail Limited
• ICICI Bank does not guarantee and make any representation about the usefulness, worthiness and/or character of the discount / benefit or of the Products/Services under the Offer provided by Infiniti Retail Limited
• Shipping charges as per assigned terms and conditions by Infiniti Retail Limited
• Products will not be shipped to locations not mentioned in the list of locations that www.croma.com services
• Customer will be required to make payment as per the price quoted by Infiniti Retail Limited on www.croma.com (Infiniti Retail Limited website) or at physical stores
• Service charges as applicable shall be payable by the Customer
• Any person availing of this offer shall be deemed to have accepted these Terms and Conditions
• ICICI Bank and Infiniti Retail Limited reserves the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change or vary all of these terms and conditions or to replace, wholly or in part, this offer by another offer, whether similar to this offer or not, or to extend or withdraw it altogether
• All disputes, if any, arising out of or in connection with or as a result of above offers or otherwise relating hereto shall be subject to the exclusive jurisdiction of the competent courts / tribunals in Mumbai only;
• Infiniti Retail Limited shall not be liable for any claims or grievances solely attributable to ICICI bank Cards

III. Terms and Conditions Prescribed by ICICI Bank

• This offer is brought to you solely by Infiniti Retail Limited. ICICI Bank is only communicating this offer on behalf of Infiniti Retail Limited
• ICICI Bank does not guarantee and make any representation about the usefulness, worthiness and/or character of the discount / benefit or of the Products/Services under the Offer provided by "Infiniti Retail Limited."
• Any tax or other liabilities or charges payable to the government or any other statutory authority/body or any participating establishment, which may arise or accrue to the ICICI Bank debit/credit cardholder due to provision of the Offer, shall be to the sole account of the ICICI Bank debit/credit cardholder. Tax deducted at source, if any, on the monetary value of the Offer shall be payable by the ICICI Bank card debit/credit cardholder
• The existence of a dispute, if any, regarding the Offer shall not constitute a claim against ICICI Bank and shall be addressed directly by Infiniti Retail Limited. In the event of any customer claims arising due to any acts and omission on the part of ICICI or claims or fraud related to the credit/debit card, ICICI shall be liable to address such disputes. • All issues / queries / complaints / grievances relating to the Offer, if any, shall be addressed to Alliance Partner directly at the below mentioned email id customersupport@croma.com Or call at toll free number 1800 258 3636 without any reference to ICICI Bank. The same shall be addressed by Alliance Partner in accordance with its customer support policy/guidelines Email: customersupport@croma.com
• ICICI Bank reserves the right to disqualify the -Offer Partner/s or Cardholder from the benefits of the Program if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the Program or otherwise by use of the Card
• ICICI Bank shall not be held liable for any delay or loss that may be caused in delivery of the goods and services or the assured gifts / prizes
• The Offer is not available wherever prohibited and / or on products / services for which such offers cannot be made available for any reason whatsoever
• ICICI Bank/ Infiniti Retail Limited reserve the right to modify/ change all or any of the terms applicable to the Offer without assigning any reasons or without any prior intimation whatsoever. ICICI Bank also reserves the right to discontinue the Offer without assigning any reasons or without any prior intimation whatsoever.
• If the ICICI Bank credit/debit Cardholder ceases to be so at any time during the Offer Period, then all the benefits under the Offer shall lapse and shall not be available to such ICICI Bank Cardholder
• This Offer is subject to availability of products and can be availed at the sole discretion of Infiniti Retail Limited
• Neither Bank nor any of its subsidiaries or affiliates nor Bank’s member banks nor any of their respective subsidiaries or affiliates (collectively the “Promoters”) assumes any responsibility for the products & services offered or the free gifts provided at Croma stores
• The products and services are sold or licensed or provided by Infiniti Retail Ltd and the promoters accept no liability whatsoever in connection with those products and services.
• This Offer shall be subject to all applicable laws, rules and regulations which are in existence and which may be promulgated anytime by any statutory authority
• Any dispute relating to this Offer shall be subject to exclusive jurisdiction of Mumbai Courts
• Images in the creatives are just for illustration purpose
