Terms and Condition

I. Definitions

• This offer ("Offer") is provided by ICICI Bank Limited ("Bank") and is made available on www.amazon.in or the mobile application or mobile site thereof (collectively, "Website") by Amazon Pay India Private Limited ("Amazon").
• These Offer terms and conditions ("Offer Terms") are in addition to the Website Conditions of Use & Sale and Privacy Notice to which you agree to by using the Website. In the event of any conflict between the Conditions of Use & Sale and these Offer Terms, these Offer Terms will prevail, only for the purposes of this Offer.
• All residents of India holding a valid debit or credit card issued by the Bank (each a "Card") are eligible to avail the Offer (such holders of a Card shall hereinafter be referred to as "Cardholder(s)").
• The Offer is valid on April 18, 2018 only ("Offer Period") unless revoked or extended by Amazon (in its sole discretion), without any prior notice and without liability.
•  Under this Offer, any customer who, during the Offer Period, purchases any of the below worth INR 15,000 or above ("Product(s)") will be entitled to receive a cashback equivalent to 5% of the list price (as determined by the concerned seller) of such purchased Product(s) per successful purchase transaction, provided the payment for the Product is made using the Card.

• The cashback will be calculated on the net amount paid through the Card (after accounting for returns/cancellations, if any, of part of the order). This Offer will not be applicable on the amount of the Products cancelled and/or returned by the Cardholder, seller or Amazon.
• Each Cardholder can avail a maximum cashback of INR 1500 per Card under this Offer.
• The cashback amount under this Offer is completely funded by the Bank, to the total exclusion of Amazon.
• The Offer can be availed only once on each Card during the above mentioned Offer Period. In other words, in the event a customer avails the Offer using a Card in accordance with these Offer Terms, such customer will not be entitled to avail the Offer again using the same Card (whether such customer buys the same Product or a different variant of the Product).
• This Offer is also applicable on payment made by Cardholders using the 'Cash on Delivery' payment option provided that: (a) the order(s) is placed by the Cardholders on Amazon.in during the Offer Duration; and (b) the Cardholder, at the time of delivery of the order, makes the payment via a card accepting machine carried by the delivery associate, using the Card. In the event, for any reason, the card accepting machine is not available or is not working, the Cardholders will not be entitled to avail the Offer.
• The Bank reserves the right to disqualify Cardholder(s) from the benefits of the Offer if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the said Offer or otherwise by use of the Card.
• Amazon reserves the right, at any time, without prior notice, without liability, and without assigning any reason whatsoever, to add/alter/modify/change or vary any or all of these Offer Terms or to replace, wholly or in part, this Offer by another offer, whether similar to this Offer or not, or to extend or withdraw this Offer altogether.
• Delinquent and over-limit Bank's credit card members will not qualify for this Offer.
• Cardholders are not bound in any way to participate in this Offer. Any participation is voluntary and the Offer is being made purely on a best effort basis.
• Nothing herein amounts to a commitment by the Bank or Amazon to conduct further, similar or other offers.
• The above Offer is by way of a special offer and nothing contained herein shall prejudice or affect the terms and conditions of the card member agreement (related to the Card). These Offer Terms shall be in addition to and not in derogation of the terms contained in such card member agreement.
• All disputes between Cardholder(s) and the Bank will be resolved inter se and Amazon will not (nor will be liable or obliged to) mediate or resolve any dispute or disagreement between Cardholder(s) and the Bank.
• This Offer is not valid on corporate or commercial Cards issued by the Bank.
• This Offer is not available on purchase of products other than the Product(s).
• This Offer is also applicable on payment made by customers using the 'Cash on Delivery' payment option provided that: (a) the order for the Product is placed by the customers on the Website during the Offer Period; and (b) the customer, at the time of delivery of the Product, makes the payment via card accepting machine carried by the delivery associate using the Card. In the event, for any reason, the card accepting machine is not available or is not working, the customers will not be entitled to avail the Offer.
• The relevant cashback will be credited in eligible Cardholder's account by the Bank by June 18, 2018. Any queries/issues relating to cashback will be entertained by the concern Bank only till July 18, 2018.
• By participating in this Offer, every Cardholder expressly agrees that Amazon or any of its affiliates will not be liable or responsible for any loss or damage whatsoever that a customer may suffer, directly or indirectly, in connection with this Offer including but not limited to that associated with his/ her use or delivery or misuse of the Product(s).
• These Offer Terms are governed by the laws of India and the courts at New Delhi will have exclusive jurisdiction over any matters/ disputes arising out of or in relation to these Offer Terms.
• Any person availing this Offer will be deemed to have accepted these Offer Terms.
