Terms and Condition

a. Definitions

• "Card" shall mean an ICICI Bank VISA / MasterCard Credit Card issued by ICICI Bank, that is valid and subsisting during the Offer Period (does not include ICICI Bank EMI Card, Corporate Card, Business Card ).
• "Cardholder/s" shall mean such customer/s to whom a Card has been issued and who is authorized to hold the card.
• "Instant EMI" refers to the conversion into EMI upon request by the Cardholder, of transactions performed using the retail Card on EDC (Electronic Data Capture) terminal installed at participating stores or payment gateway of online merchant/s.
• “Offer”: 5% instant discount at Amazon & 5% cashback at participating stores on ICICI Bank Credit Card on EMI transactions as per table given below:

• "Primary Terms and Conditions" shall mean the terms and conditions applicable to the Card in addition to these Terms and Conditions.(“Offer Terms”)
• "Offer Period" shall mean period commencing from 31 July 2018 to 30 November 2018 (both days inclusive)
• “Void Transaction” shall mean any transaction wherein the transaction has taken place but has been cancelled by the merchant prior to settlement with ICICI Bank.

b. Terms and conditions

• 5% instant discount at Amazon & 5% cashback at participating stores
• Offer is applicable on 3,6,9,12 month EMI tenure.
• Offer applicable on maximum 2 transactions per card during the Offer Period.
• Offer valid only at Amazon.in/Amazon app and Card swipe under brand EMI option on Plutus/Pinelabs EDC terminal or Payment Gateway.
• Cashback for all EMI transactions will be credited to Cardholder’s Credit Card account within 90 days from the end of transaction month.
• ICICI Bank & Blackberry retains the right to change or discontinue the Offer at any time during the Offer Period without assigning any reasons or without any prior intimation whatsoever.

C. Other Terms and Conditions –prescribed by Blackberry

• This offer ("Offer") is being provided by ICICI Bank Limited ("Bank") and is made available on the website www.amazon.in or the mobile site or mobile application thereof (collectively, "Amazon.in") by Amazon Pay (India) Private Limited ("Amazon").
• These Offer terms and conditions ("Offer Terms") are in addition to the Amazon.in Conditions of Use & Sale and Privacy Notice to which customer agree to by using Amazon.in. In the event of any conflict between the Conditions of Use & Sale and these Offer Terms, these Offer Terms will prevail, only for the purposes of this Offer.
• Under this Offer, any Cardholder who, during the Offer Period, purchases any variant of a new BlackBerry KEY2 , Evolve & Evolve X smartphone ("Product") on Amazon.in from – (i) Green Mobiles, (ii) Rocket Kommerce LLP, and (iii) Darshita Aashiyana Pvt Ltd (“Participating Sellers”), and makes the entire payment by availing the equated monthly installments (EMI) facility using the Card issued by the Bank, will be entitled to receive an instant discount of 5% on such purchased Product. In other words, customers who purchase the Product in accordance with the above and during the Offer Period will pay the list price of the Product determined by the sellers less 5%.
• This Offer is NOT applicable on payment made by customers using the 'Card on Delivery' payment option.
• The instant discount provided to Cardholders under this Offer is being funded by Bank, to the total exclusion of Amazon.
• The Offer can be availed only once per Card. In other words, in the event a customer avails the Offer using a Card in accordance with these Offer Terms, such customer will not be entitled to avail the Offer again using the same Card (whether such customer buys the same Product or a different variant of the Product).
• This Offer will not be applicable if the Cardholder or the Participating sellers or Amazon cancel the order and/or the Cardholder returns the Product and, in such a case, participation in the Offer will be deemed withdrawn. In such a scenario, only the net amount paid by the Cardholder will be refunded. In other words, the instant discount will not be refunded.
• Amazon and/or Bank reserve the right to disqualify the Cardholder from the benefits of the Offer if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the said Offer or otherwise by use of the Card.
• Amazon and/or Bank reserve the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change or vary any or all of these Offer Terms or to replace, wholly or in part, this Offer by another offer, whether similar to this Offer or not, or to extend or withdraw it altogether.
• Delinquent and over-limit Bank’s credit card members will not qualify for this Offer.
• Cardholders are not bound in any way to participate in this Offer. Any participation is voluntary and the Offer is being made purely on a best effort basis.
• Nothing herein amounts to a commitment by Bank or Amazon to conduct further, similar or other offers.
• All disputes between the Cardholders and Bank will be resolved inter se and Amazon will not (nor will be liable or obliged to) mediate or resolve any dispute or disagreement between the Cardholders and Bank.
• This Offer is not valid on corporate, commercial and EMI Cards issued by Bank.
• This Offer is not available on: (i) purchase of products other than the Product, or (ii) purchase of Products from sellers other than the Participating Seller(s), or (iii) purchase of Product using the Card, but not using the EMI facility.
• By participating in this Offer, every Cardholder expressly agrees that Amazon will not be liable or responsible for any loss or damage whatsoever that a Cardholder may suffer, directly or indirectly, in connection with this Offer including but not limited to that associated with his/ her use or delivery or misuse of the Product(s).
• Any person availing this Offer will be deemed to have accepted these Offer Terms.

Other Terms and Conditions –prescribed by ICICI Bank

• The participation in the Offer is entirely voluntary and it is understood, that the participation by the Cardholder/s shall be deemed to have been made on a voluntary basis.
• Terms and Conditions of ICICI Bank and third parties apply. ICICI Bank makes no representation about the quality, delivery, usefulness or otherwise of the goods/services offered by the third party. Nothing contained herein shall constitute or be deemed to constitute an advice, invitation or solicitation to purchase any products/ services of ICICI Bank / third party.
• Images used in all the communications pertaining to the Offer are for representation purpose only.

• If the Cardholder/s ceases to be Cardholder/s at any time during the subsistence of the Offer, all the benefits under the Offer shall lapse and shall not be available to the Cardholder/s.
• All disputes are subject to the exclusive jurisdiction of the competent courts/tribunals of Mumbai.

• In all matters relating to the Offer, the decision of ICICI Bank shall be final and binding in all respects.
• These Terms and Conditions shall be in addition to and not in substitution / derogation to the Primary Terms and Conditions governing the Credit Cards. All capitalized terms used but not defined herein shall have the respective meanings ascribed to it in the Primary Terms and Conditions.
• ICICI Bank holds out no warranty or makes no representation about the quality, delivery or otherwise of the goods and services offered by the Merchant. Any dispute or claim regarding the goods and services must be resolved by the Cardholder/s with the Merchant directly without any reference to ICICI Bank.
• ICICI Bank shall not be liable in any manner whatsoever for any loss/ damage/ claim that may arise out of use or otherwise of any goods/ services availed of by the Card holder/s under the Offer.
• ICICI Bank reserves the right to modify/ change all or any of the terms applicable to the Offer without assigning any reasons or without any prior intimation whatsoever. ICICI Bank also reserves the right to discontinue the Offer without assigning any reasons or without any prior intimation whatsoever.
• ICICI Bank reserves the right to disqualify any merchant or Cardholder/s from the benefits of the Offer if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the Offer.
• All taxes, duties, levies or other statutory dues and charges payable in connection with the benefits accruing under the Offer shall be borne solely by the Cardholder/s and ICICI Bank will not be liable in any manner whatsoever for any such taxes, duties, levies or other statutory dues.
• The Offer is not available wherever prohibited and / or on merchandise / products / services for which such programs cannot be offered for any reason whatsoever.
