Terms and Conditions of Bill Payments

A. Definitions

In this document, the following words and phrases shall have the meanings as set below unless the context indicates otherwise:

  • NPCI’ refers to the National Payments Corporation of India.

  • Aggregator’ refers to online payment aggregators. These companies facilitate online payments by acting as intermediaries between the Customers and the merchant/biller. 

  • Billers’ refers to government agencies, statutory bodies, companies, corporates, businesses, societies, charities and other entities that collect bill payments.

  • BBPOU’ refers to the Bharat Bill Payment Operating Unit working based on the standards set by NPCI.

  • ICICI Bank’ or the ‘Bank’ refers to ICICI Bank Limited, a company incorporated under the Companies Act, 1956 and licensed as a bank under the Banking Regulation Act, 1949 and having its registered office at Landmark, Race Course Circle, Vadodara 390 007 and corporate office at ICICI Bank Towers, Bandra-Kurla Complex, Mumbai 400 051.

  • Terms’ refer to terms and conditions herein for use of the Bill Payment Facility.

  • Bill Payment Facility’ refers to the bill payment services offered by ICICI Bank to Customers through digital channels such as iMobile Pay App, Internet Banking, Pockets, InstaBIZ, Corporate Internet Banking to pay utility bills for multiple use cases such as electricity, post-paid mobile bills, DTH recharge, etc. Payments can be done through multiple payment modes and payment confirmation will be received through SMS/e-mail/ print receipts.

  • Customer’ refers to end users of the Bill Payment facility.

B. Role of ICICI Bank in the Bill Payment facility

  • The Customer agrees that ICICI Bank is acting solely in the capacity of a facilitator of payments and not in the capacity of a beneficiary/biller/merchant.

  • The Customer understands that the Bank facilitates the Bill Payment Facility through:

    • BBPOU infrastructure where the Biller is registered with NPCI for bill payments.
    • Aggregators with whom the Bank has an agreement.
  • The Customer understands that all payments are routed through NPCI/Aggregator and the Bank has no direct contact with the Biller.

C. Instructions

  • The Customer agrees and accepts that the Bank, through the ICICI Bill Payment Facility, will enable bill payments basis instructions provided by the Customer from time to time.

  • Customer agrees that the record of the instructions given and transactions with the Bank shall be conclusive proof and binding for all purposes and can be used as evidence in any proceeding.

  • All instructions for the Bill Payment Facility shall be given, through a medium/channel enabled by ICICI Bank for the purpose, by the Customer in the manner indicated by ICICI Bank. The Customer is also responsible for the accuracy and authenticity of the instructions provided to ICICI Bank and/or affiliates and the same shall be considered sufficient to operate the Bill Payment facility. ICICI Bank shall not be required to independently verify the instructions and the instruction shall remain effective until such time the same is countermanded by further instructions from the Customer. ICICI Bank shall have no liability if it does not or is unable to stop or prevent the implementation of an instruction, which is subsequently countermanded. Where ICICI Bank considers the instructions inconsistent or contradictory it may seek clarification from the Customer before acting on any instruction of the Customer or act upon any such instruction as it deems fit. ICICI Bank states that it has no liability or obligation to keep a record of the instructions to provide information to the Customer or for verifying the Customer's instructions. ICICI Bank may refuse to comply with the instructions without assigning any reason and shall not be under any duty to assess the prudence or otherwise of any instruction and have the right to suspend the operations through Bill Payment Facility if it has reason to believe that the Customer's instructions will lead or expose to direct or indirect loss or may require an indemnity from the Customer before continuing to operate the Bill Payment Facility.

  • Any instruction, order, direction or request entered using the password of the Customer shall be deemed an instruction, order, directive or request received from the Customer. All instructions, requests, directives, orders or directions entered by the Customer, both electronically and otherwise, are based upon the Customer’s decisions and are the sole responsibility of the Customer. The Customer understands that entering an instruction, direction, order or request with ICICI Bank, electronically or otherwise, does not guarantee execution of such instruction, direction, order or request. ICICI Bank shall not be deemed to have received any instruction, direction, order or request electronically transmitted by the Customer until it confirms the receipt of such instruction, direction, order or request.

D. Accuracy of Information

  • The Customer agrees to provide correct identification details as registered with the Biller. Customer agrees to indemnify the Bank from any liability due to incorrect information in this regard. The Customer also agrees to communicate any change in identification details as registered with the Biller to the Bank within the time specified by the Bank.

  • While the Bank will take all reasonable steps to ensure the accuracy of the billing details, the Bank is not liable for any error. The Customer shall not hold the Bank responsible for any loss, damages, etc. that may be incurred/suffered by the Customer if the information contained in bills turns out to be inaccurate/incorrect.

  • The Customer agrees that they will make bill amount payments as required by the Biller. The Customer will not hold the Bank responsible for the Biller rejecting the bill amount because of incorrect or incomplete information being supplied by the Customer.

E. Disclaimer of Warranties

  • The Customer agrees that the Bank shall not be liable for any damages, losses (direct or indirect) whatsoever, due to disruption or non-availability of any facilities due to any technical error or any failure in telecommunication network or any error in any systems beyond the control of the Bank.

  • Bank shall not be responsible for any technical issue related to periodic retrieval of the bills from the Billers/NPCI/Aggregators or any errors / discrepancies in the bills.

  • The Customer agrees that the Bank is not responsible for any transaction failure due to technical issues at NPCI/Biller/aggregator end.

  • The Customer agrees that the Bank is not liable, if for any reason the Biller refunds the amount and the transaction fails, even after the transaction is deemed successful.

F. Auto Pay Registration

  • If the payment was done from any source other than ICICI Bank, auto-pay will still be executed unless the payment preference is modified to manual or the registration is deleted. In this case, the Bank will not be liable for the ensuing events, consequences, losses, etc.

  • The Customer agrees that the auto pay will only be executed if the bill is presented by the Merchant/Biller with valid details.

  • The Customer agrees that Bank has the right to suspend/terminate the auto-pay registrations if no successful payments are done for <6> consecutive months.

G. Data Collection and Sharing

  • The Customer has no objection whatsoever, to the Biller providing their billing details to the Bank.

  • The Customer consent for sharing necessary data with the third parties to fetch and pay the bills.

  • The Customer permits the Bank to access, store and fetch the latest details from any other relationships with the Bank internally.

  • The Customer authorises the Bank to access, store, fetch and share the necessary data that would be required to share with the NPCI / Biller.

  • The Customer consents to receiving SMS alerts/e-mails/WhatsApp messages about bill payments.

  • In case the Bank collects any personal information or sensitive information, the same shall be dealt with in accordance with the privacy commitment of the Bank, which is available on the website of the Bank at https://www.icicibank.com/nri-banking/rhstemp/privacy-notice-eu-users

H. Indemnity

  • In consideration of ICICI Bank providing the Customer the Bill Payment Facility the Customer agrees, at their own expense, to indemnify, defend and hold harmless ICICI Bank, its directors, employees, representatives, agents and its affiliates against any loss, damage, expense, cost, including, but not limited to, reasonable attorneys' fees and costs awarded suffered by them; or any claim, suit, action or other proceeding brought against them by the Customer or a third party, to the extent that such loss, damage, expense, cost, claim, suit, action of other proceeding is based on or arises as a result of or in connection with:

  • ICICI Bank or affiliates' execution of the Customer's instructions

  • A violation of the Terms by the Customer

  • Any unauthorised use of the Bill Payment Facility by the Customer

  • any misrepresentation or breach of representation or warranty made by the Customer; the Customer will pay ICICI Bank and/or the affiliates such amount as may be determined by ICICI Bank and/or the affiliates to be sufficient to indemnify them against any such loss or expense even though they may not have arisen directly or are contingent in nature.

  • The Customer hereby agrees that under no circumstance shall ICICI Bank's aggregate liability for claims relating to the Bill Payment Facility, whether for breach or tort (including but not limited to negligence) exceed the transaction charges/fees or consideration paid by the Customer within the previous twelve (12) months for bill payment facility excluding any amount paid towards transactions.

I. Governing Law

These Terms shall be governed by the laws of India. The Parties hereby agree that any legal action or proceedings arising out of the Terms shall be brought in the courts or tribunals at Mumbai in India and irrevocably submit themselves to the jurisdiction of such courts and tribunals. ICICI Bank may, however, in its absolute discretion, commence any legal action or proceedings arising out of a violation of the Terms for in any other court, tribunal or other appropriate forum and the Customer hereby consents to that jurisdiction. Any provision of the Terms for which is prohibited or unenforceable in any jurisdiction shall, as to such jurisdiction, be ineffective to the extent of prohibition or unenforceability but shall not invalidate the remaining provisions of the Terms or affect such provision in any other jurisdiction.

J. General

  • Withdrawal of Bill Payment Facility: The Customer agrees that the Bank is at liberty to withdraw at any time the Bill Payment Facility, or any services provided thereunder, in respect of any or all the account(s) without assigning any reason whatsoever, without giving me/us any notice.

  • Change of Terms: ICICI Bank shall have the absolute discretion to amend or supplement any of the Terms and/or terms and conditions stipulated by ICICI Bank and/or its Affiliates pertaining to the Bill Payment Facility and/or to any services/facilities offered by ICICI Bank. The Customer shall be responsible for regularly reviewing these Terms and the terms and conditions stipulated by ICICI Bank including amendments thereto as may be posted on the website. Such amended Terms stipulated by ICICI Bank will thereupon apply to and be binding on me/us from the date of notice. By using any new services as may be introduced by ICICI Bank, the Customer shall be deemed to have accepted the changed Terms stipulated by ICICI Bank.

  • Notices: ICICI Bank may give notices under these Terms to the Customer in writing by delivering them by hand or to the registered e-mail address or by sending them by post to the last address given by the Customer and in the case of ICICI Bank to its corporate office address as set out hereinabove. In addition, ICICI Bank shall also have the right to publish notices of general nature, which are applicable to all Customers in a newspaper or on its web site located at www.icicibank.com. Such notices will have the same effect as a notice served individually to each Customer. Notice and instructions will be deemed served 7 days after posting or upon receipt in the case of hand delivery, cable, telex or facsimile.

  • Clause Headings: The clause headings herein are for convenience only and do not affect the meaning of the relative clause.

  • Assignment: ICICI Bank shall be entitled to sell, assign, or transfer ICICI Bank's right and obligations under the Terms and any security being in favour of ICICI Bank (including all guarantee/s) to any person of ICICI Bank's choice in whole or in part and in such manner and on such terms and conditions as ICICI Bank may decide. Any such sale, assignment, securitisation or transfer shall conclusively bind the Customer and all other persons. The Customer, his heirs, legal representatives, executors, administrators and successors are bound by the Terms. ICICI Bank may sub-contract and employ agents to carry out any of its obligations under this contract. However, the Customer shall not be entitled to transfer or assign any of his rights and obligations hereunder.

  • Grievance Redressal: For any grievances Customer may call Customer Care or raise a Query/Complaint under https://nli.icicibank.com/NewRetailWeb/complaint.htm

K. ACCEPTANCE

  • The Customer hereby expressly acknowledges and confirms that the Customer has read, verified, understood and accepted the Terms online by ticking/clicking the ‘I agree’/ ‘Agree’/ ‘Agree’ and Proceed’ or ‘I agree and accept’ or any similar icon/tab/option online, for as well as by entering the One-Time Password (‘OTP’) received in the Customer’s registered mobile number.
