Terms and Conditions for eBay Offer

I) DEFINITIONS:

"Alliance partner” shall mean eBay India Pvt Ltd as “eBay”, who has entered into an alliance agreement with ICICI Bank for purpose of providing the Offer.

“Customer/s” for the purpose of this Offer shall mean a resident Indian individual/HUF holding an ICICI Bank Savings Account residing in India.

“Offer” shall voucher provided by the "Alliance partner" on purchase of Products/Services using ICICI Bank Debit/Credit/Prepaid/Gift Card or Netbanking services, during the offer period.

“Offer Period” shall mean the period commencing from _______ to ____, both days inclusive.

"Pockets" shall mean the ICICI Bank Facebook application on which Customer/s can register through their ICICI Bank Debit Card and ATM PIN and perform banking transactions.

"Website" shall mean the following "website" of the "Alliance partner" www.ebay.in/icici

"Void Transactions" shall mean wherein the transaction has taken place but has been rejected /cancelled/ been unsuccessful at the ""website"" of the "Alliance partner".

"Voucher" shall mean Promo Code from respective Alliance Partner.

"Primary Terms and Conditions" shall mean the terms and conditions applicable to ICICI Bank’s internet banking facility/service.

“Products/Services” shall mean the goods/benefits/facilities offered by the Alliance Partner.

All capitalized terms used but not defined herein shall have the respective meanings prescribed to them in the Primary Terms and Conditions. These terms (“Terms”) shall be in addition to and not in derogation of the Primary Terms and Conditions. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail.

II) Offer:

ICICI Bank customers who register to Pockets for the first time during the Offer Period will be entitled to get an eBay Voucher offering flat 25% off, for purchases on eBay India Web Site (www.ebay.in).

The availability of the offer is based on the following criteria:

• The Offer is valid only for those ICICI Bank customers who have registered for Pockets for the first time during the Offer Period. Only unique registration will be valid.
• Eligible Customer/s shall be provided the Discount Coupon by mail to their email address registered with ICICI Bank.
• Participation in the Offer by the Customer is on a voluntary basis.
• The Customer may avail the Offer during the Offer Period or until the stock lasts, whichever is earlier.
• This Offer cannot be clubbed with any other Offer that may be made available to the Customer by the Alliance Partner.
• The Offer is non-transferable, non-binding and non-encashable.
• The Offer is not valid for Void Transactions
• In order to register to Pockets, the Customer/s would be required to follow the steps below:
  • Customer would have to login to Facebook from a desktop/laptop.
  • Type "Pockets by ICICI Bank" in their search bar and accept all permissions.
  • Register using their ICICI Bank debit card and ATM Pin.

III) Steps To Avail The Offer

• Visit www.ebay.in/icici.
• Select products of choice.
• Enter your coupon code received for the discount during checkout before making payment.
• Make your Payment through ICICI Bank Net Banking, ICICI Bank Credit Card or ICICI Bank Debit Card/Prepaid/Gift card.

IV) Terms and Conditions Prescribed by Alliance Partner

• This offer is brought to you solely by eBay India Pvt Ltd. ICICI Bank is only communicating this offer on behalf of eBay India Pvt Ltd.
• The offer is valid on purchase of all products displayed on the website.
• To avail the discount on www.ebay.in, the ICICI Bank net banking user/Credit card user should enter the promo code to avail the offer. If the ICICI Bank net banking user fails to enter the promo code, the customer will not be eligible for the discount.
• The offer is valid on purchase of all products on www.ebay.in from July 01, 2014 to September 30, 2014 both days inclusive.
• Customer cannot club two offers during the same transaction. The discount benefit cannot be combined with any other promotional benefit offered for bookings on www.ebay.in.
• The ICICI Bank Internet Banking, Credit or Debit card customer needs to quote the deal code provided to him at the time of booking to be eligible for the discount.
• The ICICI Bank cardholder will be required to make payment as per the price quoted by Alliance partner on www.ebay.in.
• Service charges as applicable shall be payable by the Customer.
• Prior to using the www.ebay.in website, the Customer should read and understand the User Agreement of the said website and proceed to make purchases only if the Account holder agrees to abide by the same. The Customer shall be required to give personal information and account details online for the products purchased on www.ebay.in The ICICI Bank user should read and understand the Privacy policy for the eBay India Pvt Ltd, prior to providing such information.
• Any person availing of this offer shall be deemed to have accepted these Terms and Conditions.
• ICICI Bank and eBay India Pvt Ltd reserves the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change or vary all of these terms and conditions or to replace, wholly or in part, this offer by another offer, whether similar to this offer or not, or to extend or withdraw it altogether.
• ICICI Bank Cardholders are advised to go through the privacy policy for the Ebay website, prior to providing such information.
• You (means the person using this promotion with the intent to receive assured free gift under the ICICI Promotion Offer or the eBay User) should not be in violation and agree to abide with this terms and conditions, the eBay User Agreement, PaisaPay User agreement, eBay Site rules and policies.
• eBay India reserves the right at anytime to amend / add / remove / modify (in whole or part) any of the terms & conditions of this ICICI Promotion Offer, or to replace, wholly or in part, this ICICI Promotion Offer by another Promotion/ Offer, whether similar to this ICICI Promotion Offer or not, or to withdraw it altogether, and eBay India's decision in this regard shall be final.
• All decisions of eBay India regarding running / process / results, of the promotion, data selection shall be final and binding on all participants of this promotion, including you. No appeals will be entertained in this regard.
• In the event of circumstances arising outside of eBay India's control, which in eBay India's opinion make it necessary to suspend, substitute, change or cancel the Offer, eBay India reserves the right to suspend, change, substitute or cancel the Offer at any time without any notice.
• If eBay India has suspicion or knowledge, that any entrant has been involved in any fraudulent or illegal activity related to this ICICI Promotion Offer, eBay India reserves the right to disqualify that entrant and any related entrants. Any entrant user of the eBay Site who, knowingly and with intent to injure, defraud or deceive, files a Fraudulent Complaint containing false, incomplete, or misleading information may be guilty of a criminal offence and will be prosecuted to the fullest extent of the law. eBay India reserves all the rights including but not limited to suspend, block, restrict, cancel the user id and remove all listings of the errant eBay User and its related user id's on the eBay Site.
• eBay India shall not be liable for issues related to technical, human error whatsoever e.g. wrong promotion number being entered by you or you being logged out of system.
• eBay India does not accept, and is not responsible for, any lost or delayed data, communication. eBay India reminds you of the nature and limitations of the Internet and is not responsible for any problems, technical malfunctions of any communications network, online system, computer hardware/ software failure, human error, things outside the control of eBay India that may affect entry/participation to the ICICI Promotion Offer.
• The products or services are listed by third parties, who are responsible and liable for complying with commitments, communications, understanding including but not limiting to guarantees, warranties, services (pre, post sales) between them and you, as also complying with applicable law of the land.
• You understand and agree that participation in the Offer is good and sufficient consideration for you to agree and be bound by these Terms and Conditions.
• Any and all taxes, including without any limitation income tax (if any) applicable on this Offer and the rewards / benefits thereto shall be borne by you and you shall deposit the applicable amount of taxes (if any) to eBay / contract administrator / applicable governmental authorities before user could avail any benefits, unless otherwise mandated under the applicable laws.
• All Gift Code should be redeemed within the promotion period only.
• All communications with you will be, on your email (ID registered on eBay Site) and / or community board.
• The benefits under the Offer CANNOT be clubbed with other offers running on the eBay Site, including vouchers or any other offer available on the eBay Site.
• The employees and the immediate family members of the employees of eBay India and its associate companies are NOT eligible to participate in the Offer.
• All disputes, if any, arising out of or in connection with or as a result of above offers or otherwise relating hereto shall be subject to the exclusive jurisdiction of the competent courts / tribunals in Mumbai only, irrespective of whether courts / tribunals in other areas have concurrent or similar jurisdiction.

• The offer is brought to you by the Alliance partner. ICICI Bank is only communicating the offer on behalf of the Alliance Partner.
• The Offer is valid only for select set of ICICI Bank Net Banking User(s) selected at the sole discretion of ICICI Bank and who have received communication about the Offer from ICICI Bank, during the Offer Period.
• Participation in the Offer by the ICICI Bank Net Banking User/s is on a voluntary basis.
• The ICICI Bank Net Banking User/s may avail the Offer during the Offer Period or until the stock lasts, whichever is earlier.
• This Offer cannot be clubbed with any other Offer that may be made available to the ICICI Bank Net Banking User/s by the Alliance Partner.
• The Offer is non-transferable, non-binding and non-encashable.
• The Offer is not valid for Void Transactions
• ICICI Bank does not guarantee and make any representation about the usefulness, worthiness and/or character of the discount / benefit or of the Products/Services under the Offer provided by the Alliance Partner.
• Any tax or other liabilities or charges payable to the government or any other statutory authority/body or any participating establishment, which may arise or accrue to the ICICI Bank Net Banking User/s due to provision of the Offer, shall be to the sole account of the ICICI Bank Net Banking User/s. Tax deducted at source, if any, on the monetary value of the Offer shall be payable by the ICICI Bank Net Banking User/s.
• All issues / queries / complaints / grievances relating to the Offer, if any, shall be addressed to Alliance Partner directly at without any reference to ICICI Bank. The same shall be addressed by e-bay, only up to a period of 2 days after the date of transaction/purchase.
• The existence of a dispute, if any, regarding the Offer shall not constitute a claim against ICICI Bank and shall be addressed directly by ebay.

• The Offer is not available wherever prohibited and / or on products / services for which such offers cannot be made available for any reason whatsoever.

ICICI Bank also reserves the right to discontinue the Offer without assigning any reasons or without any prior intimation whatsoever.
• If the ICICI Bank Net Banking User ceases to be an ICICI Bank Net Banking User at any time during the currency of the Offer Period, all the benefits under the Offer shall lapse and shall not be available to the ICICI Bank Net Banking User.
