(c)To be eligible, the application form duly filled by the Applicant along with all other relevant documents as required by ICICI Bank as per its extant policies for issuing Cards should have been received by ICICI Bank.

(d)A draw will be held for all the eligible Applicants to whom the Card is issued pursuant to their application during the Offer Period. The draw will be held in mid of December 2005. The draw will choose a selection of 100 winners from among the Card Member by way of randomized computer selection. Each winner would be awarded a voucher which the winner can redeem for one free return Air Deccan ticket at any Participating Establishment ticket counter to travel to any destination where Air Deccan extends its services by an Air Deccan flight between the period from January 1, 2006 to March 31, 2006. The decision to allow selection / any change of schedule / sector would rest with Participating Establishment and would be final and binding. The above mentioned voucher would be delivered only at the billing address of the Card Member.

(e)Any tax or other liabilities or charges payable to the Government or any other authority or body , which may arise or accrue to the Card Member due to the provision of the prizes shall be to the sole account of the Card Member. TDS, if any on the monetary value of the prizes shall be paid by the winner.

All blanks need to be fill in by the Business Groups as per the approval.

Other Terms and Conditions:

a)These Terms & Conditions shall be in addition to & not in substitution /derogation to the Primary Terms and Conditions governing the Card .

b)The participation in this Offer is entirely voluntary and it is understood, that the participation by the Applicant shall be deemed to have been made on a voluntary basis. The participation in the Offer shall be deemed to be acceptance of all the Terms and Conditions governing the offer.

c)The prize enumerated herein shall be non-transferable, non-encashable, non-negotiable, and non-extendable. ICICI Bank reserves the right to change the prize or the number of prizes offered.

d)ICICI Bank shall not be obliged to make any public announcements of the results or to intimate all participants. However, an applicant who wins the prize will be intimated separately by post or email.

e)In all matters relating to this Offer, the decision of ICICI Bank shall be final and binding in all respects.

f)ICICI Bank reserves the right to modify/ change all or any of the terms applicable to this Offer without prior notice to any one. ICICI Bank also reserves the right to discontinue the Offer without assigning any reasons whatsoever.

g)The Participating Establishment is independently liable/ responsible for the quality of goods/services or otherwise provided by it under this Offer. ICICI Bank will not be liable in any manner whatsoever for any loss/ damage/ claim that may arise out of use or otherwise of any goods/ services availed of by the Applicant under this Offer.

h)ICICI Bank is neither responsible nor guarantees the quality of goods/ services at the Participating Establishment nor is it liable for any defect or shortcomings or facilitating process of the goods / services so obtained/ availed or redeemed by Applicant at the Participating Establishment. Any dispute or claim regarding the goods and services must be resolved by the Card Member with the Merchant Establishment directly without any reference to the ICICI Bank.

j)Any dispute arising out of this Offer will be subject to the exclusive jurisdiction of competent courts in Mumbai. The existence of any dispute if any, does not constitute a claim against ICICI Bank .

k)The Offer is not available wherever prohibited for any reason whatsoever.
